That
Council give first, second and third reading to Township of Langley ControlledSubstance Property Bylaw 2006 No. 4537 Amending Bylaw 2009 No. 4722.
EXECUTIVE SUMMARY:
Township of Langley Controlled Substance Property Bylaw 2006 No. 4537 was adoptedMarch 26, 2007. Township of Langley Controlled Substance Property Bylaw 2006 No. 4537Amending Bylaw 2009 No. 4722 is an amendment to add housekeeping amendments.Section 5.1 of the Controlled Substance Property Bylaw No. 4537 currently reads as follows:5.1 Every person who is the registered owner of a property that contains a building, astructure or other premise that is subject to a Tenancy Act agreement:a) must inspect the premises, buildings or structures at least once during everyperiod of three consecutive calendar months to ascertain whether this bylaw inrelation to the premise, building or structure, musti) within 24 hours of the discovery of the contravention, deliver writtennotice to the Bylaw Offices of the particulars of the contravention, andii) subject to the
Residential Tenancy Act 
, within two months of thedelivery of the notice, take such action as may be necessary to bringthe premises into compliance with this bylaw so that the Manager,Permit Licence and Inspection Services may remove the “Do NotOccupy” notice posted under section 7.1.The amendment to the Controlled Substance Property Bylaw 2006 No. 4537 to read as:5.1 Every person who is the registered owner of property that is subject to a tenancyagreement must inspect the property, including all buildings and structures thereon,at least once every three consecutive calendar months to ascertain whether thisbylaw has been contravened, and if a contravention of this bylaw is found, must:a) within 24 hours of the discovery of the contravention, deliver written notice to theManager of Bylaw or designate of the particulars of the contravention; andb) subject to any applicable tenancy legislation, within two months of the delivery ofthe notice, take all action necessary to bring the property, including all buildingsand structures thereon, into compliance with this bylaw.
 
CONTROLLED SUBSTANCE PROPERTY BYLAW 2006 NO. 4537AMENDING BYLAW 2009 NO. 4722Page 2…Section 8.3 of Bylaw No. 4537 is being amended by deleting the reference to 5.1(b)(i) andinserting 5.1(a).Staff have reviewed the proposed amendment with Township legal staff and are satisfied thatthe amendment will address the issue of owners taking responsibility for regular inspectionsof their properties.
