    This is the response I received from Getty after my initial reply. In this letter it becomes clear that Getty Images is not truly interested in protecting the intellectual property rights of their artist as they claim but are using these settlement demand letters as a business model for profit. In my opinion what Getty is doing is tantamount to legalized extortion by demanding inflated sums of money on images that have been proven to be nonwillful an innocent infringement's and refusing any proof of claim whatsoever that they have rights to collect damages on behalf of of their artists.Getty Images uses fear tactics such as these demand letters which look like legal cases are pending, artificial payment deadlines before escalation occurs and the threat of legal action if payment is not made within 14 days. While doing all of the above items Getty refuses to provide the proof reasonably requested by letter recipients like myself who were willing to negotiate and reach a reasonable settlement as long as proof of claim was produced.

As you may know, Getty Images Rights-managed images are exclusive to Getty Images and only for sale through us. The copyright is owned by our represented photographer for whom we have exclusive agreements to not only represent their images through licensing the use of their intellectual property to our customers, but to also protect them against unauthorized use, otherwise known as copyright infringement. If we don't ensure that this image is appropriately licensed or if we allow infringers to be excused with just a cease and desist letter, our photographer are not getting paid for the use of their work. As you can understand, our effort in enforcement is to protect the intellectual property of our represented photographers, preserving the value of their work that we've been entrusted to maintain and protect. After careful consideration, Getty Images is willing to accept $625.00 as full and final settlement of the demand that was recently presented to Yeah, We Do That. This offer is made conditionally and it will automatically be withdrawn if full payment is not postmarked by April 24, 2012. Getty Images hopes that the added consideration given to reduce this settlement demonstrates our mindful attention to the circumstances; as such we encourage prompt payment of this settlement as offered.
