Hi folks, I received an email form a TX pro life leader that outlined some legal concerns with respect to the

admitting privileges regulation. However, there is a deeper issue that I think TX pro lifers need to consider as they approach the enemies gates in the name of God and with His authority. Namely who do we serve? God or men? ________________

I appreciate what you are trying to do, but I have to tell you I am a little concerned because the Fifth Circuit did leave an opening for the abortion advocates to come back with specific examples of the requirement preventing access. If hospitals are willing to defy both state and federal law (requiring that they not exclude doctors specifically because they do abortions), it could give them a basis to have the Court reconsider the privileges requirement altogether. If that happens, we could lose the added layer of protection it provides by at least keeping the worst actors out of the industry. Have you considered consulting with a lawyer about this? TX Pro Life Leader I have not consulted an attorney, but I do have a law degree. =-) Your point is well taken, but the Roe v. Wade decision upon which all this rests is bad law. Abolitionists who fought slavery never convinced the Supreme Court to reconsider their decision to support slavery in the Dred Scott case but slavery still ended. I think any strategy that is dependent on getting a rogue court on our side is misguided at best. Its a rogue court that changed the abortion laws in nearly every U.S. state and in so doing violated the unalienable right to life that trumps any Supreme Court decision. And that was possible because of public opinion and the silent complicity of so many Americans. Too many pro lifers are on the defense and in a symbiotic relationship with abortionists I dont think they intended for that happen but its the reality we face today. Christ was crucified because he was a revolutionary in the eyes of the state and the self appointed, self anointed religious leaders of his day. He refused to play ball with Rome. I doubt Christ would be trying to placate a Supreme Court that created a right to privacy from thin air in Griswold v. Connecticut in order to change the birth control laws that ultimately led to the slaughter of millions of babies in Roe v. Wade. I think Christ would be admonishing us to serve God and stop worrying about serving a godless Supreme Court. He would probably be swaying public opinion by doing what He did best: encouraging people to turn from their sins and serve God. Christ never received the support of the courts and the churches of his day but his courage and actions still reverberate through history. Ultimately he was willing to sacrifice his life in defense of the truth along with his disciples. There are no scriptures of Christ abandoning his mission because Rome, the Pharisees, and Sadducees disagreed with his theology. Pontius Pilate pleaded with Christ to surrender to the state and recant. The church leaders would have been lenient if he simply acknowledged their authority over Him.

But he was steadfast and said the only authority that mattered was Gods authority. And when it came to harming children he was quite specific when he warned the world about the consequences, Take heed that ye despise not one of these little ones; for I say unto you, That in heaven their angels do always behold the face of my Father which is in heaven. Matt. 18:10 The Supreme Court has no standing when it comes to unalienable rights and the Declaration of Independence spells out our recourse if injustices are not cured in a reasonable about of time, We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Declaration of Independence, July 4th, 1776. Interestingly, the Declaration of Independence was adopted as law by all of the U.S. colonies. When I read the Lincoln-Douglas debates I noted that Lincoln kept saying they should rip the pages out of the statute books if they didnt believe in those truths I did some research and realized he was talking about the colonies who had adopted it as law. Lincoln fought against slavery and lost the Senatorial election but he didnt give up because he was on the side of God. Congress, The Supreme Court, and all the laws of the south were firmly against the abolitionists. But Judge Douglas (a defender of slavery) pointed out the strategy that works: a revival in the churches and schools, Mr. Lincoln, following the example and lead of all the little Abolition orators, who go around and lecture in the basements of schools and churches, reads from the Declaration of Independence, that all men were created equal, and then asks, how can you deprive a negro of that equality which God and the Declaration of Independence awards to him? He and they maintain that negro equality is guaranteed by the laws of God, and that it is asserted in the Declaration of Independence. If they think so, of course they have a right to say so, and so vote. I do not question Mr. Lincolns conscientious belief that the negro was made his equal, and hence is his brother, (laughter,) but for my own part, I do not regard the negro as my equal, and positively deny that he is my brother or any kin to me whatever. Never. (cheers) Judge Douglas, Lincoln-Douglas Debates of 1858. Prior to the abolitionists the politicians of the day attempted to negotiate with the darkness. They were willing to compromise and even called their sinful legislation the Missouri Compromise. They said they were willing to tolerate slavery so long as it didnt continue to spread but the darkness doesnt compromise. Later the Nebraska Act rescinded the Missouri Compromise and slavery continued to spread across the country. Congress affirmed slavery. You can imagine how empowered the sinners must have felt when the darkness threw them a bone. Look, were limiting slavery hurray for us! The abolitionists recognized that compromising with the darkness on God given unalienable rights was a recipe for failure. And they ended the two party system that existed in that day: The Whigs and the Democrats. The Republican Party was formed by abolitionists who refused to continue down the path of

negotiating a settlement on the topic of slavery. They wanted to abolish it. Today most Americans dont even know there was a Whig party that compromised on the issue of slavery. If pro lifers sit on the sidelines and do nothing for fear of what a Supreme Court might do (the same court that legalized abortion across America) then the law is toothless. And even if what you fear comes to pass that only brings more glory to God. Let them bring it before the court and possibly overturn it. Let the court have another opportunity to reaffirm their decision to side with the darkness or turn back to God. And let the people potentially see that the Supreme Court will not save the babies whose death warrant they signed in 1973. And praise God let the fearful pro lifers realize that placing their faith in the Supreme Court and negotiating with the darkness rather than placing their faith in God was a mistake. Or maybe God is bigger than our biggest fears and the law gets affirmed and the 30 mile radius becomes the law of land. We wont know until ->we<- do the right thing. The Supreme Courts battle is against God who is undefeated throughout eternity. Their battle is not with pro lifers who with a few exceptions are on the defensive and rationalizing their inaction (myself included). Note: I tell everyone God has a really good sense of humor if Im in his army. I am not a shining example of what everyone should do but I occasionally recognize what I think were supposed to be doing. ;-) The Bible says the gates of hell shall not prevail against the church. Gates are a defensive structure which means the church is supposed to be attacking the gates of hell not running in the opposite direction and giving up ground. Instead were an army full of Jonahs seeking a whale to contemplate our rebellion against God. Sadly, in far too many locations the sidewalks in front of abortion clinics are empty. And far too many leaders in the church are unwilling to stand up against blatant sin in their congregations and in their cities. As long as that continues we shouldnt expect people turn from their sin and serve God. If the shepherds lead the sheep into the rocks and abandon them out of fear of what the wolves might do to them are they really shepherds? Weve been in the belly of the whale for over 40 years now its time to march to our Nineveh and tell the people to pray. This country is in peril because God is just and not a single sin is missed. 56 million of Gods children have been murdered and a high price is going to be paid. Here is what Thomas Jefferson said when he contemplated the cost our nation would pay because of the sin of slavery, God who gave us life gave us liberty. Can the liberties of a nation be secure when we have removed a conviction that these liberties are the gift of God? Indeed I tremble for my country when I reflect that God is just, that his justice cannot sleep forever. Thomas Jefferson. Jefferson was a conflicted man because he inherited slaves and still fought against it. The price we paid was a Civil War and a broken nation. Were equally conflicted in our battle against abortion since so many of us did so little for so long and allowed abortion to become a multi-billion dollar institution that our federal government funds ($300+ million annually) with tax dollars. Were bathed in the blood of our children. But there is still good news.

If we worry what God thinks about our actions not courts of men then the gates of hell cannot prevail against us. And if we show up with Gods authority not the authority of the courts then there is no higher tribunal in the land. God is against abortion and when we serve God we dont need to fear what might happen if sinners disagree. We know what they did to Christ and the prophets before him, Blessed are ye, when men shall revile you, and persecute you, and shall say all manner of evil against you falsely, for my sake. Rejoice, and be exceeding glad: for great is your reward in heaven: for so persecuted they the prophets which were before you. Matt. 5:11-12 If the court reviles us and persecutes us according to Scripture were being blessed!
