JUDGMENTANDSENTENCEtORDIRECTCRIMINALCONTEMPTThismattercamebeforetheCourtonJune302011,upontheCourt'sownmotiontoshowcausewhyMATTHEWBARTLETT,whosedateofbirthisJuly4,1982,shouldnotbefoundindirectcriminalcontemptofcourtpursuanttorule3.830oftheFloridaRulesofCriminalProcedure.DuringthetrialproceedingsintheStatev.CaseyAnthony,CaseNo.200R-CF-15606-0,theDefendantwasamemberofthetrialaudience.Hewasseatedinthelowerlevelofthecourtroominaseatdirectlyinlinewiththetelevisioncamera.TheCourtwasnotifiedbyamemberofthemediathattheDefendantwasobservedmakinganobscenegesturecommonlyreferredtoas"shootingabird"directedtowardsthewellofthecourtroom.The

wasprovidedaphotographoftheDefendantwhichclearlyshowstheDefendantmakingsaidgesture.Acopyofsaidphotographisattached.TheDefendantwasbroughtbeforetheCourttofacechargesofdirectcriminalcontemptbasedonhisaction.Hewasgivenanopportunitytoexplainwhyheshouldnotbeheld
in
directcriminalcontemptofcourt.TheCourtquestionedtheDefendantandheardandconsideredhis
 
explanationsandotherstatements.Pursuanttoquestioning,theDefendantacknowledgedhehadobservedthenoticepostedontheentrancetothecourtroom,acopyofwhichisattached,whichstates,"Anygesture,facialexpressionoraudiblecommentshowingapprovalordisapprovalduring
a
courtproceedingisabsolutelyprohibited."Hestated

couldreadand

ahighschoolgraduate.TheDefendantstatedthatpriortothebeginningofproceedings,hespecificallyheardthecourtdeputyreiteratingthewarningspostedonthesignandwarningtheaudiencenottomakegesturesorfacialexpressions.TheDefendantadmittedhemadethegestureandhestatedthatitmeantthe"F-word'andhedirectedtheobscenegesturetowardstheAssistantStateAttorney,JeffreyAshton,whowasatthepodiumaddressingtheCourt.TheDefendantspecificallyacknowledgedthejurywasinthecourtroomatthetimebemadethegesture,InSmithv.State954So.2d1191(Fla.3dDCA2007),thecourtstated:Thepurposeofcriminalcontemptis"topunishassaultsoraspersionsupontheauthorityanddignityofacourtorjudge",nottoavengepersonalaffronts.Afindingofdirectcriminalcontemptmaybebaseduponeitheraviolationofanorderofthecourtoranactwhichisfaciallycontemptuous.ContempthasbeendefinedbytheFloridaSupremeCourtasfollows:[AJnyactwhichiscalculatedtoembarrass,hinder,orobstructthecourtintheadministrationofjustice,
or
whichiscalculatedtolessenitsauthority
orits
dignity,
is
acontempt.
The
testisnotthephysical
propinq
uityoftheacttothecourt,butitstendencytodirectlyaffecttheadministrationofjustice.Id.at1194(citationsomitted).TheDefendant'sactionswereclearlycontemptuousandwerewithoutquestionanassaultupontheauthorityanddignityofthecourt.Thetrial
inwhich
hecommittedhiscontemptuousacthadbeenprogressingforapproximatelysixweeks
at
greatcosttothetaxpayersofFlorida.ThemembersofthejuryhavebeensequesteredformuchofthattimePage2of4
 
andhaveattentivelyattendedtotheircivicduties.WhiletheDefendantapologized,hisactionsclearlycouldhavegreatlyhinderedandobstructedtheadministrationofjusticeinthismatter.Therefore,itisherebyORDEREDANDADJUDGED:

2.MatthewBartlettissentencedtosix(6)daysincarcerationintheOrangeCOW1tyJail.3.MatthewBartlettshallpayafmeof$400.00dollarsandstatutorycourtcostsof$223.00,foratotalof$623.00.Heshallhave
