The President
The President is the Head of State and is elected by the
members of parliament (Article 48).

Article 48(3) of the constitution reflects that consultation
with the Prime Minister excepting the appointment of the
Prime Minister and the Chief Justice is a constitutional
compulsion.

The constitutional provision is as follows:
Article 48(3):
In exercise of all his functions, save only that of appointing
the Prime Minister pursuant to clause(3) of article 56 and
the Chief Justice pursuant to clause (1) of article 95, the
President shall act in accordance with the advice of the
Prime Minister :

The Prime Minister & The Cabinet
The Executive power of the Republic is exercised by or on
the advice of the Prime Minister who commands the
support of the majority members of parliament;

Other ministers, state ministers and deputy ministers are
appointed as per wish of the Prime Minister;

The Prime Minister nominates the cabinet members from
among parliament members and up to one tenths of the
total from outside the parliament;

The cabinet is collectively responsible to the parliament.

The Rules of Business
Legal Origin:

The Rules of Business originated directly from the
constitution of the Peoples Republic of Bangladesh:

Article 55(6) of the constitution is as follows:
The President shall make rules for allocation and
transaction of business of the Government

Some Important Definitions:

Ministry means the division or a group of divisions constituted as a
Ministry.

Division means a self-contained administrative unit responsible for the
conduct of business of the Government in a distinct and specified
sphere and declared as such by the Government.

Attached Department means the department which has direct relation
with a Ministry/Division and has been declared as such by the
government.

Subordinate Office means an office of the Government which has not
been declared as Attached Department and normally does not deal
directly with any Ministry/Division.

Secretary means the Secretary (including acting Secretary) to the
Governments of the Peoples Republic of Bangladesh being the
administrative head of a Division or a Ministry.

The Prime Minister may, whenever necessary,
constitute a Ministry consisting of one or more
Divisions. (It may be mentioned that it can only be
constituted with the approval of the president.)

Where there is a Minister of State /Deputy Minister,
the Prime Minister or the Minister-in-charge with
approval of the Prime Minister may specify by order,
the cases or classes of cases which may be
disposed of by the Minister of State/Deputy Minister.

The Minister shall be responsible for conducting the
business of his Ministry/Division in the Parliament
unless otherwise directed by the Prime Minister.

The Secretary shall be the administrative head of the
Ministry/Division.

He shall be responsible for its administration and discipline
and for proper conduct of business assigned to it. He shall
also be responsible for careful observance of these rules.

The Secretary shall keep in the Minister-in charge informed
of the working of the Ministry/Division.

The Secretary shall be the Principal Accounting Officer of the
Ministry/Division, Attached Departments and Subordinate
Offices

Orders, agreements, contracts-
All executive actions of the Government shall be
expressed to be taken in the name of the
President.

(Article 55(4): All executive actions of the
government shall be expressed to be taken in the
name of the president.)

Field Administration
Division (Commissioner); District (Deputy
Commissioner); Upazila (UNO);

Major duties of Commissioner are to monitor,
coordinate and supervise the implementation of
policy decisions initiated by the government;

Field Administration (District)
The administrative unit that figures most prominent is
District;

The responsibility of DC is vast and varied. S/he represents
government at the field level, conduct all polls and act as
Collector, development co-coordinator, disaster manager,
and guardian of administration at the lower level.

S/he is the chief protocol officer representing government
ceremonies on behalf of the national government.

To be brief there are little or no activity in the district, which
is unrelated to him/her by some way or other.

Field Administration (Upazila)
The basic unit of administration of the country is
Upazila.

Field level functionaries of the development
departments operate here at the grass-root level
under guidance from the respective functional
heads stationed in the districts as coordinated by
the UNO (Upazila Nirbahi Officer).

State Owned Enterprises
Established under certain Act/Regulations and has
autonomous entity;

Businesslike enterprise having the motive of public interest;

Can purchase or sell properties in the name of its own;

Such organizations can file cases to the court and it also be
sued against by others;

Can make Agreement/Contracts;

Can take loan from the bank.
