    DearMessrs.MoynihanandO'Keefe: Asashareholderandattorney,IwritetomakeyouawarethatBankofAmericamaybe partytoanillegalpyramidscheme.Namely,thereissubstantialevidencethatHerbalifeLtd.isan illegal pyramid scheme operating under the guise of a health products company. Upon investigation,however,itappearsasthoughHerbalifemaypaymoremoneytoparticipantsinits businesstorecruitnewparticipantsthanitdoesforsaleofitsproducts.Thisisillegal.See,e.g., Websterv.OmnitritionIntern.,Inc.,79F.3d776(9thCir.1996). BankofAmerica isaidingHerbalifeinmaintainingandperpetuatingthatschemeand thus, may itself be liable for injury caused by it. Specifically, Bank of America provides HerbalifearevolvingcreditfacilitythatenablesHerbalifetomaintainandextenditsscheme. Assoonaspractical,pleaseconfirmtomethatyouhaveinvestigatedtheseissuesand ceasedallinvolvementwithorsupportofHerbalife.IfyouchoosenottoinvestigateHerbalifeor not to cease your involvement therewith, please provide me the legal basis justifying your decision,includingatminimum the opinionletterfromyourcounsel uponwhichyourely.
