10.5 What Are Legal Rights and Protections?

Whats the Fifth Amendment? Legal Rights 5 rights: grand jury, double-jeopardy, selfincrimination, due process, just compensation. All apply to people accused of crimes or who are involved in legal disputes.

Right to grand jury: for serious crimes, they decide if person will go to trial or not. What if youre found not guilty? Double jeopardy: Person who was not found guilty cannot be tried again. Self-incrimination: Police cant force people to say things that could be used against them in court. Miranda Warning

Due Process of Law: government must follow clear rules as it carries out the law; every person is innocent until proven guilty, gment must prove case beyond reasonable doubt. Just Compensation: Gment must pay a fair price for all property it takes over (i.e. for roads or parks).

How long do you wait until you go to trial? Speedy and public trial by an impartial jury. Who makes up the jury? Jury consisting of people who live in the defendants area. Right to hear and question all witnesses. Right to an attorney.

Whats the Seventh Amendment? Civil Trial Rights


Civil trial: Disputes between people or businesses. Right to jury trial. Once a jury decides, no judge can overrule the decision.

Whats the Eighth Amendment? Bail and Punishments


Forbids excessive bail. Forbids excessive fines, and cruel and unusual punishments. Prohibits poor prison conditions.

10.6 Other Rights and Powers


Whats the Ninth Amendment Not all rights of the people could be listed in the Bill of Rights. This amendment states that other rights not listed are kept by the people.

Whats the Tenth Amendment? Powers Reserved for States


Powers not given to the natl. government are reserved for states and the people.
