LEGAL SERVICES AGREEMENT
Gina L. Turcotte and Harold J. Hainke, Esq. agree as follows:

1) Gina L. Turcotte requested legal representation at state expense because she was charged
with certain crimes. Currently, her case is pending in the Kennebec County Superior Court in Docket
No. AUGSC-CR-2012286. This is the same case as former Maine District Court Docket No. AUGDG-CR
-2012--301. This Agreement does not pertain to any other case.
2) Gina L. Turcotte was granted her request and an attorney was appointed. After
dissatisfaction with two attorneys, the Court appointed Harold J. Hainke, Esq. as her attorney. After
discussions with Ms. Turcotte, it was determined that she did not want an attorney to act on her
behalf, but wanted an attorney to be available to advise her as to court procedures and render other legal
advice. This arrangement is referred to as "stand--by counsel."
3) Therefore, the parties agree, as long as it is approved by the Kennebec County Superior Court,
that Gina L. Turcotte will act as her own attorney and have all the duties and responsibilities of an
attorney including but not limited to following: presenting her own case, communicating directly with
the Court, the District Attorney and any other persons, including witnesses; she will be responsible for
Opening and Closing statements at trial, examining and cross examining witnesses, making objections to
the District Attorney's presentation of evidence and responding to the District Attorney's objections to
her presentation of evidence; she is responsible for selecting the jury and filing motions. She will
make all the decisions concerning her case, including the legal strategy to pursue.
4) Therefore, Mr. Hainke will not have the traditional responsibilities concerning the allocation
of authority between Attorney and Client and the scope of his representation will be limited to the
duties of stand-by counsel, which include but are not limited to the following: the responsibility
of being present with her during court appearances, meetings with the District Attorney and at her
request any other meetings or interviews. However, Ms. Turcotte most notify Mr. Hainke of any Court
appearances, if he has not received notice from the court. Mr. Hainke shall assist Ms. Turcotte with the
presentation of her case and be available to render legal advice upon her request.
5) Therefore, Mr. Hainke will not communicate with any party in this matter unless Gina L.
Turcotte is present and has expressly given Mr. Hainke authority to offer counsel.
