12-12-02 PRESS RELEASE: New, invisible electronic signatures in the Israeli courts "The Emperor's New Clothes"
[Hebrew text below // ] In a recent request filed under the case of the self-immolated, social protest activist Moshe Silman, the new system of invisible electronic signatures in Israeli court records is described as "The Emperor's New Clothes". The filing came in response to a recent decision by Magistrate Avigail Cohen, explaining that the Tel Aviv District Court serves orders, not signed by the judges, accompanied by transmittal letters, not signed by the clerks, since the records are signed through "electronic signatures in Net HaMishpat". Net HaMishpat is the electronic case management system of the Court, where no public access is permitted. In his last letter, Silman levels serious accusations against Judge Hagai Brenner and the Tel-Aviv District Court, relative to conduct of his litigation against the Social Security Administration. Indeed, the case of Moshe Silman provides unique documentation, how Net HaMishpat is employed to conduct simulated proceedings in the Tel-Aviv District Court.

Jerusalem, December 2 in a request, filed in the Tel-Aviv District Court under the case of the self-immolated, social protest activist Moshe Silman, a system of invisible electronic signatures in court records of the Israeli district courts is described as "The Emperor's New Clothes". The request states that there is no technical reason, preventing the Court from serving papers, which signed using visible electronic or hand signatures. [1] According to a recent decision by Magistrate Avigail, the Tel-Aviv District Court serves orders, which are not signed by the judge, accompanied by transmittal letters, which are not signed by the clerk, since these records are signed through "electronic signatures in Net HaMishpat". Net HaMishpat is the electronic case management system of the Court, where no public access is permitted. [2] The court request was filed as part of efforts, since July 2012, to access records of the Tel- Aviv District Court in the cases related to the late Moshe Silman and Bituach Leumi (the social security administration). According to Regulations of the Courts of the State of Israel, and a decision by former Presiding Justice Dorit Beinisch of the
Supreme Court (both from the past decade), in order to inspect court records in Israel, one must file a request with the court, and the request is decided by the judge, who holds the court file. In his suicide letter, the self-immolated social protest activist Moshe Silman levels serious accusations against Judge Hagai Brenner and the Tel Aviv District Court. Indeed, the records, so far discovered, show that Silman was subjected to simulated proceedings in the Tel-Aviv District Court: [3] The Court refused to accept a request to inspect under the original complaint file, claiming it never existed. Judge Hagai Brenner, who affected the closing of the secondary complaint file, also affected the closing of an appeal from his own decision. Decisions under the appeal file were listed in the case management system of the Court, while missing from the public access system of the Court, and the Court knowingly failed to serve the same decisions on the filer of the request to inspect. Decisions on the request to inspect under the secondary complaint file were only served unsigned by a judge, accompanied by a transmittal letter, unsigned by a clerk.\ In both the complaint and appeal files, the Court denies access to a docket of his own requests and related decisions, even to the filer himself. The recent request again asks the Court to serve its decisions signed by the magistrate and with transmittal letters signed by the clerk of the court, using visible electronic, or hand signatures. The recent filing also asks the Tel Aviv District Court to provide copies of previous decisions on the request to inspect, certified "true copy of the original" by Chief Clerk Kobi Bleich. With it, the Court is also asked to produce the appointment record of Chief Clerk Kobi Bleich. The reason, provided for the requests, is that the preponderance of the evidence indicates that the Tel-Aviv District Court is conducting simulated proceedings even on the request to inspect itself. The court has so far failed to respond on previous similar requests. The Human Rights Alert (NGO) 2013 submission for the Universal Periodic Review (UPR) of Human Rights in Israel by the Human Rights Council of the United Nations documents large-scale fraud in implementation of the Electronic Signature Act (2001) and in implementation of new electronic record systems in the courts, starting 2002. [46] The submission is titled, "integrity, or lack thereof, of the electronic record systems of the courts of the State of Israel," and subtitled, "a court, which refuses to certify its own records, is certified corrupt." The submission documents falsification of court records in the Supreme Court, in the district courts, and in the detainees' courts of the State of Israel. The fraudulent systems, which have been implemented in the Israeli courts over the past decade, copied central features from systems (PACER and CM/ECF), which had been implemented in the US courts a decade earlier. [7] The earliest fraudulent system of this type is believed to be Sustain, implemented around 1984 in the Los Angeles Superior Court. [8-9]
