COMPENSATION

The monetary relief for loss of wages due to work related injury; also, payment for disability ratings given when disabling injuries occur. Types of compensation paid to employees covered by the Act are: Compensation for disability dependent upon extent of injury. Compensation in stipulated amounts for loss of some part of the body. Compensation for death. Compensation for bodily disfigurement.

Compensation for Death:

Where death is resulted from an injury to a workman who is on receipt of monthly wages not exceeding to Rs 8000 the amount of compensation payable to it heirs will be Rs. 300,000 as specified in schedule. Death benefits are payable to the dependents of the employee. Benefits are first payable to the current spouse for life or until remarriage. Dependent children are entitled to the benefits until they reach age 18, or age 25 if they are actually dependent. Others may qualify, if there is a showing of actual dependency

Disablement

Disablement is the loss of the earning capacity resulting from injurycaused to a workman by an accident. Disablements can be classified as (a) Total, and (b) Partial It can further be classified into (i) Permanent, and (ii) Temporary, Disablement, whether permanent or temporary is said to be total when it incapacitates a worker for all work he was capable of doing at the time of the accident resulting in such disablement.

Permanent Partial Disability

Any injury which results in the complete loss or loss of use of any member or part of the body. Disablement is said to be permanent partial when it reduces for all times, the earning capacity of a workman from every employment, which he was capable of undertaking at the time of the accident. Every injury specified in (Part II of Schedule I) is deemed to result in permanent partial disablement. Permanent Partial Disability (PPD) When a job-related injury results in a permanent disability, the employee may be entitled to PPD benefits based upon the degree of permanent disability.

Permanent Total Disability

Any injury other than death which results in the complete and permanent total incapacity of the employee from following any gainful occupation.
Total disablement is considered to be permanent if a workman, as a result of an accident, suffers from the injury specified in (Part I of Schedule I) or suffers from such combination of injuries specified in (Part II of Schedule I) as would be the loss of earning capacity when totaled to one hundred per cent 100% or more. Permanent Total Disability (PTD) When a job-related injury leaves an employee incapable of returning to gainful employment, the employee may be entitled to PTD benefits. The PTD benefits are payable as long as the employee remains permanently totally disabled.

Temporary Partial Disability

Any injury or disability which reduces the employee ability to work, over here worker is able to work at a smaller rate of earnings than that of his average weekly wage of his occupation at the time of the accident. Temporary Partial Disability (TPD) benefits may be payable if the employee returns to work at a lesser paying job, because of the injury. The TPD benefit amount is to be 50% of the difference between the employees average gross weekly earnings at the time of the injury and the employees actual earnings while temporarily working at the lesser paying job. The three-day waiting period (explained above) also applies to TPD

Temporary Total Disability

Any disability which renders the injured employee unable to perform a regularly established job on one or more calendar days following the day of injury. Temporary disablement reduces the earning capacity of a workman in the employment in which he was engaged at the time of the accident. Temporary Total Disability (TTD) When an injury results in more than three calendar days of disability, the employee may be entitled to TTD benefits beginning on the fourth day and continuing until the employee has returned to work or is medically capable of returning to substantially similar employment, whichever occurs first. The three-day waiting period becomes payable if the disability period exceeds to the fourth calendar days.

At the time of injury workman must have been engaged in the business of the employer and must not be doing something for his personal benefit That accident occurred at the place where he as performing his duties and Injury must have resulted from some risk incidental to the duties of the service, or inherent in the nature condition of employment.
