Use of Force Defined


DRC Administrative Rule 5120-9-01 defines force as exertion or application of a physical compulsion or constraint. Less-than-deadly force means any force which could not reasonably be expected to result in the death of the person against whom it is directed. Excessive force means an application of force which, either by the type of force employed, or the extent to which such force is employed, exceeds that force which reasonably appears to be necessary under all the circumstances surrounding the incident. Deadly force means any force that carries a substantial risk that it will proximately result in the death of any person.

Use of Force Guidelines


AR 5120-9-01 establishes the following guidelines for officers use of force: Staff members shall evaluate the need to use force based on the circumstances as known and perceived at the time it is considered. Staff may use force only to the extent deemed necessary to control the situation; staff shall increase or decrease the level of force as resistance increases or decreases. Staff should attempt to use the least amount of force necessary. Force or physical harm shall not be used as punishment. Medical attention for any individual injured during a use of force incident will be provided as soon as practical.

Key Statistics
Total use of force incidents increased by 10.0 percent from CY 2008 2012. In 2012, there were 4,203 uses of force, the lowest number since 2008. Lebanon Correctional Institution, which houses Level 3/close security offenders, had the highest number of use of force incidents in 2012 with 512 incidents. Southern Ohio Correctional Facility, which houses Level 4/maximum security offenders, had the highest use of force rate in 2012.
