Dear Counsel:

The Court requests supplemental briefing on the following issue:

What role does the doctrine of "professional speech" play in this case? If A3371
regulates "speech" and not merely "conduct," how much protection does this "speech"
receive under the First Amendment? Are Plaintiffs' free speech rights diminished
when they are speaking as licensed professionals in the course of treating clients?
See, e.g., Planned Parenthood of Southeastern Penn. v. Casey, 505 U.S. 833, 884
(1992) ("To be sure, the physician's First Amendment rights not to speak are
implicated, but only as a part of the practice of medicine subject to reasonable
licensing and regulation by the State.") (internal citations omitted); Lowe v. S.E.C.,
472 U.S. 181, 228-33 (1985) (White, J., concurring in the judgment); Wollschlaeger
v. Florida, 2014 WL 3695296 at *13-20 (11th Cir. July 25, 2014); id. at *29-46
(Wilson, J., dissenting). To be clear, we are not interested in any further briefing on
the question of whether SOCE counseling is "speech" or "conduct" for purposes of
the First Amendment; we are interested only in the question of whether if SOCE
counseling is "speech" is it "professional speech" subject to lesser First Amendment
protection?
