Dear Mr. McBride:

This office is in receipt of your documents (petitioner’s committee, ballot title and text, and sample petition)
for a proposed recall of the Board Director in Director District 4 of School District #1, City and County of
Denver, State of Colorado. These documents were submitted for approval to the Denver Clerk and Recorder
on January 24, 2011. Our office has completed its review of these documents, and pursuant to Colorado
Revised Statutes § 1-12-101 et.seq., your documents have been approved as to form.

Your petition sample does contain two typographical errors that must be corrected prior to circulating
petitions. In the first line of the warning statement on the Signature Page, please replace the word “sigh”
with “sign.” In the second line of the Affidavit of Circulator, replace the word “an” with “on.” If you plan to
handwrite the petition section number at the bottom of the signature pages, please make the line longer to
accommodate the four digit numbering convention.

Also, please be advised that pursuant to C.R.S. § 1-12-108 (1), a completed recall petition shall be filed with
the Clerk and Recorder (Elections Division) no later than sixty days from the date of approval of the petition
documents. To be deemed sufficient, the petitions must be signed by eligible electors of the school director
district equal to forty percent of those electors who voted in such district in the last preceding election
(C.R.S. § 1-12-105). The vote total for the last election in Director District 4 was 13,408; therefore forty
percent is 5,363 valid signatures from Director District 4.
