ARTICLEIIPurposeofCommunityPlanningGroupandGeneralProvisions
Section1.Section2.Section3.TheNavajoCommunityPlanners,Inc.hasbeenfannedandrecognizedbytheCityCounciltomakerecommendationstotheCityCouncil,PlanningCommission,Citystaff,andothergovernmentalagenciesonlandusematters,specificallyconcerningthepreparationof,adoptionof,implementationof,oramendmentto,theGeneralPlan.oralanduseplanwhenaplanrelatestotheNCPIcommunityboundaries.TheplanninggroupalsoadvisesonotherlandusemattersasrequestedbytheCityorothergovernmentalagency.Inreviewingindividualdevelopmentprojects,NCPIshouldfocussuchreviewonconformancewiththeadoptedcominunityplanand/ortheGeneralPlan.PreliminarycommentsonprojectsmaybesubmittedtotheCityduringtheprojectrevi~wprocess.Wheneverpossible,theformalplanninggrouprecommendationshouldbesubmittednolaterthantheendofthepublicreviewperiodofferedbytheenvironmentalreviewprocess.Uponreceiptofplansforprojectswithsubstantiverevisions,theplanninggroupmaychoosetoreheartheprojectandmaychoosetoprovidea.subsequentformalrecommendationtotheCity.AllactivitiesofNCPIshallbenonpartisanandnonsectarianandshallnotdiscriminateagainstanypersonorpersonsbyreasonofrace,color,sex,age,

Section4.Section5.Section6.Section7.creedornationalorigin,orsexualorientation,orphysicalormentaldisability.Inaddition,meetingfacilitiesmustbeaccessibletodisabledpersons.TheNCPIshallnottakepartin,officiallyorunofficially,orlenditsinfluencein,theelectionofanycandidateforpoliticaloffice.Electedmembersshallnotidentifyaffiliationwithaplanninggroupwhenendorsingcandidatesforpublicoffice.Theplanninggroupmaytakeapositiononaballotmeasure.PursuanttotheprovisionsofCityCouncilPolicy600-5,NCPl'sfailuretorespondtotheCity'srequestforinputonthepreparationof,adoptionof,implementationof,oramendmentto,theGeneralPlanoracommunity,precise,orspecificplan,orfailuretoreviewandreplytotheCityinatimelymannerondevelopmentprojectsshallresultintheforfeitureofrightstorepresenttheNavajoCommunitiesforthesepurposes.SuchadeterminationresultingintheforfeitureofrightstorepresentthecommunityforthesepurposesshallbemadeonlybytheCityCouncilupontherecommendationoftheMayor's.Office.NCPIoperatesundertheauthorityoftheRalphM.BrownAct,whichrequiresthatmeetingsoftheplanninggroupareopenandaccessibletothepublic.Inaddition,CouncilPolicy600-24"StandardOperatingProceduresandResponsibilitiesofRecognizedCommunityPlanningGroups"andthesebylawsgoverntheoperationsoftheplanninggroup.SeveralprovisionsofthesebylawsconstituteBrownActrequirementsasoutlinedinthePolicy.Inaddition,theAdministrativeGuidelinesprovideexplanationsofthePolicy'sminimumstandardoperatingproceduresandresponsibilitiesofthisplanninggroup.

isusedwhenthePolicy,theAdministrativeGuidelines,andthesebylawsdonotaddressanareaofconcernorinterest.TheNCPImayproposeamendmentstothesebylawsbyamajorityvoteoftheelectedmembersoftheplanninggroup.ProposedamendmentsshallbesubmittedtotheofficesoftheMayorandCityAttorneyforreviewandapproval.AnyproposedamendmentsthatareinconsistentwithCouncilPolicy600-24shallnotbeapprovedbytheMayorandCityAttorneyandshallbeforwardedtotheCityCouncilPresidentwhoshalldocketthematterforCouncilconsideration.BylawamendmentsarenotvaliduntilapprovedbytheCity.
ARTICLEIIICommunityPlanningGroupOrganizations
Section1.TheNCPIshallconsistofsixteen(16)electedmembers;four(4)eachfromAlliedGardens,DelCerro,GrantvilleandSanCarlostorepresenttheNavajocommunities.Thesemembersoftheplanninggroupshallconstitutetheofficiallyrecognizedcommunity-planninggroupforthepurposeofthesebylawsandCouncilPolicy600-24.

Section2.CouncilPolicy600-24requiresthatelectedmembersofNCPIshall,totheextentpossible,berepresentativeofthevariousgeographicsectionsofthecommunityanddiversifiedcommunityinterests.OntheNCPI,allelectedseatsarefilledbyanyeligiblememberidentifiedbelowwithnofurtherrestrictiononthedistributionofseatsamonginterestsinthecommunity,otherthanfour(4)representativesfromeachofthefour(4)Navajocommunitiesaretobeelectedtorepresenttheirneighborhoods.Planninggroupmembersshallbeelectedbyandfromalleligiblemembersofthecommunity.Tobeaneligiblecommunitymember,anindividualmustbeatleast18yearsofage,andshallbeaffiliatedwiththecommunityasa:(1)propertyowner,whoisanindividualidentifiedasthesoleorpartialownerofrecord,ortheirdesignee,ofarealproperty(eitherdevelopedorundeveloped),withinthecommunityplanningarea,or(2)resident,whoisanindividualwhoseprimaryaddressofresidenceisanaddressinthecommunityplanningarea,or(3)localbusinessperson,whoisalocalbusinessornot-for-profitowner,operator,ordesigneeatanon-residentialrealpropertyaddressinthecommunityplanningarea.'
An
individualmaybecomeaneligiblememberofthecommunity,forpurposesofbeingelectedasaDirector,bydocumentedattendanceattwo(2)meetingsoftheNCPIpriortotheMarchgeneralelectionandsubmittinganapplicationtotheElectionCommitteetoverifyeligibility,eitherpriortotheMarchgeneralelectionoratthetime'ofvoting.Onceeligibilitytovoteisestablished,anindividualremainsaneligiblememberofthecommunity,untiladeterminationismadethattheindividualdoesnotmeettheplanninggroup'scriteriaandformalactionistakenbytheplanninggrouptodeclareotherwise.However,NCPIshallrequireproofofeligibilityduringelections.'Section3.MembersoftheNCPIshallbeelectedtoserveforfixedtermsofTwo(2)years,withexpirationdatesduringalternateyearstoprovidecontinuity.Nopersonmayserveontheplanninggroupformorethaneight(8)consecutiveyears.Theeight(8)yearlimitreferstototalmaximumconsecutiveyearsofservicetime,nottoindividualseatsheld.-3-
