Description
I received a copyright "settlement demand" letter from Timothy B. McCormack at McCormack Intellectual
Property Law based in Seattle. They claim their client, Getty Images, has retained them in an alleged copyright
infringement case against my company. The photo image originally used was taken by Jupiter Images, a stock
photo company that Getty acquired in 2008. Jupiter also used other stock photo outlets to sell similar images
such as iStock (also a Getty recent acquisition). The letter demands $1,400. in payment for an image that is
very similar in content that be purchased royalty free for $50 to $170 (see attached Jupiter website examples).
Getty's internal legal team originally wanted a $875. MobilityWorks made an offer to Getty's legal team back
in 2011 for $170. to settle based on a very similar image found on their site. Mr. McCormick now wants
$1,400. I found the same image online today (Aug 3, 2012 for $353. for use up to 3 months. Getty and Mr.
McCormack cannot prove how long the image appeared -- or as to whether a web development vendor
purchased it legally for our purposes from Jupiter before the Getty acquisition. We have not been provded a
date-stapmed copy of the image file on disc so that they can prove it wasn't photo-shopped for the purpose of
making money with these tactics. They have also not produced a complete list of all Jupiter clients from 2007-
2008 for cross-referencing web development vendors. Until they do, thousands of companies are open to this
form of strong-arming by Getty and Mr. McCormick.
