Understanding Legal Obligations Explained

An obligation is a legal duty to give, do, or not do something. There are five sources of obligations: 1) law, 2) contracts, 3) quasi-contracts where the law implies a contract, 4) acts or omissions punished by law, and 5) quasi-delicts or unintentional wrongs. Obligations derived from law are not presumed or implied but must be expressly defined in the Civil Code or other special laws. Anything not foreseen will be regulated by the general provisions of the Civil Code.

Obligations
An
obligationarise
is a juridical necessity to give, to
from:
do or not to do. (n)
(1) Law;
(2) Contracts;
(3) Quasi-contracts;
(4) Acts or omissions punished by law; and
(5) Quasi-delicts. (1089a)
Article 1158.
Obligations derived from law are not presumed.
Only those expressly determined in this Code or
in special laws are demandable, and shall be
regulated by the precepts of the law which
establishes them; and as to what has not been
foreseen, by the provisions of this Book. (1090)
