Hello neighbors!,
‘We hope this letter finds you and your family well! We've been delighted to have
everyone an Ossington, Foxley, and the surraunding streets as aur neighbors and in that vein,
we would like to inform yau of a few changes we'll be making to our restaurant as we wish to
gather your thoughts and opinions
We intend to apply to the city for a small 23-seat backyard garden patio that serves food
and alcohol for lunch and dinner to patrons during the warmer months. This will be a long and
complex process however we would like to keep you abreast of our intentions and have an
open dialogue with you to address any concems or questions you may have. With that in mind,
we have attached a list of conditions that will apply to our garden patio. These conditions will
serve us and the neighborhood well as we believe they strike a balance between our need to
operate a successful business while placing the concems of our neighbors first. Hawker Bar
wants to be a great neighbor bath to your family and to the Ossington-Littie Portugal community.
We have been in contact with aur city councillor Mike Layton so that he too may contribute to
this discussion.
We'd like to give you a clear idea of what type of garden patio we'd like to create: it will
be a small 23-seat garden patio featuring extensive use of foliage as both decor and sound-
reducing devices. There will be no speakers or music present on the garden patio. Moreover,
we will construct a caver on top of the patio to significantly lessen any potential noise
disturbance. And, as per our committed patio conditions, we will close the garden patio at 11pm
We intend for the garden patio ta be a small, intimate space for those to come and enjoy our
great food and drink.

Attached: Conditions on Hawker Bar, 164 OssingtanGarden Patio Conditions
1. The Licensee shall not sell or serve and shall not permit consumption of liquor after 11 p.m
n the patios or other outdoor areas of the premises.
2. The Licensee shall not provide or permit music in outdoor areas of the premises
3. The Licensee shall not provide or permit amplified music or other forms of entertainment in
indoor and outdoor areas of the premises. Amplified music or other forms of entertainment in
indoor areas of the premises are only permitted during one-time, non-recurring special events,
and only at levels that are not likely to disturb the quiet, peace, rest, enjayment, comfort,
convenience or safety of the nearby neighbourhood inhabitants in their residences.
4. The Licensee shall not have any of the following in operation on the premises: videos
arcade-type or ather electronic games, manual games, pool/olliard table, karaoke machine and
microphones, jukebox.
5. The Licensee shall ensure that any sound resulting from the operation of the business is not
audible beyond a reasonable distance from the lot line of the property an which the premises
are located. This clause refers to sound that is generated by any conversation by patrons within
the premises, bussing of tables, garbage and bottle disposal. A reasonable distance for such
sound to be considered in non-compliance is any paint opposite the Licensee's premises that is.
separated by a public street, public or private laneway or a parting wall between the Licensee's
premises and any adjacent space
6. Atall times while the premises are open, the Licensee shall ensure that the back door to
the premises is locked and that patrons are prohibited from using the back door and the back
landing as an extension of the indoor facilities or as an alternative exit, except for a fire exit.
7. The Licensee shall post prominent signage at the main exits that remind and/or encourage
patrons to be considerate of the residents of the surraunding community.
8. The Licensee shall ensure that private or special events can only be available to patrons-
attendees deemed mature enough by the Licensee to conduct an event that does not create
disturbances including naise and behavioural issues for adjacent neighbours
9. The Licensee shall ensure that a staff member patrols/monitors the events to ensure that
noise is Kept to a reasonable volume
10. The Licensee shall provide a telephone number for residents to register concerns or
complaints. This line will normally be answered by a staff member during the Licensee's,
published hours of operation. This line will be equipped with a functioning answering service for
those periods when the Licensee's staff is otherwise occupied and when the establishment isclosed
11. The Licensee shall ensure that there is a designated and supervised area for
smokers that does not adversely affect property adjacent to the premises
12. The Licensee shall use best efforts to ensure that all areas immediately adjacent to the
establishment are clean and free of ltter, refuse and other debris.
13. The Licensee shall use best effarts to arrange garbage collection and recycling at times that
will not disturls nearby residents.
14. The Licensee shall install a visualnoise barrier to minimize the emission of the noise trom
the patio.
