Attached is a draft powerpoint for BOH study session on Wednesday. I kept it short/succinct. Wanted to bring in the questions brought forth at the last BOH meeting on FDAs position and past TPCHD Tobacco policies. Then lead into a quick overview of the main points of the e-cig resolution with conversation. Then the same with local SIPP resolution. End with next steps. Please note the snapshot of the FDA video- if you can watch it, that would be great. I think it would be good to play for the Board. Its less than 4 minutes. Please let me know what you think. I can modify based on your suggestions today. Attached is the draft of the PCMS column with Dr. Chen's edits. He made quite a few changes, but I think the direction is still the same and it does push appropriately on the e-cigarette issue.
Liz- he added a stat from this site (http://www.infoplease.com/ipa/A0762370.html) about adult smoking rates in 1965. It cites the CDC, but I can't find the original report anywhere. I'm hesitant to include it without an accurate source. Can you help me? If it's not this source, do you think we can find one that makes a similar point?

Slide 2: * Do we want to call them Tobacco Regulations? I'm on the fence because e-cigarettes don't have tobacco. Slide 4: * I'd add something about the really old one where we said that cigarettes couldn't be sold to minors. It reminds them that it wasn't always the case and shows some history in our efforts. Slide 7: * I'd put "Regulation" or "Resolution" in the title so it's clear we're now talking about what we're trying to pass and not the product itself. * I think we need to be really careful with the word smoking. Technically, when you're using an e-cigarette you are not smoking. The opponents will use other verbs, so we need to be careful. * On the last bullet, I'd say "Prohibits marketing activities such as sampling or heavy discounts designed to attract new and younger users. Slide 8: * The con sticky should have the same size font as the pro. * The con is a little unclear to me. Maybe "Difficult for smokers who are using e-cigarettes to quit smoking." * I'd call it "Cons" and not concerns. Slide 10: * Same comment re: Cons

Just an fyi about the "sticky note" slides. This is going to be interactive- I'll have real sticky notes, pens and large sticky paper on the walls. The intent is to get the pros and concerns about the major components of each of the 2 regs. Each member will be asked to write their thoughts and we'll cluster their thoughts into themes. Will help us to understand the big issues so we can address them in our process/strategy development.

Hi Frank, thanks for the feedback. I made the changes that you suggested however; I'm stuck on one of them. The comment re: moving the e-cigs/SIPP slides before the Answer Your Questions slides (on FDA position and BOH Tobacco policies). I understand your point, but the FDA point directly leads into the conversation about the e-cigs and may give folks some thought before we engage in discussion. The BOH tobacco policy piece can go anywhere but think they should stay together.
So, I left the order, as is, but I added the 2 proposed regulations to the first slide to make it clear what we were discussing so they won't get distracted. I can present in a way that the "questions" piece is just a "side" piece but important for the conversation. How does this sound to you? If you still want me to move the slides, I can do that. I think this is fine. I think it's important to remind Board members up front the main purpose of the discussion. Incorporating the info in the 2nd slide works well.
Attached are the slides with all of your suggested changes except the one discussed above. Just let me know.
Also, regarding email to get back to Becky Sullivan- you should have received an email of which I bcc:d you. I asked Allison for a one to two paragraph summary of her findings regarding the reasons why low income/priority populations have higher rates of smoking. She gave me some articles but no summary- I asked her to get this done by 10 AM today. Not sure whether this is going to get done and how well. Do you want to go with what we've got or wait until I hear back from Allison to see what we've got? I did see that email. I think you can probably use the info in the first paragraph Allison prepared. I think that covers it adequately.
I'll share with Bridget this AM. Green sheet? I saw your email with Bridget's comments. I don't think it needs to go through the green sheet process, but once we get Anthony's comments and incorporate them into the presentation, it

The BOH tobacco policy piece can go anywhere but think they should stay together.
So, I left the order, as is, but I added the 2 proposed regulations to the first slide to make it clear what we were discussing so they won't get distracted. I can present in a way that the "questions" piece is just a "side" piece but important for the conversation. How does this sound to you? If you still want me to move the slides, I can do that.

Also, regarding email to get back to Becky Sullivan- you should have received an email of which I bcc:d you. I asked Allison for a one to two paragraph summary of her findings regarding the reasons why low income/priority populations have higher rates of smoking. She gave me some articles but no summary- I asked her to get this done by 10 AM today. Not sure whether this is going to get done and how well. Do you want to go with what we've got or wait until I hear back from Allison to see what we've got?

I went to the mall today and met w/ Steven Heim, the mall's general manager, he said that it was true. He said all Simon Malls (300 facilities) across the country are smoke free and that means you can't smoke anything in the mall. He said he had done research on the product and understood that e-cigs contain nicotine, which is highly addictive. This was curious to me because e-cigs are sold in the Tacoma Mall. He said that the kiosk rental manager rented a space to an e-cig retailer w/out his previous approval. He said he told her "you might as well have rented the space to a heroin dealer." He called his corporate head quarters and was told that he was correct in banning the use of the item in the building. Steven stated that there is a no smoking sign at every door, and the company applies this policy to all smoking. They have no plans of adding an addendum to their current code of conduct to specifically state "no smoking of ecigarettes". If customers want to smoke an e-cig, they can go outside and stand 25feet from the door.

Well I've got to run out for the day now, so I'm not sure how much help I'll be this afternoon. But basically what happens is any video tries to load and does the spinning dots thing. Then after a few minutes it says "An error occurred. Please try again later."
It didn't always do this, but I'm not sure when it switched.

Section 10: Reinspection-I'd like to suggest that with several changes that we can take out the box diagram in paragraph B. So in A the third line beginning with "finding" would read:
"finding of a violation and any subsequent reinspection within any five-year period also results........."
And then in paragraph B we could: 1. Delete "and following" in the second line 2. Put a "period" in the end after "Board of Health" 3. Take out the box diagram
E-Cigarette
Section 3: Findings I have some reservations about including "Gummy Bears, Peanut Butter Cups and Orange Creamsicle." We know that Kim from the Vaporium will be looking at this language and realize that these flavors are exactly the same as part of her advertising. She will probably think that the Health Department is specifically targeting her business , and treating her unfairly as compared to her competition who may be using other flavors in their ads, but we don't include those flavors in our regulation. She could make a distracting stink about this with the Board . So I'd suggest that we keep in "chocolate and strawberry." We may want to add other child friendly flavors.

Section 6: Suggest that the title be changed to "Sale or Providing to Minors Prohibited" as the intent of the paragraph in several places includes to "give or furnish."
Section 9 Alternate: So what we're saying is that e-cigs could be used in taverns, bars, casinos, etc. where it's currently posted with signs that say "no minors allowed."
This may be where the BOH eventually wants to go with limiting restrictions on where e-cigs can or can't be used, but I'd suggest that we not offer this option at this time. If they can't support the more comprehensive ban in "public places and places of employment," we could then offer the alternative for their consideration.
Section 10: Enforcement
In paragraph B I'd like to suggest that it read......The civil penalties and reinspection fees that may be imposed.....

Thanks Bridget. Also, Ive attached a draft version of a tough Q&A we developed.
In terms of rationale for extending the smoking ban in public areas, it basically boiled down to three arguments, all of which were used prior to the vote:
1) Allowing e-cigarettes creates an enforcement problem for program staff and proprietors, as its difficult to distinguish between an e-cigarette and the real thing
2) E-cigarette use can lead to more tobacco smoking in establishments in violation of the law, which leads to more second hand smoke, which we now know from the Surgeon General can be instantly harmful. (This was based on a couple observations by inspectors.)
3) Banning smoking in public sets an important social norm about the use of tobacco and other nicotine delivery devices.

I saw a complaint on an e-cig forum website from a person who said that they were unable to smoke their e-cig in the Tacoma Mall. I went to the mall today and met w/ Steven Heim, the mall's general manager, he said that it was true. He said all Simon Malls (300 facilities) across the country are smoke free and that means you can't smoke anything in the mall. He said he had done research on the product and understood that e-cigs contain nicotine, which is highly addictive. This was curious to me because e-cigs are sold in the Tacoma Mall. He said that the kiosk rental manager rented a space to an e-cig retailer w/out his previous approval. He said he told her "you might as well have rented the space to a heroin dealer." He called his corporate head quarters and was told that he was correct in banning the use of the item in the building. Steven stated that there is a no smoking sign at every door, and the company applies this policy to all smoking. They have no plans of adding an addendum to their current code of conduct to specifically state "no smoking of ecigarettes". If customers want to smoke an e-cig, they can go outside and stand 25feet from the door. He said that the mall is a family oriented establishment and want to project that image. Allowing the smoking e-cigs throughout the mall would contradict that image. He stated that was the main reason why the Tinder Box smoke shop

Hello all, Attached is the latest summation/article I could locate on the recent court effort by the FDA to regulate e-cigs. Basically, it seems that the courts uphold the assertion by the e-cig manufactures that e-cigs are not cessation/therapeutic products, but alternative "smoking devices". The courts continue to rule that because e-cigs are a type of recreational device, the FDA can regulate e-cigs like any other tobacco product, which is via marketing regulations. The FDA won't be able to regulate any ingredients, including nicotine levels. 1. If e-cigs companies are saying that they are for "smoking pleasure only, not cessation" Why can't e-cigs be treated like any other smoking product? ( i.e. SIPP/not to minors) 2. There is no evidence or claims by the manufactures that there isn't any harm to the environment or the individual 3. The e-cig manufactures state that the e-cigs includes some toxic chemicals, but no research done to see if the vapors truly dissipate. One simply can't smell an odor, which implies nothing. (this is stated in the product warning labels)

Basically, it seems that the courts uphold the assertion by the e-cig manufactures that e-cigs are not cessation/therapeutic products, but alternative "smoking devices". The courts continue to rule that because e-cigs are a type of recreational device, the FDA can regulate e-cigs like any other tobacco product, which is via marketing regulations. The FDA won't be able to regulate any ingredients, including nicotine levels. 1. If e-cigs companies are saying that they are for "smoking pleasure only, not cessation" Why can't e-cigs be treated like any other smoking product? ( i.e. SIPP/not to minors) 2. There is no evidence or claims by the manufactures that there isn't any harm to the environment or the individual 3. The e-cig manufactures state that the e-cigs includes some toxic chemicals, but no research done to see if the vapors truly dissipate. One simply can't smell an odor, which implies nothing. (this is stated in the product warning labels) 4. e-cigs are legal, adults can choose to use them as intended or not intended 5. We're not against a new nicotine replacement therapy, but this is not what the product was designed for or tested to do. 6. If e-cigs are not banned from public spaces, 1. We don't know anything about the second hand mist 2.this may be a trigger for past smoking to start smoking again 3. current regular smokers could say if they can "vape" indoors, why can't I smoke indoors 4. Bruce mention the possible overall SIPP enforcement challenges

10. Enforcement [ I guess I missed that portion of our meeting when it was decided that the penalties for violations will be listed in this regulation. Anyway.....]
In Subsection B.....as a "seller" may not be someone who gives away or furnishes an esd to a minor, we may want to delete "on sellers" from B.
Section 12 Reinspection should be changed to be Section 11 (and in 10.C. "12" should be changed to "11"), and the remaining sections should have their numbers updated.

For feedback, we can go one of three routes. The simplest would just be an email address (directed to Tutrecia, but we could use an alias like MayRegulations@tpchd.org) with an ask for people to share their feedback. Another route would be to set up a SurveyMonkey link, and ask some really targeted questions and some open ended one for feedback. And then we could combine the two and offer both options.
If we're really serious about collecting feedback and doing something with it, then I'd say go with the last option and make ourselves as open as possible to hearing what people say. But we have to expect that we'll get feedback from e-cigarette advocate groups all over the country who will flood the site. And then we have to decide how we capture, analyze and take or disregard all that feedback.

From the perspective of persons who have breathing disabilities, vapors that contain propylene glycol which are a trigger for asthma attacks. Also, the e-cigarette retailers have a financial interest in the product which explains why they oppose laws that restrict the use of e-cigs in public places and workplaces, just like the tobacco industry which opposes smokefree air laws. The FDA stated that they will now be classifying e-cigs as tobacco products, which means that NO e-cig retailer, producer, distributor, etc. should be claiming that their product is used for smoking cessation purposes, since only FDA approved smoking cessation devices can make that claim. Lastly, tobacco control advocates and health departments have made great strides in denormalizing smoking, by passing comprehensive smokefree air laws in public places and workplaces. Amending smokefree air laws to include a ban on e-cigarette use helps to continue the denormalizing of smoking or vaping any product that contains nicotine, since nicotine use can negatively affect health conditions, and increases the risk of diabetes. This morning I received the attached e-mail from Karen Blumenfeld at GASP. The e-mail says that shes Karen Haines but her (Karen Bs) e-mail was down so she was using Karen Hs. In a second e-mail that I received from Karen B. it identified her as the Exec Dir of GASP. Anyway..I gave her a call. I let her know that we are developing new e-cig and SIPP regulations to be presented soon to the public and the BOH. She said that she had seen a news article about that. (I just did a Google search and couldnt find any new article about TPCHD and any new e-cig or SIPP regulations). Linked in this e-mail is a GASP White Paper on E-cigs. Its a very comprehensive document and I think that it will provide us with some good info/data for our work. Karen has sent another e-mail with more info on NJs tobacco/e-cig policies. Ill forward that to you. GASP is funded by the NJ Dept of Health with funds from the CDC.

subsequent appeals thereof. I have gone back and forth on whether to include such a provision. I have had the issue researched. There is no clear case law on the extent to which a local governmental entity can require the prevailing party to be reimbursed for its attorney fees and costs. But I think a strong case can be made that we have authority under the delegation of authority in RCW 70.160.080 (local agency may adopt regulations required to implement the SIPP) as well as under the general delegation of police powers under RCW 70.05.060. It is also my recollection that Dr. Chen wanted to include such a provision if I believed there was legal authority to do so. Lets discuss this further at our 3:00 call. Greg Gregory A. Hi Paul, I'm glad to hear of your interest in this work. As mentioned, I am attaching a copy of our latest timeline and process for the Tobacco policy regs.
Key dates include: 5/16 Public Meeting 6-7 PM TPCHD Auditorium 5/18 Presentation at Board of Health Meeting from 3-5 PM to Board of Health in TPCHD Auditorium 6/1 Board of Health meeting to vote on proposed regulations
We have a meeting scheduled today at 3-3:30 (Steve Marek, our legal counsel and myself) to talk about the regs. Would you like to be here for the meeting- it will be in Steve's office. Also, we're scheduling a meeting for tomorrow (Thursday) and it will either be at noon or 3 PM with the team. You will receive a meeting request for that shortly.
Lastly, I will send the regs in a separate email.

Steve and Kirsten, I have attached the local SIPP and E-Cigarette regulations. The documents incorporate the edits that Steve and I discussed yesterday with Dr. Chen. In addition, I have added a subsection to the enforcement section of both regulations that allows the prevailing party to recoup its reasonable attorneys fees and costs in a proceeding before the hearing examiner or any

subsequent appeals thereof. I have gone back and forth on whether to include such a provision. I have had the issue researched. There is no clear case law on the extent to which a local governmental entity can require the prevailing party to be reimbursed for its attorney fees and costs. But I think a strong case can be made that we have authority under the delegation of authority in RCW 70.160.080 (local agency may adopt regulations required to implement the SIPP) as well as under the general delegation of police powers under RCW 70.05.060. It is also my recollection that Dr. Chen wanted to include such a provision if I believed there was legal authority to do so. Lets discuss this further at our 3:00 call. Greg Gregory A. Also, if you would be willing- it would be great if you could put all of the other counties' regs/resolutions in our shared drive that we're using for the Tobacco policy process. Perhaps you could add a new folder called something like "Tobacco regs and resolutions from other jurisdictions". Would you be willing and able to do that today? J

I believe you are correct. My recollection is that we took the position that RCW 70.160 granted the authority, so there was no need for a formal local board of health resolution to authorize us to enforce SIPP. RCW 70.160.070(3) states "Local health departments shall enforce . . ."

We are posting the regulations on the website on Wednesday, and will pitch a story to the TNT that same day or possibly Tuesday to start the conversation and have an early influence on the story. I've been doing a lot of research on other LHJs around the country that have proposed similar regulation. One important element of their media coverage has been public support and participation in the media by at least one BOH member. I'd like to identify which BOH member will speak to the media about e-cigarettes and the proposed regulation. In talking with Steve, he suggested that Rick Talbert might be our best bet. Other possible options could be Victoria Woodards or Jake Fey. And if she'd be willing, I think that Pat McCarthy would be especially impactful.
If we do not have a BOH member identified, we run the risk of a story coming out that pits the Health Department against the BOH chair, which I believe may weaken our case in the public's eye.
Tawana is working on scheduling your meeting with Rick Talbert, and I believe you're talking to Pat McCarthy today. As you speak with them, if you feel they are in support of the regulation, would you ask if they would be willing to work with the media on this? Specifically we'll need them to participate in a curtain raiser story next week, and then likely be quoted in the press release we issue if the regulation passes.

I like theALF overview as this is what I think Steve is looking for. However; it was developed 9/09 and outdated.
The FDA document is informative but it really speaks to the dangers- rather than give an overview of what they are.
Is it possible to re-create the ALF document and for us to update it with the newest information (esp. the FDA stuff) unless we can find another one pager that is an overview and up to date.

The final files have been moved. Bridget upload a Key Messages document yesterday, too, so you may want to delete one of the documents to avoid confusion. The entire folder structure on the network has been moved. What is left under Tobacco is empty folders. The system won't let me delete one of the folder right now, but I will check back later.
