ourunderstanding
that
the
administration
of
GovernorTomCorbett
has
signed
a
long-term
contract
with
CamelotGlobal
Services
PA
LLC
(Camelot)
tooperate
and
manage
the
Pennsylvania
Lottery.
As
you
know,
the
contractcannot
become
effective
unlessand
until
the
Office
of
Attorney
General
approvesthe
contract
for
form
and
legality
under
the
CommonwealthAttorneys
Act.’
We
write
to
youtoday
to
urge
you
nottoapprove
thiscontract
for
form
and
legality.
Undersection
204(t)
of
the
CommonwealthAttorneysAct,
if
the
Attorney
General
determines
that
a
contract
is
not
statutorily
authorizedor
is
unconstitutional,
the
Attorney
General
is
required
to
notify
the
Governor’s
Office
of
General
Counsel
andtheGeneral
Assembly
of
thatfact.
We
urgeyouto
carefully
consider
your
important
obligation
underthis
statute
while
you
are
reviewing
the
PrivateManagement
Agreement
(PMA)
with
Camelot.
The
PMA
poses
serious
financial
and
legalquestions
that
have
yetto
be
satisfactorily
answered
by
the
Corbett
administration.
Chief
among
our
concerns
is
that
thiscontract
was
awarded
and
signed
without
statutory
authority.
As
wehave
publicly
stated
for
some
time,
it
is
ourdetermination
that
an
amendmentto
Pennsylvania’s
LotteryLaw
is
required
for
GovernorCorbett
to
enter
into
such
an
agreement.
And,
as
thiscontract
is
dependent
upon
a
dramaticexpansion
of
gaminginPennsylvania
with
the
widespread
introduction
of
Keno
and
online
gaming,
it
is
clearthat
such
gamingexpansionmust
be
vetted
and
approvedby
vote
of
the
General
Assembly.
Inshort,the
Executive
Branch
of
this
Commonwealth
has
overstepped
and
usurpedthe
authority
of
the
Pennsylvania
Legislatureby
unilaterally
executing
a
20-to-30-year
contract
that
significantly
expands
gamingopportunities
inPennsylvania.Theactions
of
the
Corbettadministration,relative
tothe
Camelot
PMA,
are
clearlycontrary
to
Pennsylvanialaw.
We
are
enclosing
for
your
use
a
draft
of
an
amicus
brief
we
are
preparing
to
file
insupport
of
the
petitioners
in
the
case
filed
by
AFSCME
and
others
contesting
the
Governor’sauthority
to
enter
into
the
PMA
with
Camelot.2
