PROPOSED RESOLUTION NO. 2015-287 indorsing and/or interposing no

objection to the establishment of the Cagayan de Oro International Hospital,
Geriatric Hotel and Shopping Centre in a 6-hectare private lot in Barangay Lumbia
where an 8-storey state-of-the-art international hospital shall be funded through
grant by philanthropists from Turkey in the amount of 350,000,000.00 (Euros).

AN ORDINANCE REPEALING ORDINANCE NO. 12440-2012, AN ORDINANCE REGULATING THE

ESTABLISHMENTS TO COLLECT A PASS-THROUGH CHARGE FROM CUSTOMERS REQUESTING
SINGLE-USE PLASTIC CARRYOUT BAGS, AND FOR OTHER PURPOSES
Whereas, Ordinance No. 12440-2012 was enacted by the City Council to address the problem on solid
wastes especially on the clogging of drainage canals caused by plastic carryout bags, among others, and to
provide livelihood program to the victims of Typhoon Sendong;
Whereas, years after its implementation, numerous owners of commercial establishments in the City
have complained on the improper implementation of the said Ordinance;
Whereas, even after request by the City Council for accounting of the Trust Fund covering the proceeds
of the pass-through charge from customers requesting single-use plastic carryout bags, the Office of the City
Treasurer has not submitted its financial statement thereof to determine how the fund was spent;
Whereas, the City Council is already contemplating of enacting an Ordinance banning the use of singleuse plastic carryout bags as substitute thereof;
Now, therefore:
SECTION 1. - Ordinance No. 12440-2012, entitled: An ordinance regulating the distribution of singleuse plastic carryout bags and requiring retail establishments to collect a pass-through charge from customers
requesting single-use plastic carryout bags, and for other purposes is hereby repealed.
