Objection to Child Support Claim #11-1

Greg and Sandra Howard, debtors in a Chapter 13 bankruptcy case, objected to a $99,850.86 priority child support claim filed by the Massachusetts Department of Revenue on behalf of Valerie Mitchell. However, according to a state court order, the actual child support arrearage owed to Mitchell is only $7,551.56. Furthermore, the Alabama Department of Human Resources filed a claim for $7,631.14 for the same domestic support obligation, which will be paid in full under the debtors' bankruptcy plan. Therefore, the debtors assert that the Massachusetts claim should be disallowed as the amount is no longer owed.

The Massachusetts Department of Revenue filed a priority child support arrearage claim on behalf of Valerie Mitchell in the amount of $99,850.86.

However, the Debtor is only $7,551.56 in arrears to the child support

claimant, Valerie Mitchell, according to the Alabama state court order dated

February 26, 2010. Attached hereto please find the state court order of February

Furthermore, the Alabama Department of Human Resources filed a

priority claim in the amount of $7,631.14 for the domestic support obligation arrearage claim of Valerie Mitchell. Attached hereto please find the proof of claim filed by Alabama Department of Human Resources.

Additionally, Alabama Department of Human Resources claim will be paid in full under the terms of the Debtors Plan.

amount is no longer owed to said creditor and is being collected through Alabama Department of Human Resources as referenced in its proof of claim and provided for in the Debtors Plan.
