Minutes of the Tanworth-in-Arden Parish Council Meeting


held on Thursday 15th November 2012 at 19.30 hours in The Church Room, St Mary Magdalene
Public Forum There was 1 member of the public present, together with County Councillor Perry, District Councillor Atkinson and District Councillor Oakley. Report from County Councillor Perry Councillor Perry brought some maps indicating the speed limits for Dyers Lane, Forshaw Heath Road and Valley Road. There is dispute over a 50mph sign outside Broadmead in Forshaw Heath Road as to whether it is on private land or Highways land. County Councillor Perry said that he has written to Susan Steele at Stratford District Council concerning the yellow lines in the keyhole in Malthouse Lane and is awaiting a reply. An appeal is being made to bus pass holders to respond to letters asking for photographs before their passes expire in March 2013. Bus passes can be renewed at Elizabeth House. County Councillor Perry is arranging a site visit with an officer from Warwickshire County Council to see where dropped kerbs are required in Tanworth Village to improve disabled access. Councillor Stanton will also be included in this site visit. Councillor Perry has spoken to Simon Bennett from the County Council about the disabled parking bays in the village requested by the Parish Council. He reported that this was something that the County didnt appear to be able to help with. The bays would not be enforceable and he didnt think that the roads were wide enough. He will ask again to see if there is any way around this. 26 primary routes will be gritted through the winter and secondary routes will be gritted if they are dangerous. Snow blowers have been bought to clear the pavements this year. Warwickshire Fire and Rescue Service have released its Integrated Risk Management Plan for consultation. Warwickshire Fire and Rescue is the best performing authority in the country with property and vehicle fires down by 10% and dwelling fires down by 16% to an all time low. Report from District Councillor Atkinson: District Councillor Atkinson reiterated the point that the County Council would not put in disabled bays because they are not enforceable. At a recent meeting of the Regulatory Committee the Monitoring Officer was instructed to appeal against the Shottery decision in its entirety. The keyhole in Malthouse Lane has been tarmaced. There is soon to be a meeting with a representative of Orbit Housing and Councillor Atkinson is trying to arrange for Orbit to fund the double yellow lines. The refuse lorries have difficulty turning in the keyhole because of cars parked. Jenny Buckley asked Councillor Atkinson how far into Malthouse Lane the yellow lines would go. Councillor Atkinson said that this has not been decided yet. Councillor OBrien stated that there is generally free access for the refuse lorries. Councillor OBrien asked Councillor Atkinson if the appeal for the 800 houses in Shottery had been lost because the Core Strategy was not in place. Councillor Atkinson did not think that this was the case. Councillor OBrien then went on to ask if 800 houses go up in Shottery does this mean that the number of new houses identified for Local Service Villages will be reduced. Councillor Oakley said that the decision will have no bearing on the number of houses to be built elsewhere. Councillor Oakley said that there was a general problem with traffic in Malthouse Lane with large vehicles having a problem getting out. He said that there used to be a turning point just before the entrance to The Lakes but this has been done away with. Councillor Willmott said that it used to be used as a car park so could not be used as a turning area.

Report from District Councillor Councillor Oakley said that he was as the meeting of the Regulatory Committee concerning the Shottery decision. They couldnt disclose anything in public so that the case would not be weakened when it goes to the High Court. The public felt that decisions were being made behind closed doors because details were not being put into the public domain. The decision was to advise the Monitoring Officer to take action in the High Court. The Secretary of States decision to allow outline planning permission is extant until such time that the ruling is overturned in the high court. The decision will need to be overturned on planning grounds and the bar to overturn planning decisions in the High Court is set very high. Councillor Oakley had been to a Consumer Partnership meeting which discussed how Credit Union Services can help people who have difficulty in budgeting and provides help for the poorest people who have difficulty sorting their finance. Councillor Oakley has some leaflets which he will place in the parish office. The Public Forum closed at 20.05 hours

Present: Councillor Willmott (Chairman), Councillor Stanton, Councillors Fitzpatrick, Councillor Instone, Councillor OBrien and Councillor Oakley In Attendance: Julie White - Clerk to the Council 12/13/148 - Apologies for absence Apologies for absence were received from Councillor Waters, Councillor Keogh, Councillor Ross, Councillor Jones and Councillor Cunningham. The reasons given for absence were accepted by the Parish Council. 12/13/149 - Declarations of Personal or Prejudicial Interest Councillor Oakley declared a personal interest in item 12/13/158 because one of the security quotes was supplied by a family member. 12/13/150 - To Confirm and sign the Minutes of the Parish Council Meeting 18th October 2012 Councillor Stanton proposed that the minutes were a true and accurate record. Seconded by Councillor Instone seconded the proposal. All those present at the last meeting were in favour. Councillor Willmott signed the minutes of the last meeting. 12/13/151 - Matters arising from the minutes not otherwise dealt with none 12/13/152- Matters raised in the Public Forum Councillor Oakley expressed his disappointment that 40 years after the Disabilities Act it didnt seem possible to put in two disabled parking bays in the village. 12/13/153 - To Note Items of Correspondence Received The correspondence list was received and noted. The following items were highlighted. 6.76 SDC Resurfacing the keyhole in Malthouse Lane 6.77 - Lynda Rogers Registered the parish Council tree in the Royal Records of trees planted in Jubilee Year 6.83 Donation from Earlswood Lakes Fete Committee 6.90 - WCC Submission of Waste Core Strategy 6.91 - TIA 1857 Trust Letter asking for payment of the outstanding 7,500 owed from PC 6.102 Pam Moore suggestion for white lines indicating pedestrian walkway in keyhole 12/13/154 - Finance i) Councillor Willmott proposed that we adopt the minutes of the Finance Committee from 4th October 2012. Seconded by Councillor Oakley. All in favour. ii) Chairmans report: The budget was discussed at length and Cllr Willmott asked that any suggestions for inclusion in the budget are e-mailed to him. We are still unsure, as yet, as to whether or not the precept is going to be capped. iii) Items for payment: It was proposed by Councillor Oakley and seconded by Councillor Stanton that the payments were taken en bloc except for the new computers which are to be discussed under item 12/13/159. All in favour. 12/13/155 - Planning i) Councillor Instone proposed that we adopt the minutes of the Planning Committee Meeting from 4th October 2012, seconded by Councillor Willmott. All in favour.

ii) Chairmans Report. Councillor OBrien reported that he and Councillor Ross had been to a workshop. Councillor OBrien asked for permission from the Parish Council to ask the Clerk to contact SDC to arrange a meeting with a planning officer to put our points across on the following matters: 30% rule, Greenbelt protection, Conservation Area. The Clerk reported that application 12/01660/FUL Well Meadow is going to planning committee on November 21st. Councillor Oakley agreed to speak on behalf of the Parish Council. Councillor Oakley reported that the Government are abolishing the Village Green Provision next summer so if anyone has anywhere in mind to designate as a village green there is only 8 months left to register it. Councillor Oakley reported that the Greenbelt Network is alive and well. It now has a President, Chairman and Vice Chairman together with draft Articles of Association. Councillor OBrien thanked Councillor Oakley for the tremendous amount of work that he has put in to get this group off the ground and it will be a great asset. iii) The following decisions were noted:
Application Number 12/01374/FUL 12/01757/VARY Address Arnolds Wood House, Cut Throat Lane The Field House, Forshaw Heath Road Proposal Change of use of existing bungalow 2 from an ancillary dwelling to a separate dwelling. Removal of condition 3 on 09/01144/FUL to allow occupation of the dwelling without complying with the agricultural occupancy condition. Decision Refusal Permission

iv) To consider the following planning applications:

12/13/156 To Confirm the Meeting Dates for 2013 Councillor Willmott proposed that the meeting dates for 2013 are accepted. It was noted that the meeting on May 2nd may have to be moved due to local elections. Seconded by Councillor Stanton. All in favour. 12/13/157 To Discuss a New Parish Travel Scheme This was discussed again and Councillor Willmott said that he would see if he could budget for it. Councillor Oakley left the room at this point whilst the next item was discussed.

12/13/158 - To Receive Updates/Recommendations from Office Security Working Party Councillor OBrien reported that the working party had met recently. The quotes received before were not like for like. Each quote had been scrutinised and the priorities addressed. The three companies have now been asked to requote based on external lighting for the immediate outside area, outer door buzzer access, inner door access, 1 way glass on inner door and 1 CCTV camera to view outer door. A panic button in the office is also to be included in the quote. Councillor Oakley rejoined the meeting. 12/13/159 To Ratify The Decision of The Finance & General Purpose Committee to Purchase New Office Computer Equipment It was proposed by Councillor Willmott and seconded by Councillor OBrien that the decision to purchase new computer equipment is ratified. Payment was approved. All in favour. 12/13/160 To Consider a Recommendation From the Finance & General Purpose Committee to Make The Neighbourhood Plan/s Committee a Sub-Committee of The Finance & General Purpose Committee Councillor Willmott made the proposal that the recommendation of the Finance & General Purpose Committee to make The Neighbourhood Plan/s Committee a Sub-Committee of The Finance & General Purpose Committee is accepted. It was proposed that this sub-committee is mandated to make all necessary decisions to take the Neighbourhood Plan/s as far as a final draft. The final draft must be approved by Full Council. Others may be co-opted from outside the parish council as felt necessary by the sub-committee. All reasonable expenses may be given to the sub-committee by The Clerk from petty cash. Seconded by Councillor OBrien. The resolution was passed. 5 votes in favour and 1 abstention. 12/13/161 To Discuss War Memorial 2014 Centenary Celebrations Councillor Fitzpatrick said that he would like to have The Green decorated. He asked if research could be done on the soldiers from the area who served in World War I. It was suggested that Val Tonks may be able to help. Some members questioned if the celebrations should be in 2018 to commemorate the end of the war instead of 2014 which would be commemorating the outbreak of war. The Clerk will see what the Government guidelines are. 12/13/162 - To Consider Granting Dispensation to Councillor Jones In Respect of all Dealings with the 1857 Inclosure Award Trust It was proposed by Councillor Willmott that Councillor Jones is granted dispensation in respect of all dealing with the 1857 Inclosure Award Trust until October 2015. Seconded by Councillor Fitzpatrick. All in favour. 12/13/163 To Consider Appointing A Parish Council Representative on The Canal & River

Trust Multi-Agency Committee


It was agreed that the Parish Council would have a representative on this committee. Councillor Keogh to be appointed if she is agreeable. All in favour. 12/13/164 - Any Items for Community Forum - None 12/13/165 - Work Around The Parish - none
