Given that the collective bargeining process that was initieted in 2008 has not yet been concluded and that the collective agreement received is in draft form, the requirements of section 71(1) of the ‘Canada Labour Code (Code) have not been met. In particular, we are not satisfied that the notice to commence collective bargaining has been properly given under section 49 of the Code, Furthermore, section 6 (2) of the Canada Industrial Relations Regulation provides thet, a notice of dispute to the Minister, given under Section 71 of the Canada Labour Code, shall be accompanied by a copy of the most recent collective agreement between the parties.
