3 MR. WEIDNER: Im sitting in the same office
4 Ive been sitting in for years doing the same damn thing
5 Ive been doing day after day, month after month and year
6 after year, fighting these banks and institutions that are
7 destroying this country and as I sit here in the morning, I
8 sit here all day long, I simply cannot understand why we
9 dont have more people in this country who are expressing
10 more outrage and frustration in what these banks and
11 institutions are doing. They are destroying this country
12 and while theyre busy doing that, youre just sitting
13 there in your house not doing a damn thing about it.
14 Meanwhile we got this press that isnt doing
15 a damn thing about reporting whats happening in this
16 country. Thats a disturbing phenomenon that the press,
17 the mainstream press in these institutions that are out
18 there reporting this garbage thats absolute propaganda and
19 lies and the American people are just sucking it in and
20 theyre believing it.
21 You know, Ive been doing these files you
22 see sitting behind you for years now, running the same
23 motions, running the same arguments over and over again
24 refining them against these corporations, these banks and
25 their lawyers that are nothing but bullies and funds.

1 We go into these courtrooms, taking up time


2 for our Judges, from our staff, from our clerks, when
3 simply we should not have to.
4 Early in this debate, we heard all this
5 arguing about how these deadbeat borrowers taking out more
6 loans than they should, more loans that were given to
7 people that couldnt afford them and people who borrowed
8 more house than they could ever afford and yet only now are
9 we starting to understand that it really is the banks and
10 institutions who are the wrongdoers in this because theyre
11 the ones that wrote the loans that they knew could not be
12 repaid and why were they doing that, because they had the
13 full faith and credit of the United States Government in
14 the form of the insurance that backed up those loans. That
15 went to the federally insured loans for the direct
16 endorsement lenders.
17 Understand what happened here, people, when
18 they wrote those loans, they wrote them knowing that when
19 they went bad, they would be paid by the Federal
20 Government. Thats you, thats me, thats every single one
21 of us.
22 So I dont want to hear another comment
23 about borrowers and their big loans and loans they couldnt
24 afford.

2 country and theyre doing it with the full support of the
3 Federal Government and the quote, unquote, leaders that
4 are supposed to be looking after the American people.
5 I want to know why it is our press isnt
6 reporting on this and you have to rely on websites, like
7 Zero Hedge and Naked Capitalism and people like Abigale
8 Fields and Matt Stoller and Matt Taibbi, a few lone voices
9 out there in the wilderness who are screaming the truth.
10 Why wont the American people wake up and
11 finally start doing something about this.
12 We have a campaign for President that is
13 nothing but a farce.
14 As you look in the republican delegate
15 counts and all the scams thats going on there, its clear
16 that theyre being manipulated.
17 The republican voters in their own primaries
18 are being manipulated by a machine thats stealing the vote
19 and the political will of the American people.
20 But focusing back here on whats happening

1 You simply cannot allow cases to go


2 undefended.
3 I dont care what you think youre getting
4 into communicating with the banks. If youre still living
5 in the delusion that you can negotiate with the bank and
6 they might give you some modification that will make sense
7 to you, but youre not actively fighting that foreclosure
8 case, youre being part of the problem.
9 Youre not part of the solution here and
10 there are too many Americans, millions of Americans that
11 are playing into this game and into this system thats
12 allowing our country to be destroyed.
13 They are working with the banks and
14 institutions and theyre causing more damage in the long
15 run and the most frustrating thing that I see in our
16 courtrooms is the fact that these banks and institutions
17 continue to engage in the same systemic bad practices that
18 got us into this problem in the first place.
19 Were years into this.
20 The Florida Supreme Court in 2009 recognized
21 the problem. That means back in 2007/2008, they knew we
22 were heading into this crisis. They produced rules in 2010
23 that aim to curb the abuses of the banks and institutions.
24 The Verified Complaint Rule that Ive been screaming about
25 for years now and still to this day, we have banks and

1 institutions and their lawyers not complying with this rule


2 and yet I dont see any enforcement or any real penalty for
3 not complying with the rules as a taxpayer. Forget my role
4 as an advocate for consumers. As a taxpayer, it terrifies
5 me that we have such anarchy and lawlessness in our
6 courtrooms, systemic tyranny and lawlessness that
7 encourages further systemic tyranny and lawlessness because
8 the banks and institutions are able to ignore the rules.
9 The rules that you and I must follow, otherwise we will
10 face severe consequences.
11 Ive talked for years and years and years
12 about the fact that these plaintiffs are not properly
13 identifying themselves.
14 I looked back at some of the earliest
15 motions that I filed way, way, way back in 2007 and 2008,
16 where I was screaming about the fact that I dont know who
17 this plaintiff is thats suing my homeowner.
18 He didnt borrow money from this corporation
19 and why is it that this corporation or this trust that I
20 cant identify is now suing him and wants to throw his
21 family out into the street.
22 How is this possible? If nothing else,
23 please tell me who this trust is or where this corporation
24 is located so I can verify that they exist.

1 can you possibly grant a Foreclosure Judgment to the


2 shadowy and undefined plaintiff that we dont have any idea
3 where theyre located in.
4 The XYZ 2006 Trust. Tell me a little bit
5 about that trust, please? Who owns that trust, who are the
6 beneficiaries in that trust because youre going to be
7 granting a piece of America to this trust. Thats what
8 happens in a foreclosure case.
9 When a final judgment is entered by a
10 Circuit Court Judge, that Circuit Court Judge is giving
11 away a piece of America to whoever that plaintiff is, know
12 if its a corporation we can identify, I guess I can live
13 with that. Even if its one of these shadowy corporations,
14 or a nominal plaintiff that doesnt really own that loan,
15 but that nominal plaintiff is being given the title to that
16 piece of dirt here in America and thats wrong.
17 Judges should not be granting property in
18 America to corporations unless they can clearly and
19 specifically define and understand who that corporation is.
20 They shouldnt -- and they must be able to understand who
21 owns that loan, who it is that actually is going to be
22 taking title to that property, to that piece of America and
23 yet all across this country, in this shadowy hidden world
24 of wizards behind the curtain controlling the foreclosure
25 process and taking an interest in these loans.

1 We dont know who it is thats taking title


2 to America.
3 We know now as a result of years of
4 litigation after this has been hidden from us by these
5 plaintiffs, we know that the plaintiffs dont really own
6 these loans. They are the bagmen, they are the collection
7 agents, they are the thugs that are working for undisclosed
8 principles that are hidden from America, that are hidden
9 from the Judges that are signing these judgments.
10 Its time for Americans to wake up. Its
11 time for our Judges to start asking questions and demand
12 that we know who it is thats taking title to America.
13 Now, in most cases we understand now that
14 whos really taking title to these properties are the
15 Federal Government through their agents, co-conspirators,
16 Fannie and Freddie, but the fact of the matter is, that if
17 Americans understood that what was happening in the vast
18 majority of foreclosure cases, was that effectively the
19 Federal Government was foreclosing upon a citizen that
20 would change the dynamic, but understand thats what
21 happening here.
22 The Federal Government is foreclosing
23 against Americans.
24 Every lawsuit thats filed, when Fannie and
25 Freddie are the real party in interest here, is effectively

1 being paid for by the American taxpayer.


2 So that homeowner thats being sued is being
3 sued by the Federal Government whos been collecting money
4 all along the way in servicing when they made the loan.
5 When theyre servicing the loan, when theyre modifying the
6 loan and then now finally when the foreclosure gets
7 concluded.
8 Again, Im getting frustrated and tired
9 about the fact that Americans are just lying there asleep
10 and letting this happen to all of us.
11 Its time for Americans to wake up.
12 I dont want to see another foreclosure case
13 go undefended.
14 There are enough good attorneys out there
15 that are working with Americans. That every single
16 American should be grabbing an attorney and defending and
17 fighting that foreclosure case.
18 When you get served with a foreclosure case,
19 you treat that as a personal invitation for you to get
20 involved in your court system. You use this as a
21 personalized, hand-delivered invitation to go inside a
22 courtroom, meet with Judges, meet with the clerks, meet
23 with the sheriffs that are there to protect their legal
24 system and get involved in your legal system.

1 that is in this State of Florida, our judicial systems


2 grossly underfunded and thats the fault of you and me and
3 every single voter that have allowed the Executive Branch
4 and the Legislative Branch to attack our judicial system.
5 Just yesterday we heard in Saint Pete Times
6 that there have been new rules imposed on our elected
7 Circuit Court Judges that are intended to prevent them from
8 going in front of you, the voters that support your
9 communities and speak out against this.
10 That means its up to you and me as
11 attorneys in particular, to speak out and defend our
12 judicial system.
13 We have abandoned our judicial system.
14 Weve abandoned our Court system by not
15 being involved and the banks and institutions have stepped
16 into that void and stepped into that place and they, in
17 fact, have taken over our judicial system, but its time
18 for us to get back in there and get more involved.
19 I want every single one of you to get more
20 involved in whats happening in your courtrooms out of a
21 sense of protection and common duty and honor to this
22 country.

Dear Mr. Inspector General:
I am writing to request that you initiate an investigation into widespread allegations of
abuse by private attorneys and law firms hired to process foreclosures as part of the "Retained
Attorney Network" established by Fannie Mae. I also request that you examine allegations of
abusive behavior on the part of default management firms engaged by both mortgage servicers
managing Fannie Mae-backed loans and attorneys and firms that are part of the Retained
Attorney Network. Finally, I request that you examine efforts by Fannie Mae and the Federal
Housing Finance Agency (FHFA) to investigate these allegations and implement corrective
action.
Allegations of Abuse in the Retained Attorney Network
In August 2008, Fannie Mae created "a new mandatory network of retained attorneys to
handle all foreclosure and bankruptcy matters" relating to Fannie Mae mortgage loans, whether
held in portfolio or mortgage-backed securities. Fannie Mae required that only these retained
attorneys represent Fannie Mae mortgage servicers, and it established the maximum allowable
reimbursable fees for foreclosure-related work. In December 2010, Fannie Mae Executive Vice
President Terence Edwards announced that the Retained Attorney Network would be expanded
from 31 to 50 states.

Recent reports indicate that many of the private attorneys, law firms, and other entities
participating in the Retained Attorney Network have been accused of practices that are fraught
with flaws, errors, conflicts of interest, and fraud, and these allegations have prompted numerous
state and federal investigations.
For example, on August 10, 2010, the Florida State Attorney General announced an
investigation into unfair and deceptive practices by the Law Offices of David J. Stern, P. A., the
Law Offices of Marshall C. Watson, P.A., and Shapiro & Fishman, L.L.P. The allegations
against the firms include creating and filing with Florida courts improper documentation to speed
foreclosures and establishing affiliated companies outside the United States to prepare false
documents. In announcing this investigation, the Attorney General stated:

On numerous occasions, allegedly fabricated documents have been presented to


the courts in foreclosure actions to obtain final judgments against homeowners.
Thousands of final judgments of foreclosure against Florida homeowners may
have been the result of allegedly improper actions of the law firms under
investigation.

Former employees of the Stern law firm also reportedly alleged that the firm engaged in
"robo-signing," a practice in which employees signed hundreds of foreclosure affidavits each
day, falsely swearing to have personal knowledge of the underlying documents. One employee
testified that the firm's chief operating officer "signed as many as 1,000 foreclosure affidavits a
day without reading a single word." The employees also reported that the firm backdated and
altered documents, and that it took steps to cover its misconduct by changing the dates on
hundreds of documents.

Last November, Fannie Mae issued a public notice stating that it had "terminated its
relationship with the Law Offices of David J. Stern" and informing servicers that they "may not
refer any future Fannie Mae matters to the Stern firm."

Separately, the U.S. Trustee Program (USTP) of the Department of Justice is


investigating another firm in the Retained Attorney Network, the firm of Steven J. Baum, P.C. of
Amherst, New York, for filing foreclosure documents that appear to be false or misleading;

attempting to foreclose on borrowers after rejecting their attempts to make on-time payments;
and failing to prove ownership of mortgages as it seized homes. The firm has also been accused
of illegally charging for foreclosure-settlement conferences, overcharging on foreclosure fees,
and racketeering.

Another firm in the Retained Attorney Network, McCalla Raymer, L.L.C., is a defendant
in a federal lawsuit in which the plaintiffs allege that it engaged in fraud, racketeering, and the
manufacture of fraudulent foreclosure documents. Reportedly, this firm established operations
in Florida under the name Stone, McGehee & Silver and hired ten former Stern law firm
employees. The firm Stone, McGehee and Silver, LLC, dba McCalla Raymer currently appears
as a "Designated Counsel/Trustee" in Florida for Freddie Mac.

Lender Processing Services, Inc. (LPS), a $2.8 billion company headquartered in


Jacksonville, Floridaand the largest provider of default loan services in the nationis also
under investigation by the Florida Attorney General for producing apparently forged or
fabricated documents in foreclosure actions. LPS is also a defendant in a federal suit alleging
an illegal fee-sharing scheme. Filed in federal bankruptcy court in Mississippi, the suit alleges
that LPS and another company, Prommis Solutions Holding Company, illegally required
attorneys in their networks to turn over a portion of their fees for foreclosure services, and that
another large law firm, Johnson & Freedman, L.L.C., joined in this scheme. The Chapter 13
Trustee for the Northern District of Mississippi, a unit of the Department of Justice, has joined as
a plaintiff.

A special investigation by Reuters last December reported that LPS and its affiliated
companies also allegedly deployed low-skilled, non-lawyers to prepare foreclosure documents,
created invalid mortgage assignments to facilitate foreclosures, and rewarded attorneys for speed
rather than accuracy in filing court pleadings. Reuters reported:

The law firms are on a stopwatch. [An LPS spokesman] confirmed that the LPS Desktop
system automatically times how long each firm takes to complete a task. It assigns firms
that turn out work the fastest a "green" rating; slower ones "yellow" and "red" for those
that take the longest. Court records show that green ratings go to firms that jump on
offered assignments from their LPS computer screens and almost instantly turn out readyto-file court pleadings, often using teams of low-skilled clerical workers with little
oversight from the lawyers.

Although Fannie Mae terminated its relationship with the Stern law firm last November,
it does not appear to have terminated its relationships with any of the other firms described
above.

Request for Investigation


These are serious allegations that may have affected thousands of homeowners. For these
reasons, I request that your office initiate a comprehensive investigation into allegations of abuse
by attorneys and law firms participating in the Retained Attorney Network, as well as servicers
and default loan service providers alleged to have participated in these abuses.
It is my understanding that the mission of your office is to "promote the economy,
efficiency, and effectiveness of the FHFA's programs; to assist FHFA in the performance of its
mission; to prevent and detect fraud, waste, and abuse in FHFA's programs; and to seek
sanctions and prosecutions against those who are responsible for such fraud, waste, and abuse."
In 2008, FHFA replaced the Office of Federal Housing Enterprise Oversight and became the
regulator and conservator for Fannie Mae. As such, the agency's duties include overseeing the
"prudential operations" of Fannie Mae and its contractors and ensuring that their activities and
operations "are consistent with the public interest."

With this background, I request that you address the following issues with respect to
attorneys and law firms participating in the Retained Attorney Network program and with
respect to other entities engaged by both mortgage servicers managing Fannie Mae-backed loans
and attorneys and firms that are part of the Retained Attorney Network:

To what extent have homeowners lost their homes to improper, illegal, or otherwise
invalid foreclosures as a result of the types of abuses described above?

requirements, or other regulations, rules, guidelines, or laws?

To what extent have the alleged abuses described above undermined loss and foreclosure
mitigation efforts and outcomes? What responsibilities do loan servicers have in
monitoring and overseeing the activities of attorneys and other third party companies?
What are the levels of cure rate and loss mitigation activities among retained attorneys?

Attached is a foreclosure lawsuit that was served on me Saturday January 13, 2013. Can you
represent me? Otherwise my plan is to respond pro se, and argue as alleged in my HUD complaint
from August 2012, and perhaps make a counterclaim under federal law and remove to federal court.
I was also served in my capacity as co-trustee, with my brother Mark Gillespie. Below is a link to
the court docket page, showing a commercial foreclosure, but I could not find either the trust or my
brother listed as defendants.
