The c o u r t has r e v i e w e d t h e p e t i t i o n e r ' s Request f o r C i v i l S t a l k i n g I n j u n c t i o n . The p e t i t i o n e r has p r o v i d e d t h e c o u r t w i t h p o l i c e r e p o r t s , statements f r o m t h e p e t i t i o n e r , h e r husband, t h e respondent, t h e respondent's c h i l d r e n , and o t h e r s . The u l t i m a t e c o n c l u s i o n reached b y t h e c o u r t i s t h a t t h i s i s a n o t a s i t u a t i o n which can be r e s o l v e d by a s t a l k i n g i n j u n c t i o n . The respondent's c h i l d r e n walk t h e i r pony a l o n g a p u b l i c s t r e e t and do n o t encroach upon t h e p e t i t i o n e r ' s p r o p e r t y . The p e t i t i o n e r accuses t h e respondent's c h i l d r e n o f s t a r i n g a t h e r w h i l e s t a n d i n g away from h e r p r o p e r t y . The respondent, a c c o r d i n g t o t h e p e t i t i o n e r , d r i v e s s l o w l y by h e r house i n h i s p o l i c e c a r on a p u b l i c s t r e e t . T h i s does n o t c o n s t i t u t e s t a l k i n g . He l i v e s i n t h e same s m a l l town n o t t o o f a r from t h e p e t i t i o n e r ' s home. The p e t i t i o n e r ' s own account o f t h e o r i g i n a l i n c i d e n t w i t h t h e respondent's f r i e n d p a i n t s an u g l y p i c t u r e o f t h e p e t i t i o n e r , as w e l l as t h e respondent's f r i e n d . The p e t i t i o n e r does n o t d e s c r i b e any communications made b y t h e respondent o r h i s w i f e w h i c h would j u s t i f y a s t a l k i n g i n j u n c t i o n . None o f t h e a c t i o n s d e s c r i b e d j u s t i f y a s t a l k i n g i n j u n c t i o n . Although the p e t i t i o n e r claims that members o f t h e Santaquin P o l i c e Department a r e o u t t o k i l l h e r , she d e s c r i b e s n o t h i n g which would j u s t i f y t h a t c l a i m . A t one p o i n t , the p e t i t i o n e r ' s husband approached t h e p o l i c e w e a r i n g a gun w i t h the t r i g g e r s t r a p undone. Not s u r p r i s i n g l y , t h e p o l i c e o f f i c e r s were upset and nervous. The p e t i t i o n e r and h e r f a m i l y appear t o be as r e s p o n s i b l e f o r t h e i r own f e a r s as anyone e l s e . Most o f what t h e p e t i t i o n e r ^ d e s c r i b e s appears t o be a n o v e r - r e a c t i o n t o l a w f u l a c t i o n s o f t h e respondent and h i s f a m i l y . The c o u r t denies t h e Request f o r a C i v i l S t a l k i n g Injunction.
