A STAND-UP EXAMPLE FROM HURRICANE K ATRINA EMERGES

ing Hurricane Katrina. We
watched the Chief of Police of
New Orleans declare on na-
tional television that “no one

watched an old lady being
tackled in her own kitchen
and disarmed.
In fact, that atrocious event
was one of the reasons I
started Oath Keepers. But I
also knew, from my service
as an Army paratrooper, that
there are men and women of
courage, honor, and integri-
ty in the military who would
refuse to obey such orders.
My goal with Oath Keepers
is simply to increase their
numbers and harden their
resolve. But when it came to
Katrina, we did not have con-
crete proof that some said no
– until now.
On Friday May 14, 2010, I
had the pleasure of meeting
and interviewing Staff Ser-
geant (SSG) Joshua L. May
of the Utah National Guard
who told me how he, along
with the other men in his
military intelligence unit,
refused to participate in any
gun confiscation while de-
ployed to assist during Hur-
ricane Katrina in 2005.
I discovered SSG May and
his story only because af-
ter a speech I gave in Logan
Utah on May 13, 2010, a lo-
cal resident, Farley Ander-
son, walked up and told me
about what SSG May had
done. Upon hearing of it, I
knew I had to talk to him,
so I had Mr. Anderson track
down SSG May’s number
and I called him at 11pm
and invited him to break-
fast the next morning. Until
that night, SSG May hadn’t
even heard of Oath Keepers
(which is ironic since he is a
shining example of an oath
keeper). We met for the first
time that next morning, Fri-
day, May 14, 2010. During
breakfast, SSG May told me
his story, and then I asked
him if we could go outside
and do a video interview in
the restaurant parking lot.
He agreed that his story
needed to be told.
Tipping the Scales on
the Side of the Consti-
tution and the Rights of
the People
As I have said from the day
I founded Oath Keepers, we
know that some will “just
follow orders.”
That is clear from the sad
history of the human race,
and that is also clear from
our own history. The intern-
ment of Japanese Ameri-
cans during World War II
shows that reality. And in
the modern context, the

already noted, what hap-
pened during Katrina shows
that some will actually fol-
low even such a clearly un-
lawful, unconstitutional or-
der. And that is why I started
this organization – to do my
utmost to keep it from hap-
pening again.
However, I also know be-
yond a doubt that there are
men and women of honor,
deep courage, and true de-
votion to the Constitution
in service who would refuse
to obey such orders. I know
this because I served with
some of them. The men I
served with in the Airborne
infantry would have been as
willing to forfeit their lives
or liberty by refusing such
orders as they were willing
to give their lives in combat.
And I know that there are
still, to this day, many people
of such honor, courage, and
devotion in the military. The
number of Bronze and Silver
stars, and even Congressio-
nal Medals of Honor, being
awarded today are a testa-
ment to the fact that this
nation still has many young
lions (and lionesses) of great
courage in service.
Enough of them have the
courage to do what is right
if they know what is right.
The only question I have
is whether enough of them
have the necessary knowl-
edge of the Constitution and
of their obligations under
the oath to stop another ‘Ka-
trina debacle’ or worse from
happening. Courage without
knowledge is insufficient. A
brave man or woman with-
out knowledge and under-
standing of the Constitution
can be tricked into becoming
a tool of oppression over fel-

is why I don’t waste my time
with most lawyers and poli-

demonstrated their lack of

and knowledge. When a per-

person can and will make a

the cynical conventional
wisdom would have you be-
lieve is possible, just as SSG
May did. He proves the cyn-
ics, who contend that all in
the military will always just
follow orders, wrong.
I have long said that it is
simply a reflection of human
nature that in an average
military unit, at any time in
history, there will likely be
some who will just follow or-
ders (sometimes with blood-
thirsty gusto), and there will
be some who will not follow
unlawful orders under any
circumstances (provided
they understand the orders
are unlawful), and then
there will be those in the
middle who’ll just go which-
ever way the wind blows.
Again, the results of LCDR
Cunningham’s survey reflect
this. 26.2% said they would
fire on fellow Americans.
But 12.0 percent said they
“had no opinion” about that

news is that 42.3 percent an-
swered that they “strongly
disagreed” and 19.3 percent
“disagreed.” So, there was a
strong split in opinions, with
those disagreeing in the ma-
jority.
The whole point of Oath
Keepers, its prime mission,
is to increase the number
of service members who are
awake, knowledgeable about
the Constitution, and com-
mitted to saying “hell no!”
and thus tip the scales on the
side of those who have both
the courage and knowledge
to not go along. Those who
blow with the wind will then
side with right, and any pos-
sible psychopaths and blind
followers will be significant-
ly outnumbered and will be
suppressed.
And it bears repeating that
a man in the ranks like SSG
May, a man who has been
awakened to the awesome
responsibility of his oath and
who has become a student
of the Constitution, can tip
the scales on the side of jus-
tice and the Constitution in
ways that mere numbers can
never quantify. Such a man
is a moral and morale force
multiplier. SSG May’s story
bears this out.
He became a teacher and an
inspiration to others, and he
was the solid rock of resolve
that they gathered around
and drew strength from
when taking their stand. Yes,
the majority were in agree-
ment with him (and I’ll bet
he certainly helped them see
the light) but I think it was
his unshakable resolve that
helped the others actually
take a firm stand. Perhaps
if he had not been there, an-
other would have sounded off
loudly that the gun confisca-
tion was flat wrong and that
he would not do it. Perhaps
another would have stepped
up to be the spokesman for
the others to go tell the com-
mander they would refuse if
given that order. But perhaps
not. Regardless, one man
can make a difference and
there can be no doubt that
SSG May’s presence helped
tip the scales on the side of
refusing to obey any orders
to confiscate guns. And he
made it into a preemptive
refusal. He did not wait un-
til the orders were actually
given. With him leading the
way, the men made it clear in
advance that they would not
comply.
SSG May, way back in 2005,
was a stellar oath keeper
long before Oath Keepers the
organization even existed.
The oath – and the obliga-
tion that goes with it -- is as
old as the Constitution itself.
We here at Oath Keepers cer-
tainly did not invent it. The
Founders invented it. And
they put that requirement
right in the Constitution, in
Article VI. We at Oath Keep-
ers merely do our small part
in honoring the oath by doing
our best, to the utmost extent
of our powers (as the motto
of my Airborne unit put it)
to make sure there are more
SSG Mays out there. Just as
SSG May was awakened by
another National Guards-
man who made him realize
he did not have a sufficient
understanding of the Consti-
tution to adequately keep his
oath, we strive to wake up as
many current serving as we
can to the fundamental ne-
cessity of understanding and
studying the Constitution if
they are to keep their oath
to defend it. You can’t de-
fend it if you don’t know it. I

firmly believe that it is pos-
sible to reach, teach, and in-
spire enough of the current
serving to provide a tipping
point on the side of the Con-
stitution and on the side of
the rights of the people when
future unconstitutional or-
ders come down the chain of
command. We can do it.
And now we have SSG
May’s stellar real-world ex-
ample from Katrina itself to
show the way for others. In
honor of SSG May’s stand, I
am nominating him for the
Oath Keepers 2010 Current
Serving Military of the Year
award, and I am nominat-
ing his unit for a counter-
part award for Unit of the
Year for their stand during
Katrina. I can’t imagine a
better example coming to
light between now and our
national Oath Keepers Con-
ference in October, so I look
forward to presenting both
those awards.
We hear so much bad news
nearly every day that it is
wonderful to have such a
great piece of good news. So,
take heart, and remember,
with each and every current
serving military, police, or
emergency personnel you
talk to, with each brochure,
pocket Constitution, or

WHAT THE CLINTON, BUSH AND OBAMA PRESIDENCIES HAVE IN COMMON

When then Senator Obama
first began to campaign, one
of his campaign promises was
music to my ears. Senator
Obama promised that he would
never support the amendment
to the Foreign Surveillance In-
telligence Act (“FSIA”). The
amendment proposed giving
telecommunications companies
retroactive immunity for assist-
ing the National Security Agency
(“NSA”) in engaging in warrant-
less wiretapping and internet
data collection on unsuspecting
Americans. Senator Obama was
charming, articulate and pas-
sionate. He made all the cam-
paign promises that a long-time
liberal Democrat could like.
He promised to bring home the
troops, to close the Guantanamo
detention center, and to lower
taxes. He promised to review the
executive orders signed by prior
presidents and to stop what he
called an unlawful practice of
legislating via executive order.
In short, he promised “change.”
Instead, what we have witnessed
in the first year of his adminis-
tration is more of the same, in-
cluding a clever game of hide and
seek that began with the Clinton
Administration.
The Clinton, Bush and Obama
administrations all expertly used
the courts and legislative process
to hide information about sig-
nificant current and historical
events and government wrongdo-
ing from the public. The pattern
repeats itself. A whistleblower
files suit to expose alarming fed-
eral government wrongdoing.
Major media hardly reports on
the lawsuit or the wrongdoing.
The Department of Justice at-
torneys defend in court, arguing
that the lawsuit would danger-
ously expose “state secrets” or
“classified information.” If the
United States prevails in Court,
case over. If not, legislation is
introduced at the Congressional
level to squash the suit. This pat-
tern was the genesis of the FSIA
amendments. A whistleblower
named Mark Klein is to blame.
Mark Klein worked as an engi-
neer at AT&T for more than 20
years. After he retired, he assist-
ed in the prosecution of a whis-
tleblower lawsuit, alleging that
AT&T facilitated the NSA’s mas-
sive warrantless spying program
on AT&T customers. He provided
testimony that AT&T construct-
ed a secret room through which
all its customers’ voice, data and
internet transmissions and infor-
mation were directed. Only NSA
agents or persons with security
clearance were allowed to enter
the room to monitor transmis-
sions. Klein presented evidence
that every telecommunications
company engaged in this prac-
tice. The district court found that
the companies were immune, be-
cause they engaged in this prac-
tice at the request of the federal

Court of Appeals, decidedly the
most liberal federal appellate
court in the nation, disagreed.
Its decision would have made
AT&T, Verizon and others civilly
liable for spying, an invasion of
Americans’ privacy rights.
The Ninth Circuit held that
telecommunications companies
could be sued for facilitating the
government’s massive warrant-
less spying program, for violat-
ing the privacy rights of custom-
ers. That decision spurred the
Congressional introduction of
the FSIA amendment – legisla-
tively provided immunities for
big telecom’s assistance in spy-
ing. Senator Obama showed his
early and strong opposition to
the concept of providing big tele-
com immunity for help in spying.
On February 12, 2008, he voted
to strike this key provision from
the FSIA amendment. Then, re-
markably, on July 9, 2009 [sic:

pass the entire FSIA, including
the big telecom immunity provi-
sion. President Bush then signed
the amendments into law. Sena-
tor Obama’s public justification:
“to help protect the nation.”
Presumably, someone from the
Bush administration gave candi-
date Obama a dog and pony show,
likely to demonstrate how war-
rantless surveillance on Ameri-
cans foiled terrible terrorist plots
that would have otherwise gone
unnoticed. Was this the subject
of the March 13, 2008 secret
meeting of Congress, only the
6th closed session in the history
of our country? Or, was Senator
Obama taken aside and shown
that the path to the Presidency
included making unfavorable de-
cisions, even if they mean violat-
ing Americans’ basic civil rights
of privacy? Of course, if the Bush
administration would have prof-
fered the demonstration as “clas-
sified information,” then Obama
could not publicly explain his
sudden flip-flop on the FSIA
amendment.
This pattern, of using the

guise of classified information
to hide significant government
wrongdoing, began with Presi-
dent Clinton’s Executive Order
No. 13039. By Executive Order
13039, President Clinton took
away any whistleblower protec-
tion for a little known division of
the navy called the Navy Special
Warfare Development Group. In
other words, if anyone from this
division revealed what it knew
about government wrongdoing,
that person would not be entitled
to the government protections
afforded to federal whistle blow-
ers. The Naval Special Warfare
Development Group was part of
the recovery operations concern-
ing TWA Flight 800.
The “official story” on the de-
mise of this plane and the 230
passengers aboard, was that the
center fuel tank exploded, caus-
ing the plane to explode and dive
in pieces into the Atlantic Ocean
after departing New York’s JFK
airport. Because scores of wit-
nesses interviewed by the FBI
provided eyewitness accounts
that were consistent with a mis-
sile striking the plane before it
crashed and the forensic evi-
dence concerning missile residue
on the debris, many questioned
this story. Indeed, in 2000, sev-
eral eyewitnesses took out a full
page advertisement in the Wash-
ington Times entitled, “We Saw
TWA Flight 800 Shot Down by
Missiles And We Won’t Be Si-
lenced Any Longer.” In the ad-
vertisement, several witnesses
identified themselves by name.
On November 6, 2003, a retired
United Airlines pilot and the fa-
ther of one of the passengers on
TWA Flight 800, filed a lawsuit
against the National Transporta-
tion Safety Board (NTSB”), Lahr
v. NTSB, requesting that the gov-
ernment be forced to turn over
documentation related to its “of-
ficial story” that the plane had ex-
ploded due to its center fuel tank
and not a missile. Lahr alleged
that the government had not com-
plied sufficiently with the Free-
dom of Information Act (“FOIA”)
requests that he had made about
the accident. The United States
Attorney for the Central District
of California, where the case was
venued, defended the lawsuit and
has argued over the last five years
that the NTSB performed an ade-
quate search for the government
records requested and that it did
not have to produce some 32 cat-
egories of documents.
The information sought includ-
ed the names of the FBI agents
that conducted the 773 inter-
views of eyewitnesses, hundreds
of whom revealed that they saw
a missile head towards and col-
lide with the plane before it ex-
ploded.
The government refused to pro-
vide the names of the FBI agents
or the eyewitnesses, citing the
privacy interests of the agents
and the witnesses (despite the
fact that some of them took out
a full page ad in the Washington
Times). The trial court first or-
dered the NTSB to produce the
information, but the federal ap-
pellate court, the Ninth Circuit
Court of Appeals for the Ninth
Circuit, disagreed. It held that
the NTSB could lawfully with-
hold the names of the agents and
the eyewitnesses based on the
privacy interests of both. Why
was the government working so
hard to protect the witnesses
who say that what they saw was
consistent with a missile? Why
was the government refusing to
allow independent interviews of
the FBI agents and the eyewit-
nesses? What is there to hide?
Interestingly, the FBI also re-
fused to answer why three navy
vessels were in the area the eve-
ning of the crash, explaining
only that they were on “classified
maneuvers.” One of the victim’s
sisters says that she attended a
meeting, shortly after the crash
also attended by James Kall-
strom, the head FBI investigator
for Flight 800. When a reporter
stated, “Well, you can’t tell me
it was anything other than a
missile,” Kallstrom responded,

“You’re right, but if you quote
me, I will deny it.” Shortly there-
after, James Kallstrom reported-
ly met at the White House with
Deputy Attorney General Jamie
Gorelick. Immediately after that
meeting, Kallstrom began to
state firmly and publicly that a
bomb or missile had been ruled
out as the cause of the accident.
What influence did Ms. Gorelick
have to the FBI’s public state-
ments about the cause of TWA
Flight 800’s crash? Interestingly,
Ms. Gorelick also served on the
much criticized 9/11 commis-
sion. Coincidence? I think not.
Several respected journalists
fought hard to investigate the
true cause of TWA Flight 800.
Journalist James Sanders and
his TWA employee wife, Eliza-
beth Sanders, were prosecuted
in federal court for conspiracy
after an NTSB investigator pro-
vided them with a swatch of fab-
ric from the TWA plane debris.
Mr. Sanders sent the swatch to
a laboratory, which found that
the swatch contained the type of
residue consistent with a mili-
tary grade missile. Instead of ap-
plauding his excellent detective
skills, Clinton’s Department of
Justice caused the Sanders to be
arrested and prosecuted for ob-
struction of justice or conspiracy.
Perhaps they should have been
applauded for refusing to permit
the United States to “obstruct
justice.” The judge who refused
to dismiss the case against them
and eventually sentenced the
Sanders? Newly appointed Su-

mayor. Coincidence? I think not.
The obstruction of the investiga-
tion of Flight 800 is one of Presi-
dent Clinton’s darkest legacies.
The legacy of government ob-
fuscation of truth continued
well into the Bush administra-
tion with 9/11. Several victims
filed lawsuit designed to uncover
what really happened on 9/11. El-
len Mariani, whose husband was
on United Airlines Flight 175,
filed a civil RICO (Racketeer In-
fluenced and Corrupt Organiza-
tions Act) action lawsuit against
President Bush and other high
level members of his adminis-
tration based on the ongoing ob-
struction of justice by covering
up the truth about September 11.
She was plagued by problems in
her selection and control her of
her counsel, eventually hit with
a gag order that precluded her
from even talking about 9/11,
In another case, eleven fami-
lies brought suit against certain
Saudi officials for facilitating
the U.S. government’s funding
of Al Qaeda, but the Department
of Justice, appearing only as an
amicus curiae (an unsolicited
“friend of the Court”), convinced
the Court of Appeals for the
Second Circuit that the officials
were immune from suit for ter-
rorist activities under the FSIA.
The Supreme Court denied re-
view of that decision.
Bush effectively passed
the baton of obfuscation and
the strategies to achieve it to
Obama. Those of us who ini-
tially believed that the Obama

presidency would provide some
“change” have sourly real-
ized that change is not coming.
With respect to 9/11, President
Obama’s administration contin-
ues to use the legal system to
suppress lawsuits designed to
elicit facts about 9/11. The “offi-
cial story” cannot be challenged.
Note the resignation of Obama’s
Green Czar, Van Jones, simply for
exercising his First Amendment
rights and signing a petition in
support of a truly independent
9/11 commission. Since when
should a government employee
lose his job and have his career
besmirched for exercising his
rights under the First Amend-
ment of the Bill of Rights? After
the work of these three adminis-
trations, the greatest document
ever written, the Bill of Rights,
lies in tattered shreds on the
ground torn apart by three dif-
ferent presidents.
President Obama has even
taken the game of hide and seek
a critical step further. He has
promised to support protections
for federal whistle blowers, gov-
ernment employees who seek to
disclose incidents of government
wrongdoing or cover-ups. Yet, the
bills making their ways through
the Senate and the House, with
White House involvement, fall
short of fully accomplishing that
task. For instance, the Senate
version would actually decrease
protections for FBI whistle blow-
ers. The Senate bill contains no
federal court access for whistle
blowing employees. Instead of
providing court access, the Sen-

ate bill creates an “Intelligence
Community Whistleblower Pro-
tection Board” that consists of in-
telligence agency officials. There
are no due process protections,
and the Board does not have the
authority to hold hearings or in-
terview the whistleblower.
However, the Board is given
the authority to determine a
whistleblower’s credibility solely
on the basis of the record creat-
ed by the agency that retaliated
against the employee. Talk about
the fox guarding the henhouse.
President Obama’s methods of
working to conceal the truth are
more subtle to the mainstream
public than was Bush. Bush was
flagrant in his deception. Obama
wraps his deception in his charm,
poise and his wide-sweeping
statements like this one found on
his campaign web site:
“Often the best source of infor-
mation about waste, fraud, and
abuse in government is an exist-
ing government employee com-
mitted to public integrity and
willing to speak out. Such acts
of courage and patriotism, which
can sometimes save lives and of-
ten save taxpayer dollars, should
be encouraged rather than sti-
fled. We need to empower fed-
eral employees as watchdogs of
wrongdoing and partners in per-
formance. Barack Obama will
strengthen whistleblower laws to
protect federal workers who ex-
pose waste, fraud, and abuse of
authority in government. Obama
will ensure that federal agencies
expedite the process for review-
ing whistleblower claims and
whistle blowers have full access
to courts and due process.”
But now, as he sits as our
President, his support for these
protections swaggers and sways
in the wind between the Senate
and the House Bills. In testimo-
ny offered by the Department of
Justice in response to the House
version of the bill that provides
court access, the White House
now says: “We believe that this
structure would unconstitution-
ally restrict the ability of the
President to protect from dis-
closure information that would
harm national security.” Because
the public does not get caught up
in the details, important as they
are, in the texts of the bills, his
eventual signing of any one of
these watered down bills, will be
hailed by Obama supporters as
success. President Obama may
feel constrained by issues of na-
tional security, but he would be
wise to take the advice of Benja-
min Franklin:
“They who can give up essential
liberty to obtain a little tempo-
rary safety, deserve neither lib-
erty nor safety.”

FEATURED STATE CHAPTER
There’s something to be said for
being in the right place at the right
time. That’s what Celia Hyde,
Massachusetts resident, and Oath
Keepers state president, learned
over the last year.
Celia had been a member of her
local police force for over 30 years.
“I was six when they asked me to
join,” she quips. For 6 ½ years she
was the Chief of Police in the small
town of Bolton, Massachusetts. In
addition to her work on the po-
lice force, she has owned a bed
and breakfast for 24 years. Celia’s
uncle, Dave Freeman (who hap-
pens to be an Oath Keepers board
member and OK’s Law Enforce-
ment Liaison), called her in the
spring of 2009 and asked if some
friends of his could stay in her
B&B. They were going to do a cer-
emony on April 19, the anniversary
of the Battle of Lexington and Con-
cord, on Lexington Square. Celia
booked the rooms, but was curious
as to what this group was doing.
Dave gave Celia the website in-
formation, and she checked it
out. “It seemed a little radical to
me,” she confesses; at the time,
she wondered what her uncle had
gotten himself into. So she called
a friend of hers who had moved to
Florida. This friend happened to
be Chauncey Normandin. When
Celia asked Chauncey if he had
heard of this new group called
Oath Keepers, he couldn’t believe
what he was hearing—he had been
checking them out himself. “Book
me a room, too; I want to come up

what this is all about,” Chauncey
asked Celia.
Celia ended up receiving calls
from all over the country, and had
over 20 people from Oath Keep-
ers staying at her B&B. She had a

chance to ask questions DQG ¿QG
out about the group, eventually de-
ciding that her uncle wasn’t so cra-
zy after all; Celia not only joined,
but took the post as state director
for Massachusetts. She is now
state president. And Chauncey
Normandin had his questions an-
swered as well—he is now the Flor-
ida State President.
So why did Celia take the state
president’s position? “The Con-
stitution is being ignored!” she
exclaims. As a Law Enforcement

aware of the restrictions placed
upon government by the Consti-
tution. But she was seeing that
other governmental authorities
weren’t so diligent in their adher-
ence to that revered document. “I
had to pay attention to what was
going on outside my little town,
and I decided that rather than sit-
ting and complaining, I was going
to get up and do something about
it,” Celia explains.
In Massachusetts, Celia and her
moderators are still laying the mas-
ter plan for their state’s activities.
They have divided the state into 10
zones; half of the leadership posts

programs. “Our leaders have great
ideas; the plans we are making are
all coming from them,” reports Ce-
lia. And with 351 towns in the Bay

We want them to know that we’re

forcement and the military,” Ce-
lia explains. Massachusetts OK is
also working to help the families
of wounded veterans and LEOs;
according to Celia, “When these
families have needs, we want them
to know that Oath Keepers stand
with them.”
Another great outreach idea that
Massachusetts is starting is to rec-
ognize the good things done by
law enforcement and the military
in our communities. States Celia,
“We need to draw attention to pos-
itive actions, instead of just com-
plaining about the negative things
that happen.” OK groups through
the state also plan to have family-
oriented outings for military and
law enforcement, to show their
support for those who serve.
Massachusetts Oath Keepers are
working with several likeminded
groups to see that the Constitu-
tion is returned to preeminence.
Several OK members worked to
support the Massachusetts Liberty
Preservation Association, a watch-
dog group that reports on the ac-
tivities of the Massachusetts State
Legislature. A few months ago,
they saw unconstitutional provi-
sions removed from Senate Bill
2028, the Massachusetts Pandem-
ic statute. Massachusetts OK will
also work with the 9/12 groups and
Tea Parties throughout the state.
A contingent from the state will be
heading to Washington, D.C., for
the 9/12 march this September.
In addition to her work within the
state, Celia is working throughout
New England to help OK groups
get started. She is currently over-
seeing New Hampshire, Maine,
Connecticut, and Rhode Island.
The latter state has been coming
along quite well. “Randy Swanson
contacted me to say that an Oath
Keepers ceremony had been re-
quested in his state,” recalls Celia.
She encouraged him that he could
do it himself, and helped him de-
velop a speech. “Now he’s taking
the bull by the horns, and going
full force in Rhode Island,” she re-
ports.
“I believe that Oath Keepers is an
answer to a lot of people’s prayers.
We’ve created a group that people
can approach. So many have come
to me and said, ‘I thought I was
the only one who felt this way,’”
Celia concludes. “Oath Keepers is
a great way to introduce likemind-
ed individuals and let them know
they’re not alone.” And despite all
the hassles of being on the fore-
front of a new and sometimes con-
troversial group, she says, “This is
a small price to pay for freedom.”

THE CAPTURE

The morning air over Lake
Champlain was cool and heavy
with mist. The still, glassy
surface of the water mirrored
the gentle pink of the early
dawn sky.
Fort Ticonderoga’s jutting
walls sat above the water, on
a point of land overlooking
the lake from a hilltop. The
massive fortress had not
seen battle since the French
and Indian War nearly
twenty years before. The
fort had been the site of
sieges and battles then, as it
transferred between French
and British control, and sat
at the connection between
two important waterways.
But this morning, on May 10,
1775, all was quiet at the fort.
The soft morning sunlight had
bathed it in the same soft pink
as the lake below. The lone
sentry on duty was asleep.
The officers were asleep. In
fact, nearly everyone was still
dozing before the start of the
day.
They did not know that below,
gliding noiselessly across the
glassy surface of the lake,
two boats loaded heavily with
over a hundred and sixty men
were heading towards Fort
Ticonderoga. The boats were
loaded with American militia,
most of them members of the
famous “Green Mountains
Boys” under the command of
Ethan Allen. The old fortress
was to be the site of more
battles very soon to come.
Less than a month before, the
first shots of the American War
for Independence had been
fired. As the siege of Boston
began and the Americans and
British prepared for war, the
armaments that were kept
at Fort Ticonderoga became
a prize once more. The
Massachusetts Committee
of Safety had sent Benedict
Arnold north, to raise a
militia and seize the guns and
other supplies stored at Fort
Ticonderoga. But soon after
Arnold embarked, he learned
that the Connecticut Assembly
had already sent Ethan Allen
and his Green Mountain Boys
to do the same job. Arnold
raced to catch up with Allen,
and when he finally did, he
insisted on being placed in
command of the mission.
However, Ethan Allen’s men
declared unequivocally that
they would serve under no
man except Allen, and Arnold
was forced to go along for the
ride.

M AY 10, 1775
The boats carrying the
Americans bumped gently
into the bank below the
fort. The Americans jumped
lightly out onto the shore and
hauled the boats up out of
the water, moving as silently
as possible. They did not
want to give the British any
hint of their approach. Their
muskets were ready and their
bayonets fixed. A few orders
were muttered quietly, and
all the hushed swearing,
joking, and laughter silenced
immediately. The Americans
looked up at their objective
on the green hillside above
them. Fort Ticonderoga had
been built by the French in
a star-shaped design. The
points of the walls allowed
for superb observation in all
directions, but as Ethan Allen
strained his eyes in the milky
morning light, he could not
see any lookouts. He glanced
at Arnold, who shook his head
brief ly. He hadn’t seen any
either.
Allen motioned with his
hand, and the militia force
followed him up towards
the fort. Their footsteps
crunched over the ground,
and the cool misty air seemed
heavy around them. They
were almost upon the fort
when the British sentry was
startled awake by the sound
of their footsteps. He jumped
up in confusion and surprise,
fired a harmless shot into the
air, and ran wildly into his
barracks.

Ethan Allen and his Green
Mountain Boys realized
that the time for silence was
over. With yells and shouts
and blood-curdling Indian
war whoops, they charged
into the fort. The American
militiamen began kicking
down whatever doors they
saw, but Ethan Allen and
Benedict Arnold both headed
directly towards the officer’s
garrison. Allen arrived first
and kicked at the closed door
in front of him.
“Come out, you old rat!” He
yelled. The British commander
inside was struggling into
his clothes. Someone inside
demanded of Allen through
what authority he made his
demand. Allen responded:
“In the name of the Great
Jehovah and the Continental
Congress!”
It was all over very quickly.
The British officer in
command, Captain William
DeLaPlace, surrendered his
sword and asked for more
specifics about Ethan Allen
and his force. The news of
Lexington and Concord had
not reached him yet. He did
not know that the American

letter from General Gage,
sent to warn DeLaPlace that
the Americans might make
an attempt on the fort, did not
arrive until May 19th.
The spoils of the day were
considerable. As the Green
Mountain Boys began joyfully
consuming the rum and other

spirits they had found, Allen
and Arnold made a tally of
the armaments now in their
possession. They had captured
seventy-eight cannons, six
mortars, and three Howtizers.
Also, they found thousands of
cannon balls and nine tons of
musket balls.
The morning had risen bright
and fair over the shining
Lake Champlain. The day
ahead promised to be sunny
and warm. The Americans’
surprise of the British that
morning had been complete.
The fort and weapons had
been seized without the loss
of a man.
The weapons captured that
day were to play a crucial
war in the American War
for Independence. Henry
Knox, under the command of
General George Washington,
would employ them in the
siege of Boston and many
more key battles in the bloody

is being debated in Wash-
ington D.C. which would
resurrect the now deceased
Glass-Steagall Act. That bill
is being actively assaulted
by the Obama Administra-
tion, which is pressuring the
Senate to vote no. Why? Be-
cause Glass-Steagall would
ban the big bail-out bullies
– the muscle-men of money
on Wall Street and in the na-
tion’s Capitol. How can I say
that?
