New Agent 1. Believing a bank robbery is imminent, two FBI SWAT team vehicles trap the suspects white car in the Arvins Farm and Garden Center parking lot along Route 22 in Readington Township. One SWAT vehicle pushes the car into the other, pinning it. 2. An agent throws a flashbang device from the front passenger seat of one SWAT vehicle toward the drivers side of the robbers white car. A new agent who ultimately shoots agent Barry Bush mistakes the flashbang explosion for gunfire from the suspects. 3. As the flashbang is thrown, SWAT agents exit the van through the rear and right side with responsibility for opposite sides of the car. The new agent had been told specifically to guard the passenger side of the robbers car against any threat.

New Agent 4. As the flahsbang is thrown and the agents deploy, Bush arrives at the passenger side of the robbers car to help with the arrest. Hes driving a bureau-issued black Chevy Impala, which the new agent mistakes for the robbers other car, a black Honda Civic.

New Agent 5. The new agent sees Bush emerge from the black car. Believing that the robbers have fired, that Bushs car is the robbers car, that Bush is a robber and that his team is under a mortal threat, the new agent fires three rounds from an M4 rifle, striking Bush once, fatally.
