A Sampling of Common Blunders andUncorroborated Statements by Members of Congress about Obama’s Birth andConstitutional Eligibility.
Executive Summary:
Certain Members of Congress based their claims that Obama wasborn in Hawaii almost entirely upon an online document (a Certifi-cation of Live Birth - not to be confused with an original birthcertificate) - which the State of Hawaii has refused to verify as astate-issued document. In some cases, Congressmen out-sourcedresearch on the eligibility issue to Senator Obama’s office, or toObama-friendly websites such as FactCheck.org. or friendly news-papers. Yet with regard to McCain, the Senate Judiciary Committeeheld a hearing to try to determine his “natural born” status andapproved a non-binding resolution affirming his eligibility. SenatorMcCain produced a long-form birth certificate (with hospital andattending doctor’s name) after being subjected to relentless ques-tions about his eligibility. Senator Obama co-sponsored this legisla-tion, but never produced a copy of his original birth certificate, andto this day, refuses to provide the name of a hospital of birth or anattending physician’s name to corroborate his claimed birth in Ha- waii.
The Constitutional requirement for thePresidency:
In this serious Constitutional matter of whether Obama meetslegal, Constitutional requirements to serve as President and Com-mander-in-Chief, Congress was derelict in its duty. Article. II, Section. 1, Clause 5:
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Of- fice who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
The Oath taken by Members of Congress when sworn into office:a Constitutional Oath mandated by Article VI of the Constitutionand 5 USC § 3331 (federal law), is sworn by all federal employeesexcept the President:
“I, _________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

The Health Director personally verified that Hawaii’s HealthDepartment holds the President’s original birth certificate. The existence and accuracy of the birth certificate also was ve-rified by the non-partisan organization FactCheck.org whichsent a representative to Hawaii to analyze the birth certificatein person.”

)No hospitalin Hawaii will claim to be Obama’s birthplace. No hospital inHawaii will confirm or deny that it is Obama’s birthplace. TheHawaiian Dept of Health will not confirm or deny which hos-pital Obama was born in or whether he was born in a Ha- waiian hospital at all. Two different hospital names were re-leased to the press; Queens Medical Center initially, then Ka-pi’olani.
Sherrod Brown:Statement:
“Senator Obama has provided several news or-ganizations with a copy of his birth certificate, showing he wasborn in Honolulu, Hawaii on August 4, 1961...Senate rulesprohibit me from commenting on the political implications of your letter.”
Editorial comment:
A Certification of Live Birth is NOT anoriginal birth certificate. The 1961 birth record, the originalbirth certificate, is what remains concealed- by Obama’s law-yers, at Obama’s directive. The online Certification of LiveBirth released by the Obama campaign was NEVER verifiedby any Hawaiian official as being issued by the State.
Jim Bunning:Statement:
“In regard to Senator Obama, there is a federallawsuit pending in Pennsylvania addressing this matter. How-ever, as a United States Senator, I cannot intervene in the legalprocess and must defer to the courts to make the appropriatedecision about this case.”

If Senators point to courts and courtsdismiss lawsuits based on lack of standing or jurisdiction, ex-actly who is responsible for determining the President’s Con-stitutional eligibility- based on evidence and facts, not hearsay?
Richard Burr:Statement:
“It is my understanding that President-Elect Ob-ama has released an official copy of his birth certificate. Sincehe was born in 1961 in Hawaii, he is eligible under the Consti-tution to run for and hold the office of President of the Unit-ed States. In addition, President-elect Obama’s birth recordshave been certified and validated by the Hawaii Departmentof Health as well as by experts from the University of Penn-sylvania.”

A Certification of Live Birth is NOT anoriginal birth certificate. No one from the the University of Pennsylvania has ever certified and validated Obama’s originalbirth certificate or any birth record from the Hawaiian Dept of Health.

Jeb Hensarling:Statement:
“As you may know, during the recent presidentialcampaign, some claimed that Mr. Obama was not a naturalborn citizen as required by the Constitution, are (sic) thus noteligible to be president. In June, his campaign released a copy of his birth certificate which showed that he had been born inHawaii on August 4, 1961...To date, no federal court, includ-ing the Supreme Court, has decided that there is any truth tothe allegations that would disqualify Mr. Obama from serving as president.”

Obama’s campaign NEVER released acopy of his birth certificate. The courts have never reviewedany actual evidence- no case has been decided on the merits. If the courts won’t examine evidence, why doesn’t the Congresscall for Obama to release his records (the evidence)?
Steve King:Statement:
“While I do not understand why President Ob-ama has refused to produce evidence to clear up this question,my office has discovered confirmation that puts the questionto rest. You will find a copy of President Obama’s birth an-nouncement in the Honolulu Advertiser, dated August 13,1961. This shows that President Obama was born in the Unit-ed States and is therefore an American citizen under the 14th Amendment to the United States Constitution.”
Editorial comment:
A newspaper announcement (and thisone references his grandparents’ home address and does notmention a country or place of birth) is not evidence. Thenewspaper birth announcements were automatically publishedafter the filing of a birth record with the Hawaiian Dept of Health in 1961. ). Without a hospital name or doctor’s signature (customary in-formation on any original birth certificate), this is not enoughinformation to conclude Obama was born in Hawaii.

No allegations pertaining to PresidentObama’s citizenship have been reviewed and dismissed by any courts, including the United States Supreme Court. Allegationshave been dismissed on the grounds that the plaintiffs lackedstanding to ask that their allegations be considered by thecourts.
Joseph Lieberman:Statement:
“According to information provided to me by hisformer Senate office, President Obama was born in Hawaii on August 4, 1961. A copy of his birth certificate has been madeavailable to the public, and you can view this document by vi-siting the following website:http://www.factcheck.org;elections-2008/born_in_the_usa.html.I am aware that there were law-suits brought challenging the authenticity of his birth certifi-cate and other related issues, but in each case those allegations were dismissed or were determined to be false.”

Is Senator Obama’s office considered anobjective source of information to determine his Constitution-al eligibility?

lied when it said it had “seen,touched, examined and photographed the original birth certif-icate.” They saw the Certification of Live Birth, a computer-generated, laser-printed form that did not exist in 1961. Kitty Pilgrim repeated this lie on CNN on July 17, 2009 when sheclaimed that the Obama campaign had produced the originalbirth certificate. No court has ever determined that any allega-tions about Obama’s eligibility are false.
Ed Whitfield:Statement:
“I have heard some of the same reports that youmention about Mr. Obama. Of course, the voters have spokenpretty clearly, and so now we will move on. I do expect thatthe news media and the proper authorities will look into any reports which have caused people concern, and that any evi-dence of legitimate concern will be appropriately addressed.”

An election does NOT overturn theConstitution and the rule of law. Is a Congressman not a“proper authority” to look into such serious concerns and isn’tthe oversight function of Congress among its most importantduties?
