COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:

___________________________________________________________________________________________ Complainant, Gregory Freeman, of the Minneapolis Police Department, has investigated the facts and circumstances of this offense and believes the following establishes probable cause: That on April 9, 2013, at approximately 5:45 p.m., officers were dispatched to a boarding house located at 2413 10th Avenue South, in Minneapolis, Hennepin County, Minnesota, on a welfare check. In route, officers were advised by dispatch that a resident of the boarding house was reporting his roommate, JAMES CURTIS DAWKINS, hereafter Defendant, was having an emotional breakdown, was destroying items within the residence and causing other residents concern for their safety. Officers were familiar with the Defendant from prior police contacts. During many of these prior contacts, the Defendant has been openly hostile with officers and has engaged in violent assaultive behavior. Officers entered the residence and located the Defendant. The defendant was immediately hostile towards officers and initiated a physical confrontation with them. Officers attempted to subdue the Defendant but he continued to punch and kick the officers. During the altercation, the Defendant bit down onto the gloved left index finger of one of the arresting officers. The officer screamed in pain but the Defendant continued to bite down until the officers finger was bitten off at the first knuckle. The Defendant was eventually subdued and arrested. The injured officer was transported to the hospital. The bitten off portion of the officers finger was located inside his glove. The portion of finger was preserved and brought to the hospital for possible reattachment. Officers subsequently learned the bitten off portion of finger could not be surgically reattached and that the injured officer would be permanently disfigured. At present, the defendant is in custody.

STAT. 609.221, SUBD. 1; 609.101, SUBD. 2; 609.11 PENALTY: 0-20 YEARS AND/OR $30,000 That on or about April 9, 2013, Minneapolis, in Hennepin County, Minnesota, JAMES CURTIS DAWKINS , using a dangerous weapon, assaulted Victim and inflicted great bodily harm.

NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49. THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
