    In this 6-18-09 Letter From Frank Wolf to me regarding the National Emergencies Act, Rep. Frank Wolf says his staff checked with the Congressional Research Service, who informed them the 2001 Authorization for Use of Force overrides Section 1622 (b) of the National Emergencies Act, which requires Congress to meet no later than every 6 months to consider a vote on whether to lift the State of Emergency.

    Dear Mr. Larson:

    Thank you for your recent letter attaching my previous correspondence and sharing your
    continued concerns about the legislation authorizing the use of force passed after the 9/11
    attacks. I appreciate your continued interest in this matter.

    My staff contacted the Congressional Research Service and was informed by their
    specialist in international security that Section 1622 (b) of the National Emergencies Act that you
    quoted was overridden by Public Law 107-40, signed into law by former President Bush on
    September 18, 2001. The authority to use force authorized in this law continues until additional
    legislation is passed repealing the authority granted to the president. I have enclosed a detailed
    report on the background and implications of PL 107-40, which I hope provides useful
    information.
