· April 2010 – Dr Zernik filed a report on Human Rights in Los Angeles County, California, as part of the first
ever 2010 UPR (Universal Periodic Review) of Human Rights in the United States. The report was
incorporated into the staff report of the Human rights Council of the United Nations with a reference to
"corruption of the courts and the legal profession and discrimination by law enforcement in California". [i ]

· August 2010 – Dr Zernik published a report in a peer-reviewed computer science journal, with editorial
board including scholars from six European nations and Canada, opining fraud in the case management
systems and online public access systems of the Los Angeles County jails (Inmate Information Center) -
enabling large-scale false imprisonments under the pretense of lawfulness. [ii ]
· August 2010 – Dr Zernik published a report in a peer-reviewed computer science journal, with editorial
board including scholars from six European nations and Canada, opining fraud in the design of the case
management and online public access systems of the United States courts (PACER and CM/ECF) -
enabling the conduct of pretense litigations. [iii ]
· April 2009 – Dr Zernik authored reports regarding Sustain, the case management system of the Superior
Court of California, County of Los Angeles. Upon review of the reports, a leading computer science
scholar, Prof Eliyahu Shamir, provided a qualified opinion, supporting Dr Zernik’s claims of fraud in the
design and operation of the system, and calling on US computer science scholars to examine the integrity
of the system. [iv ]
· January 2009 – Dr Zernik’s opinion of fraud in specific litigation records of the Superior Court of California,
County of Los Angeles, was reaffirmed by the opinion of Fraud Expert James Wedick, an FBI veteran,
who had been decorated by the US Congress, US Attorney General, and FBI Director for his
accomplishments in crime prevention. [v ]
· ~August 2008 - Dr Zernik’s opinion of fraud in the underwriting and loan records of Countrywide Financial
Corporation and related persons, was supported by the opinion of Fraud Expert Robert Meister, a Fraud
Expert, who appears in courts across the United States. [vi ,vii ,viii ]
· ~August 2004 – Dr Zernik’s opinion of fraud in the online public access of the California Commission on
Teachers Credentialing relative to teachers’ credentials in the Beverly Hills School District was confirmed
after two lengthy investigations by the California Department of Education, which determined “The
School District is out of compliance and in violation of the law”.
The summonses are not listed even as an attachment. Therefore, there could not possibly be a valid NEF
for the summonses as issued by clerk. Therefore, the summonses as issued by the Clerk should be
deemed invalid.
Dkt #03 Letter Reassigning Case: The Letter fails to include valid and effectual language such as “Order” or
“Notice”. Instead, it is “advised” that the case is reassigned. Moreover, the Letter specifically refers to the
Notice of Electronic Filing (NEF) as integral part of the Letter. However, public access to the NEF is
denied. In other cases in the US district courts, Assignment Orders were issued with invalid NEFs.
Therefore, there is no way to establish whether there is valid reassignment in the case for Judge Arguello.
[x ] The Letter should be deemed vague and ambiguous at best.
Dkt #04 Order Referring Case to Magistrate Judge Kathleen M. Tafoya: As noted in the docket, no
record is linked to the docketing text “TEXT ONLY ENTRY - NO DOCUMENT ATTACHED”. The At
the same time, the docket text refers to an “ORDER” “By Judge Christine M. Arguello”. Since the
docket itself states that no record was docketed, it could not possibly be certified by Judge
Arguello. Therefore, it should be deemed invalid docket notation.
Dkt #06 Letter Reassigning Case to Magistrate Judge Michael J. Watanabe: See Dkt #03, above.
Dkt #10 Motion for Extension of Time to file returns of service: The Motion is listed in the docket.
However, it is missing from the Related Transactions Report.
Dkt #12 Summons Returned Executed as to Victor Boog: The executed summons was docketed, and
therefore the summons as issued can be examined: The summons as issued by Clerk include an invalid
legal signature box: No name of an individual Deputy Clerk appears under the signature line. It should
also be noted that filing of the summons as executed bears the “FILED” stamp, dated “September 23,
2010”. However, the name and the hand signature of an individual Deputy Clerk are missing from the
stamp. It should be further noted that the Related Transactions Report failed to list the issuance of
summons, not even as text related to the Complaint (Dkt #01). The Summonses, as executed (Dkt #11-32)
are not listed as related to any transaction, and service of the summonses is not listed as “terminated”.
Dkt #19 Memorandum regarding 10 Motion for Extension of Time: There is no record linked to the
notation “TEXT ONLY ENTRY - NO DOCUMENT ATTACHED”. Therefore, there is no certification
of the Memorandum by Judge Arguello. It should also be noted that Dkt #19, like that Motion (Dkt #10)
itself, has no designated “box” in the Related Transactions Report. Therefore, no transaction was
opened, and no transaction was terminated.
Dkt #38 Minutes: No name of a Deputy Clerk appears in the Minutes. Therefore, the record cannot be
deemed a valid record of Minutes of the US District Court. The Minutes purport to rule on the Motion
(Dkt #10). However, the Motion was never listed as an open transaction in the Related Transactions
Report.

3. Opinion:
The records, which were examined in Lewis et al v. Gleason et al (1:10-cv-01850), are incomplete. Public
access is denied in the PACER dockets to the NEFs (Notices of Electronic Filing), which are deemed today
by the US district courts the electronic certificates of authentication/attestation by the Clerk.
In case the Plaintiffs have in their possession copies of the NEFs, it is recommended that they provide copies
of the NEFs pertaining to the records, docket numbers of which are listed above.
In case Plaintiff had no access to CM/ECF so far, and got no electronic notices, it is highly recommended that
they make efforts and press to gain access to the NEFs, following steps, which are outlined in the link below.

Dr Zernik’s experience in a number of US district courts and US courts of appeals is that the clerks of the US
courts today deny public access to the NEFs also when explicitly requested to provide copies of the NEFs of
specific records in a given caption. No attempt was made to gain access to the NEFs in the case at hand.
In some cases, where Dr Zernik gained access to the NEFs of judicial and clerical records, and invalid NEFs
were discovered, which were issued with no knowledge of pro se Plaintiffs in Civil Rights matters. Detailed
description of the NEF, its significance, and samples of both valid and invalid NEFs from another US district
court are provided in the Motion to Intervene, recently filed by Dr Zernik in Log Cabin Republicans v USA et
al in the US Court of Appeals, 9th Circuit. [xii , xiii ]
The Motion to Intervene also claims that the denial of public access to the NEFs amounts to violation of the
First Amendment right to access court records to inspect and to copy and the US Supreme Court decision in
Nixon v Warner Communications, Inc, 435 U.S. 589 (1978).
Regardless of the missing NEFs, sufficient evidence is found in the docket and related records of Lewis
et al v. Gleason et al (1:10-cv-01850) as detailed in 2), above, of notations, stating the entry of records by
individuals, whose names and authority are not spelled out in the PACER docket, pertaining to judicial
and clerical records, which are patently invalid court records.
Therefore, Dr Zernik opines that the Docket Report of Lewis et al v. Gleason et al (1:10-cv-01850) is false
and deliberately misleading, meticulously constructed to convey the perception of valid litigation, where in
fact the evidence indicates that the litigation was and is deliberately invalid from its commencement.

It is recommended that the Plaintiff report the conduct of US Judge Christine M. Arguello, US Magistrate
Michael J. Watanabe, and Clerk of the US District Court Gregory C. Langham to the Public Integrity Section
of the US Department of Justice and to the US Congress Committees on the Judiciary.
