Pros: PO3 Glen Fortunado is presented by the people for the purpose of testifying the incident relative
to the apprehension of Edmund Fernandez last July 20, 2014 in the evening at about 10:00 oclock in
connection with the killing of the late Dennis Beltran, and to identify for some documents for the
purpose of substantiating the information against the accused. May I proceed, your honor.
Court:
Pros: PO3 Glen Fortunado, why are you in Court?
A: I was subpoenaed by the court to testify in connection with the killing of Dennis Beltran.
Pros: PO3 Glen Fortunado, were you already a member of the Philippine National Police last July 20,
2014?
A:
Pros: Will you please tell the court in what particular unit or office were you then assigned?
A: I am assigned in the investigation division of the Station 5 Carbon, Cebu City.
Pros: Will you tell us as far as you can recall, where were you at about 10:00 in the evening of July 20,
2014.
A:
Pros: What were you doing there?
A:
Pros: How did you know that a crime has just been committed? (dili ba ni leading crime has just been
committed? Suggestion: How did you know about the incident?)
A: kdungog ka sa buto then naay commotion
Pros: What did you do then?
A: dagan ka padung didto
Pros: What happened or what did you do upon reaching the crime scene?
A: kita ka sa nagbuy-od nga lawas, naligo sa kaugalingong dugo
Pros: And then what did you do?
A: (pwede inform si glen nga polis sya?
Pors: Then?
A: sulti te malou nimo what happened & who & where the assailant is
Pros: What did you do next?
A: gidakop, handcuffed, cordoned the crime scene
(dili cguro sya ang nag cordoned but ang nag responde kay dib a cordon nay ibutang nga yellow color.
Gidakop and handcuffed and instructed ang mga tawo not to touch anything there. Then while naka
handcuffed na si suspect tawag dayon sya og responde. )
Pros: Then, what happened next?
A: abot responding officers. Kadungog ka nga gi Merandaized?? ang suspect
Pros: What did you do after?
A: Gdala sa sotero for the disposition of the filing of the case.
Pros: Then?
A: Since the assailant was bumped by a vehicle, we brought him to the physician of the clinic of the
Camp.
(prosecution must establish why wala gidala sa hospital when the suspect was seen bumped. Why clinic
and not Hospital? So here, ang ato barugan why wala sa hospital-- kay tungod at the time na bumped
sya while padung glen sa scene ni try sya barog og moikyas unta. Then he was able to stand while gi
handcuffed and can walk and move while nag-wait sila sa responding team. So the bringing to clinic is
mao pinaka immediate buhaton to just make sure he is OK. The naa man pod physician sa clinic nga
naka check sa condition sa suspect nga OK ra)
Pros: You said earlier that you were at the scene of the crime when it took place, how far was your
