and
Local 1522
of
Council #4,
AmericanFederationof State, County
and
Municipal
Employees, AFL-CIO,
(the
"Union").
I.
THE UNION AND UNION SECURITY
ARTICLE
1
RECOGNITION
1.1 The
Employer
recogni7..es
the
Union
as the
sole
and
exclusive
bargaining
agent
for
the
purpose of establishing salaries,
wages,
hours,
and conditions
of
employment
for all
of those
employees
of
the
City
as
oertified by
the
Connecticut
State
BoardofLabor Relations
in
Decision
No.
816-A,
issued December
5, 1968,
andas amended in
Case
No. ME-1444, Decision No. 1440-C,
issued December
27, 1976.
The Employer
further recognizes
the
Union
as the bargaining agent
for so-called timeJay employees
holding
the
position ofprogram
assistant,
Jaraprofessional, clerk aide,
truck
driver or bilingual aide who
are
)therwise in allrespects
appropriate
for
the bargaining
unit. The
B;mployer
further
recognizes
theunion asthe
bargaining
agent
for W.I.C.'mployees
as
described
in
Case
No. ME·13,777, Decision No. 2968.l.2
The Unionrecognizes
the
Mayorof
the
Cityor his/her designated'epresentative, or
representatives asthe
sole
representative(s) of
the
~mployer
for
the
purpose of
collective
bargaining.
l.3 The
Union
and the
City agree to
bargain in
good
faith on
all
matters
'elating
to
wages,
hours
and
other
conditionsofemployment.
ARTICLE
2
CHECK-OFF
:.1
The Cityagrees
to deduct
from
the
pay ofall
employees covered byhis
Agreement, who
authorize
sum
deductions
from
their
wages
in
vriting,
such membership
dues and
initiation
fees
as
may
be
uniformlylssessed by
the
Union.
Such
deductions
shall
continue
for
the duration
of
his
Agreement.
When
an
employee
does
not
have
sufficient
moneydue
limfher,
after
deductions have been
made
for
pension or
other
deductions
equired by law,
Omon
dues
for
such deduction
period
shall
be
deducted
-1·
in
the
first
dues
deduction payperiod
in
which
the
employee
has
sufficient
funds
due
himlher.
It
is
also
agreed
that
neither any
employee
nor theUnion
shall
have any
claim
against the
City
for
errors in the
processing
ofdeductionsunless
a
claimof
error
is
made
in writing
to
the
Citywithin
sixty (60)
calendardays afterthe date
such deductions were or
should
have been made.
It
is
also agreed
that
the
obligation
of
the
City for
fundsactually deducted
under this
section
terminatesuponthe
delivery ofthe
deductions so made to
the
person authorized to receive such
amounts
from
the
City.2.2
The dues deduction
for
the
Union shall
be
made
during
eachemployee's
respectivepay
period
and
shall
be
remitted
to
the
Union.
together with
a
list
of
names
of employees
from whose
wagessuchdeductions have been made, not
later
than
the
fifteenth
(15th)
day
of
the
following
month.
2.3
It
shall be
a condition
of employment
that
all employees of
the
Employer
covered by
this
Agreementwho
are
members of
the
Union ingood
standing
on
the
effective
date
of
this Agreement
shall remainmembers in
good
standing
of
the
Union
during the term
of
the
Agreement.
It
shall
be a condition
ofemployment
that
all employees
covered by
the
Agreement
who
are
not members of
the
Union on
the
effective
date of thisAgreement
shall,
on
the thirty·first
(31st)
day
following
the
effective
dateof
this
Agreement
become
and remain
membersin
good
standing
in
theUnion
duringthe term
of
the
Agreement.
It
shall also
be a condition of
employment
that
all employees
covered by
this Agreement and
hired
on
or
after
its
effective
date
shall,
on
the thirty·first
(31st)
day
following
thebeginning of such employment
become
andremain
members in
good
standing in the
Union or pay
to
the
Union
an
amount
equal to
dues
payable
by
Unionmembers
during theterm
of
the
Agreement.
All such
dues
shall
be
automatically
payroll
deducted
andremitted
to the
Union.2.4
The Employeragreestodeduct
from
the
wagesof
any
employee whois a
member of
the
Union
a
P.E.O.P.L.E.
deduction
provided for in a
written
authorization.
Such authorization must
be
executed
by
the
employee
and may
be
revoked
by
the
employee
at
any
time
by giving
written
notice
to both
the
employer
and the
Union.
The
Employer agreesto
remit any
deductions made
pursuant
to
this
provision
promptly
to
theUniontogetherwith
an
itemized
statement
showing
the name
ofeach
employee from whose
pay such deductions have been made
and
the
amount
deducted
during the
period
covered by
the
remittance. The
Union
agrees
to hold
the
City
harmless
from
any
claims
arising as
a
result
of anydeduction made
pursuant
to
this
subsection.·2·
