Appellant Versus Shri Neeraj Kansal Central Public Information Officer Ministry of Home Affairs New Delhi-110001 Respondent Whereas Dr.Lenin Raghuvanshi (hereinafter to as the appellant) vide his letter dated 15.12.2009 (received in this department on 13.09.2010) has preferred an Appeal against the information provided by the CPIO (hereinafter referred as Respondent) vide his letter F.N. 17012/34/2009-PR dated 18.5.2010 and the National Crime Records Bureau (NCRB) vide his letter No.STT(200)/RTI/293/08/NCRB dated 19" November, 2009. 2. The present appeal is about seeking complete information in respect of his application dated 2.11.2009 3. | have gone through the application and the appeal of the Appellant. In this connection it is informed that “Prisons” is a State subject under List-II of the Seventh Schedule to the Constitution, and therefore, the management of the prisons is primarily the responsibility of the respective State Governments. All the information sought by the appellant is maintained by the State Governments.However, the National Crime Record Bureau (NCRB) of the Ministry of Home Affairs collects and compiles some of the prison statistics on all India basis which is available at their website www.ncrb.nic.in. The NCRB vide their letter dated 19.11.2009 has, however, already supplied the requisite information maintained by them. Rest of the information are not maintained by them. The applicant is, therefore, advised to obtain the remaining information from the State Governments concerned. In view of this it is my considered view that the information furnished to the appellant by the respondent is complete in all respect. 4, In view of the facts stated above, the appeal is disposed off.
