Re: Home Rule Petition
Dear Honorable Members:
As you may or may not know, Public Safety Commissioner E. John Morocco is facing mandatory retirement in
September.
‘As Public Safety Commissioner, John provides a valuable and high level of service to this city and to this
office. He is a very important part of my Executive Team providing counsel, leadership, management, grant
writing, and mentoring to all public safety staff for the City of North Adams. While we have two excellent
directors in both police and fire who manage all aspects of day-to-day operations within their departments, John
is able to focus on prioritization, budgeting, grant writing and emergency management services for the city.
The Home Rule Order that I am proposing will ask the Commonwealth to allow John to continue in his role as
Commissioner. While I feel we have very strong police and fire services, the past couple of years have seen
many new hires and John’s experience and leadership is key to the continued development and success of our
Public Safety Department.
I respectfully request adoption of the Order and upon adoption will forward to Senator Downing and
Representative Bosley for filing.

WHEREAS, the City Council of the City of North Adams, at the request and with
the approval of the Mayor, has the authority to submit by way of Home Rule Petitions
requests to adopt Special Laws governing and affecting the City; and
WHEREAS, the Mayor of the City of North Adams deems it prudent and in the
best interests of the City to continue the employment of E. John Morocco as
Commissioner of Public Safety for the City of North Adams past the mandatory
retirement age pursuant to the General laws of the Commonwealth; and
WHEREAS, to accomplish the foregoing and in furtherance of the best interests
of the City, the City Council desires to submit the Act, in the form attached hereto and
made a part of this Order, and entitled “An Act Authorizing the City of North Adams to
Continue the Employment of Public Safety Commissioner E. John Morocco", to the
Massachusetts Legislature for adoption into law by the Great and General Court,
NOW THEREFORE, it is ordered:
That the City Council hereby approves the Act in the form attached, and that the
Mayor, acting on behalf of the City, be and is hereby authorized to petition the
Massachusetts Legislature and to request the adoption by the Great and General Court
of the act in the form attached hereto, together with any reasonable amendments
thereto, in form or substance, within the scope of the general public objectives of this.

AN ACT AUTHORIZING THE CITY OF NORTH ADAMS TO CONTINUE
THE EMPLOYMENT OF PUBLIC SAFETY COMMISSIONER E. JOHN
MOROCCO
Be it enacted by the Senate and House of Representatives in General Court assembled, and by
the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, E. John Morocco,
Commissioner of Public Safety for the City of North Adams, may continue to serve in such
position past the mandatory retirement age otherwise required by law. ‘The appointing authority
may, at its own expense, require that E. John Morocco be examined by an impartial physician to
determine that he is mentally and physically capable of performing the duties of that position.
Deductions shall continue to be made from the regular compensation of E, John Morocco under
Chapter 32 of the General Laws for any service preformed hereunder.
SECTION 2. This act shall take effect upon its passage.
