Email us: Jobs@LBPC.com Consultants predict more firms to merge in 2013 By Jerry Crimmins Law Bulletin staff writer This year will feature increasing consolidation among law firms through mergers, more client pressure on rates and more competition for law firms from nontraditional sources such as off- shore legal providers. These are among the predictions of four experts on law firms. The consultants also foresee: *High-rate legal practices will fare better than low-rate practices in client acceptance of raised rates; *Business will get better this year for lawyers in federal regulatory areas and in tax work. One consultant, Joel F. Henning of Joel Henning & Associates, said he predicted a potential good year for law firms. "My current thinking," Henning said, "is that if Congress doesn't bumble too much on the debt ceiling and coming to terms with a responsible set of government cost cuts, we will see the best business year since 2005-06, and law firm business should benefit." Kent M. Zimmermann, a consultant with the Zeughauser Group; Joseph B. Altonji, principal of LawVision Group; and Ward Bower, principal of Altman Weil Inc. also offered their predic- tions. Zimmermann said pressure on rates will get tougher for lawyers in lower-rate practice areas in 2013 and this trend may accelerate. "There is a smaller supply of attorneys who perform with strength in the highest rate practice areas," Zimmermann said. So "that keeps prices for that work high." A study last year by TyMetrix Legal Analytics and the Corporate Executive Board found that partners who charge $800 an hour or more were able to raise their rates at three times the pace of lawyers who charge lower rates, Zimmermann said. Craig N. Raeburn Jr., managing director of TyMetrix, said three high-rate law practices in Chicago are corporate and general business; finance, securities, banking and investments; and merg- er, acquisition and divestiture. Insurance litigation is an example of a low-rate legal practice, Raeburn said. Altonji said there will be "overall limited growth in hours for most firms" in 2013. "Growth will continue to require market share acquisition," Altonji said, "either by winning new clients, lateral hires or occasional mergers." In 2012, on average, business for law firms looked flat, Altonji said. "But only a few firms are 'average,'" Altonji said. "Some are having great years, year over year, while others have had several bad years in a row with little sign of improvement." In addition to tax lawyers and lawyers who deal with federal regulations, Altonji also said trusts and estates lawyers "will remain busy" due to new tax rates on estates. Bower said the deal reached at year-end by Congress and President Obama "will introduce more certainty to the business climate and thereby lead to investment and hiring by business. But we still have to deal with debt and spending issues at a federal level, which could impact businesses and thereby law firms. It ain't over." If Congress can eventually solve the budget impasse, Bower said, "it could create a surge of deals and investment and law firms will benefit." He said he foresees "continuing consolidation" of law firms, "and the pace of big mergers and cross borders could pick up." He said "nine of the 60 or so mergers in 2012 were cross border." Henning and Zimmermann also predicted more consolidation. Regarding fees, Henning said clients "will become even more aggressive about resisting 'automatic' fee increases." Corporate counsel will refuse across the board increases, he said. Some clients, Henning said, "will allow only carefully pinpointed increases for lawyers who are clearly providing added value." A trend that will accelerate this year, Zimmermann said, is that law firms will continue to try to lower the cost of legal services by using "career associates who make far less than partner track attorneys," as well as using "outside contract attorneys and attorneys who work for legal process outsourcers," known as LPOs. "If you are running a large firm," Zimmermann said, "why pay an associate $160,000 plus benefits and other overhead when you can get the same work done for half the cost and at better quality from an LPO?" LPOs use "attorneys in low-cost locations in the U.S. and offshore," Zimmermann said. "The vast majority of large firms" are using "LPOs at their clients' insistence." Henning said traditional law firms will encounter growing competition from LPOs that now offer "broader and more sophisticated services." Competition will also come from "alternative-type law firms such as Axiom," he said. Axiom says most of its attorneys work onsite with clients, so their offices vary with each engagement. The holidays really spoiled me this year. Now I have to get over it. The good thing is, it was light when I left work last night. So whats my point. The point is, Happy New Year. I know you know its the New Year. This is just a reminder that it is time for a fresh start. As in any profession a paralegal will have highs and lows in the career. Working as a paralegal for many years I have seen times when I hated my job (those were the lows) and the time when I cannot wait to get to work because I like what I do (yep, those are the highs). Now is the time to put a new spin on being a parale- gal. Even if you have worked for many years as a paralegal as I have, it is time to look with new eyes at the job. So how do you start? In my case I have been noticing lately that as I am preparing assign- ments I am thinking of what could have been done early on to make the assignment easier. So this means taking notes as you work and creating your own checklists and forms. I have noticed that in almost every case there are certain documents I use. So, I made a note that from now on, I will make sure those docu- ments are in hand, in the file and scanned so they are at my finger- tips. This is not the time to re-invent the wheel. Just take a look at forms and checklists you have been using and, if needed, update them. Do not skimp on your reading time. Keep up to date with the paralegal profes- sion and the law by reading bar journals and other professional p u b l i c a t i o n s . Remember, that blogs and list serves are won- derful tools but not always substantive ways to stay current. Clean off your desk and update your office. It is time to move the boxes around, put away the ones you can, dust and clean. It is amaz- ing how a little cleaning can really make a dif- ference. Update your person- al profile on LinkedIn. Use this professional tool. While some con- sider LinkedIn another job search method, I consider it part of building a professional profile. Keep up with other professionals. Add information about your professional activ- ities. My personal proj- ect is to put up a pro- fessional picture. These are just a few simple ways to update your career without changing jobs or doing anything terribly dra- matic. Have fun.
