Conditional Decree against the corrupt Enforcement Authority a medievalstyle debtor court system:
Numerous requests and decisions over several years, with no
Conditional Decree or summons to establish jurisdiction.
No protocols for the hearings.
Judgment was filed under a different case number...
After No 30, the Requests stop being numbered,
What is striking is that through numerous Decisions and a Judgment
there is no judicial statement regarding factual or legal arguments in this
case. Regardless, through the decision on response by State authorities, it
is evident that false electronic records and failure to perform the duties of
Office of the Clerk were at the heart of the matter.
The Israeli courts themselves ruled that a tribunal operating with no lawful
Office of the Clerk is an incompetent tribunal. The Enforcement Authority is
surely a tribunal, authorized to take the Liberty and Properties of individuals,
and various other rights, and the evidence shows that it operates with no
Office of the Clerk in its various bureaus.
Conduct of the Israeli Supreme Court, led by Presiding Justice Ashe Grunis
in Ashkenazi and 76 others v Minister of Justice should be deemed fraud,
breach of loyalty, and patronage of organized state crime by the
Enforcement Authority.
Corruption of the courts and the legal profession is central to the current
socio-economic crisis in Israel.

DECISION
1.
In the Petition before us, the Petitioners complain of three different aspects in
conduct of the Bureaus of the Enforcement and Collection Authority: First that
Decisions of the Magistrates that are longer than 17 lines are not noticed and
served, second that notice and service in general is conducted by regular mail,
and not by certified mail, and third that fees of NIS 4.00 per page are charged for
copying the decisions, which the Bureaus failed to serve.

In the preliminary response by the Respondents, the Respondents affirm that
decisions longer than 17 lines are not mailed to the debtors. That is caused by
some technical limitations. The Responders do not challenge the fact that current
conduct is neither correct nor appropriate. In an updated July 11, 2011 Notice we
were informed that the electronic record systems of the Bureaus are scheduled to
be updated in the last quarter of 2011, and with the implementation of the new
systems, the problem would be resolved.

We did not find substance in the claim that all decisions of the Magistrates of
the Bureaus have to be served by certified mail. In this matter, refer to Regulation
24(a) of the Regulations of the Bureaus 1979. The end of the Regulation says:
A record that may be served by mail, shall be served by uncertified mail with no
certificates of delivery, unless instant Regulations explicitly state otherwise. From
such statement it is clear that the rule is that there is no duty to serve the records
of the Bureaus, including decisions, by certified mail, except for cases, where it is
otherwise stipulated. For example, Warning to the Debtor must be served by
certified mail (such duty originates in the definition of Full Service in Article 1, the
Bureaus Act 1967).

Regarding the claim of payment of NIS 4.00 per page for copying Bureau
decisions: The Response, filed by the Respondents, supported by an Affidavit by a
Senior Assistant Director of the Enforcement and Collection Authority, says that
copying of decisions that are not served is free of charge. The Response says that
only when a second service of decisions is requested, fees of NIS 3.00 per page
are charged (see detail (a)(11) to Appendix to Regulations of the Bureaus (Fees,
expenses) 1968),.
5.
Therefore, there is substance only in the first claim by the Petitioners,
regarding failure to mail decisions that are longer than 17 lines. As stated, soon,
the electronic systems, which manage the Bureaus will be updated, then and there
the problem would be resolved. The State Prosecution shall file an update no later
than October 11, 2011.

DECISION
We head counsel for both Petitioners and the Responders in both Petitions. We
also heard explanations from Mr Medioni, Director of the Enforcement and
Collection Authority. It turns out that at present, a new system is introduced for
management of the Authority. We heard that the new systems should be
operational at the end of the first quarter of 2013. The system should address the
matters in both petitions.
Under such circumstances, it appears to us right that the Responders file an
update no later than the end of January; 2013. The Petitioners in both Petitions
shall then Reply within 30 days. Once all filings are complete, we shall decide on
further processing of the Petitions.

JUDGMENT

It is obvious that position of the Petitioners in 804/12 that that the Petition is now
moot, since the Responders updated and improved the relevant procedures in the
Bureaus. We hold under the circumstances that the Petitioners shall be awarded
some legal expenditures. Since their Petition, even if it did not achieve all its
goals, contributed to the update and improvement of the procedures.
The Petition in High Court of Justice 804/12 is therefore removed.
Responders shall pay Filing Fees and Attorneys Fees in the sum of NIS 5,000.
