To amend the Federal Election Campaign Act of 1971 toprovide for additional disclosure requirements for cor-porations, labor organizations, and other entities, andfor other purposes.
 Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Disclosure of Informa-
4
tion on Spending on Campaigns Leads to Open and Se-
5
cure Elections Act of 2012’’ or the ‘‘DISCLOSE 2012
6
 Act’’.

.—Subparagraph (A) of section 301(17) of the

Federal Election Campaign Act of 1971 (2 U.S.C.

431(17)) is amended to read as follows:

‘‘(A) that, when taken as a whole, ex-
8
pressly advocates the election or defeat of a
9
clearly identified candidate, or is the functional
10
equivalent of express advocacy because it can be
11
interpreted by a reasonable person only as ad-
12
 vocating the election or defeat of a candidate,
13
taking into account whether the communication
14
involved mentions a candidacy, a political party,
15
or a challenger to a candidate, or takes a posi-
16
tion on a candidate’s character, qualifications,
17
or fitness for office; and’’.

(A) by redesignating subclause (III) as

subclause (IV); and

(B) by striking subclause (II) and insert-

ing the following:
