In the matter of the Canada Labour Code (Part I- Industrial Relations) and a dispute affecting the
City of Ottawa, Ottawa, Ontario and the Amalgamated Transit Union (ATU), Local 279
This is jn response to your conespondence dated April 5, 2011 concerning your request for the
appointment of a conciliation officer, to assist in the dispute between the City of Ottawa and the
Amalgamated Transit Union, Local 279.
Given that the collective bargeining process that was initieted in 2008 has not yet been concluded
and that the collective agreement received is in draft form, the requirements of section 71(1) of the
‘Canada Labour Code (Code) have not been met. In particular, we are not satisfied that the notice
to commence collective bargaining has been properly given under section 49 of the Code,
Furthermore, section 6 (2) of the Canada Industrial Relations Regulation provides thet, a notice
of dispute to the Minister, given under Section 71 of the Canada Labour Code, shall be
accompanied by a copy of the most recent collective agreement between the parties.
CanadaHowover, it has been decided to appoint two mediators, pursuant to section 109 ofthe Canada
Labour Code, to assist the parties in their discussions.
