Some scholars and pundits suggest that presumptive Republican candidate John McCain is no more eligible under the Constitution to be President of the United States than Paris Hilton or Arnold Schwarzenegger.

The California governor, and the faux starlet and recently self-proclaimed candidate, are each ineligible but for different reasons – he is an Austrian-born naturalized U.S. citizen, and she is only 27 rather than 35, the minimum required age.

You cannot legislate natural born citizen status, a prerequisite of becoming POTUS. The status is given "at birth". The only way to change the Constitution is via amendment. This lawyer is wrong. Tribe and Olson had agendas and that has already been proven. They were hired by McCain in S.R. 511. Why do you think the bill didn't pass prior to this resolution? Because it was unconstitutional. But they don't tell anyone about the failed attempts by Sen. Claire McCaskill, Hillary Clinton and Barack Obama in March, 2008. How convenient, huh?
