Dear Mr. Larson:
Thank you for your recent letter attaching my previous correspondence and sharing your
continued concerns about the legislation authorizing the use of force passed after the 9/11
attacks. I appreciate your continued interest in this matter.
My staff contacted the Congressional Research Service and was informed by their
specialist in international security that Section 1622 (b) of the National Emergencies Act that you
quoted was overridden by Public Law 107-40, signed into law by former President Bush on
September 18, 2001. The authority to use force authorized in this law continues until additional
legislation is passed repealing the authority granted to the president. I have enclosed a detailed
report on the background and implications of PL 107-40, which I hope provides useful
information.
