Case: Fiege v Boehm

Parties: Plaintiff - Boehm (alleged father)

defendant - Fiege (unmarried woman that became pregnant out of
wedlock)

Procedural History:

Facts: Fiege and Boehm went on a date. Later, plaintiff becomes pregnant,
says the child is the defendant's. Plaintiff alleges that defendant agreed to pay
costs associated with the birth of his bastard child ($2,895.80) in exchange that
plaintiff would not file bastardy proceedings against him. Defendant only paid
$480. Defendant claims he never had sex with plaintiff, and it was proved through
blood tests that he could not have been the child's father. Defendant says he paid
the $480 to keep the situation quiet.

Issue: Was the plaintiff's promise of forbearance from filing bastardy

proceedings against defendant sufficient consideration to uphold the contract?

Holding: Plaintiff's forbearance was sufficient.

Reasoning: Court found that although she was wrong that defendant was the father,
she made the promise of forbearance in good faith, believing he very well might be
the father.
