ORDER Upon consideration of the Administrative Record, the relevant law, and the parties briefs submitted in connection with Plaintiffs Motion for Summary Judgment (Dkt. No. 13) and Defendants Motion for Summary Judgment (Dkt. No. 18), and for the reasons set forth in the accompanying Memorandum Opinion, it is hereby, ORDERED that Defendants Motion for Summary Judgment (Dkt. No. 18) is GRANTED, and Plaintiffs Motion for Summary Judgment (Dkt. No. 13) is DENIED; and it is FURTHER ORDERED that the action against Defendant is dismissed with prejudice.
