AResolutionUrgingCongresstoAdoptaConstitutionalAmendmenttoReversetheCitizens
Unitedv.FECrulingbyclarifyingthatcorporationsarenotpeoplewithconstitutionalrights
andthatunlimitedcampaignspendingisnotfreespeech
WHEREAS,theUnitedStatesConstitutionandtheBillofRightsareintendedtoprotecttherightsof
individualhumanbeings(realpeople);and,
WHEREAS,corporationsarenotmentionedintheConstitutionandThePeoplehavenevergranted
onstitutionalrightstocorporations,norhaveWedecreedthatcorporationshaveauthoritythat c
exceedstheauthorityof"WethePeople;"and,
WHEREAS,corporationscananddomakeimportantcontributionstooursocietyusingpowerful
advantagesthatgovernmenthaswiselygrantedthem,butthe[CityCouncil/legislature]doesnot
considerthemrealpeople;and,
WHEREAS,UnitedStatesSupremeCourtJusticeHugoBlackina1938dissentingopinionstated,"I
entincludescorporations";and, donotbelievetheword'person'intheFourteenthAmendm
WHEREAS,theUnitedStatesSupremeCourtrecognizedinAustinv.MichiganChamberofCommerce
(1990)thethreattoarepublicanformofgovernmentposedbythecorrosiveanddistortingeffects
ofimmenseaggregationsofwealththatareaccumulatedwiththehelpofthecorporateformand
upportforthecorporationspoliticalideas;and, thathavelittleornocorrelationtothepublicss
WHEREAS,theUnitedStatesSupremeCourtinCitizensUnitedv.FederalElectionCommission
(2010)reversedthedecisioninAustinandtheportionofMcConnellv.FederalElectionsCommission
thatupheldbansoncorporateandlabortreasuryfundsforelectioneering,andpresentsaserious
threattoselfgovernmentbyrollingbackpreviousbansoncorporatespendingintheelectoral
processandallowsunlimitedcorporatespendingtoinfluenceelections,candidateselection,policy
decisionsandpublicdebate;and,
WHEREAS,theopinionofthefourdissentingjusticesinCitizensUnitednotedthatcorporations
havespecialprivilegesnotenjoyedbyrealpeople,suchaslimitedliability,perpetuallife,and
favorabletreatmentoftheaccumulationanddistributionofassets,thatallowthemtospendhuge
sumsoncampaignmessagesthathavelittleornocorrelationwiththebeliefsheldbyrealpeople;
and,
WHEREAS,corporationshaveusedtheartificial"rights"bestoweduponthembythecourts
tooverturndemocraticallyenactedlawsthatmunicipal,stateandfederalgovernmentspassedto
curbcorporateabuse,therebyimpairinglocalgovernments'abilitytoprotecttheircitizensagainst
orporateharmstotheenvironment,toconsumers,toworkers,toindependentbusinesses,tolocal
ndregionaleconomies;and,

WHEREAS,theUnitedStatesSupremeCourtheldinBuckleyv.Valeo(1976)thattheappearanceof
corruptionjustifiedsomelimitsoncontributionstocandidates,butitwronglyrejectedother
fundamentalintereststhatthecitizensof[jurisdiction]findcompellingsuchascreatingalevel
playingfieldandensuringthatallcitizens,regardlessofwealth,haveanopportunitytohavetheir
politicalviewsheard;and,
WHEREAS,federalcourtsinBuckleyandinSpeechNow.orgv.FederalElectionCommission(2010)
overturnedspendingandcontributionlimitsonindependentcampaignsthathelpedlevelthe
politicalplayingfieldbecausetheyconcludedthatthethreatofcorruptionwasonlyapplicableto
directcontributionstocandidates;and,
WHEREAS,theUnitedStatesSupremeCourtinFirstNationalBankofBostonvBellotti(1978)and
CitizensAgainstRentControlv.CityofBerkeley(1981)rejectedlimitsoncontributionstoballot
andidatecorruption;and, measurecampaignsbecausetheyconcludedtheyposednothreatofc
WHEREAS,UnitedStatesSupremeCourtJusticeStevensobservedinNixonv.ShrinkMissouri
GovernmentPAC(2000)thatmoneyisproperty,itisnotspeech,whiletheCourtdeclinedtostrike
downlimitsoncontributionssolongastheydidnotdriveacandidatesvoicebelowthelevelofnotice;
and,
WHEREAS,aFebruary2010WashingtonPostABCNewspollfoundthat80percentofAmericans
opposetheU.S.SupremeCourtCitizensUnitedruling;and,
WHEREAS,[CityCouncilors/statelegislators]havesworntoupholdtheUnitedStatesConstitution
inourOathofOffice;and,
WHEREAS,ArticleVoftheUnitedStatesConstitutionempowersandobligatesthepeopleofthe
UnitedStatesofAmericatousetheconstitutionalamendmentprocesstocorrectthoseegregiously
wrongdecisionsoftheUnitedStatesSupremeCourtthatgototheheartofourdemocracyandthe
republicanformofselfgovernment;
NOW,THEREFORE,BEITRESOLVEDthatthelegislatureof[XCity/State]supportsamendingthe
UnitedStatesConstitutiontoclarifyseveralmisinterpretationsoftheConstitutionbydivided
actionsoftheUnitedStatesSupremeCourtthathaveculminatedinthewronglydecidedCitizens
Unitedv.FederalElectionCommission.Theamendment(s)shouldmakeclearthatcorporationsare
notpeoplewithconstitutionalrightsandshallhaveonlytheprivilegesbestoweduponthemby
theircharters;bystateandfederallaw;andtheinalienablerightsoftherealpeoplewhoaretheir
shareholdersormembers.Further,theamendmentshallclarifythatmoneyisproperty,itisnot
speech,andthatinordertoensurethatallcitizens,regardlessofwealth,haveanopportunityto
expresstheirviewstotheirfollowcitizensandtotheirgovernmentonalevelplayingfield,the
amountofadvertisingthananyonecitizenmaypurchasetoamplifytheirspeechshouldbelimited
tolevelsthatdonotoverwhelmothercitizens.
