Re: Sunshine Law Violations

Dear Mr. Centorino:

I am referring to your office for an investigation of what I consider to be serious


Sunshine Law Violations that have tarnished my desire to have our Miami Lakes
Government operate openly and transparently.

Council Member Nelson Hernandez had an item on the Agenda regarding changes
he wished to propose to the town Committee System. Council Member Richard Pulido
sponsored similar items in the past.

Knowing this item was on the agenda in an effort to insure sufficient voter’s for
passage, Councilman Hernandez placed the attached posting on his private Facebook
page, which encourage his surrogates to specifically contact Council Member Mary
Collins and ask her to vote in his favor on this item. This was clearly a conspiracy on
Council Member Hernandez in part to violate the Florida Laws by having third parties
tell his colleague how to vote on a upcoming item.

At the Council Meeting, Council Member Pulido stated that he was on the private
Facebook page and that he personally responded to an on-line poll that Council Member
Hernandez was doing and told Council Member Hernandez that he agreed with him. By
Council Member Pulido acknowledging that he read the message from Council Member
Hernandez, subscribes to his Facebook page, and responded to an agreement on an
upcoming item on the Agenda clearly indicates a violation of the language and spirit of
the Florida Sunshine Law. Since Council Member Hernandez is the Administrator for the
Facebook page and is aware of Council Member Pulido’s computer address, his message
on this issue and Council Member Pulidos’ response was that they reached accord in
private and prior to the meeting.

I am asking that your office fully investigates what is an open and notorious
Florida Sunshine Law violation and take appropriate enforcement action.
