Burke,nowa29yearoldmanwhoworksoncomputers,spokepublicly
forthefirsttimeabouthissistersdeathwithDr.Phillastweek.Hesaid
heknowsmanybelieveJonBenetwaskilledbyamemberofthefamily,
butsharplydeniesthatanyoneinthehouseplayedarole.
JonBentRamseywasfoundDec.26,1996,inthefamilysbasement
coveredbyasoftblanketwithherhandstiedlooselyoverherheadanda
garrotearoundherneck.Shehaddiedfromafracturedskull,thatSpitz
believeshappenedbeforetherestofthescenewasstaged.

Shewasprobablykilledsomewhereotherthanthebasement,headded.

Abizarre,ramblingransomnotethatsomeexpertsbelievewaswrittenby
motherPatsyRamseywasdiscoveredonastaircasebeforethechilds
bodywasfound.ForJonBentsreturn,itrequested$118,000incash
whichcloselymatchedtheChristmasbonusrecentlyreceivedbythe
wealthyfatherJohnRamsey.Adraftofthenotewasfoundinatrashcan
inthefamilysBoulder,Colo.,home.

They,Imeanthepolicedepartmentoverthere,werequiteawareofwho
thekillerislikelytobe,frominceptionalmost,Dr.Spitzsaid.Theycame
heretoDetroittotalktome,theyhadmecomedownthere,wetalked
abouttheincidentItwasprobablythemotherorthebrother,nowit
turnsout.
TheparentsgaveseveralpressconferencesbeforePatsyRamseys
deathfromcancerin2006,avidlydisavowinganyroleintheirdaughters
death.JohnRamsey,whomaintainedahomeinCharlevoix,Mich.,ran
unsuccessfullyfortheMichiganlegislatureandcontinuestospeakout
periodicallyagainstanyallegationofwrongdoinglobbedatthefamily.
Notably,byColoradolaw,noonewhowasundertheageof10atthe
timeofacrimecanbechargedwithhomicide,Spitzsaid.
SpitzaddsthatmoredetailswillemergeinthesecondpartoftheCBS
specialaboutBurkeRamsey,includingallegationshehadpreviously
smearedafamilybathroomandhisbeautyqueensistersbedroomwith
feces.
Thebrotherhasamentalproblem,Dr.Spitzsays,adding,Thebrother
isnotexactlythinkingstraight,thebehaviorisofsomebodywhosgot
aproblem.WhenIthinkofputtingfecesinthesistersbedHewas
doingthat.

CauseofDeath
TherehavebeenquestionsaboutwhetherJonBenetwaskilledbythe
blowtotheheadorthecordaroundherneck.Somebelievesmallmarks
abovethecordonherneckarenailmarks,signifyingthatJonBenetwas
clawingatherownneckwhileitwasbeingdrawntight.
Dr.Spitzdisagreeswiththatallegation,believingshewaskilledfirstby
thefracturedskullbeforethegarrotewasplacedaroundherneck.
Andtheparentsembellisheditbychangingthescene,hetoldCBS
Detroit.Idonotbelievethattheychangedthesceneinsuchawaythat
theyputclawmarksontheneck.Thereweresomescratchmarksonthe
neck,thatistrue,buttheflashinglightonthebackoftheheadwasafatal
blow.Ifitwasntimmediately,itwasfatalfromthebrainswellingthattook
afewseconds.
Headdedthemarksonherneckcouldhavecomefromthenecklaceshe
waswearing,orfromsomeoneelsescratchingatherneck.

Healsodisagreeswithallegationsofsexualabuse.
Idontthinkshewassexuallyabusedinthepast,butwhatIdoknowis
therewasasliverofwoodinhervaginaandthesliverofwoodcomes,
mostlikely,fromthehandleofabrush,thepaintbrushthatthemother
usedforpainting,thatwasbrokenoffandusedasaonesidedhandleon
thegarrote,hesaid.

NotethattheseareSpitzsopinionsbasedonareviewoftherecordsand
havenotbeenprovenorevenallegedinacourtoflaw.Agrandjury
indictedtheparentsonchargesrelatedtoJonBenetsdeath,butthe
prosecutordecidednottotakethecasetocourt.

Theywantedtoprotecttheson
Forhispart,Spitzhasconsultedandservedasanexpertonsomeofthe
biggestcrimecasesinAmericanhistory.Heconductedanofficialreview
oftheWarrenCommissiondecisiononthedeathofJohnF.Kennedy,
whereheagreedwiththelonegunmanfindingbutsaidtheautopsywas
botched.HealsotestifiedintheO.J.Simpsonciviltrial,andinthecase
ofMaryJoKopechne,whodiedinanaccidentinTedKennedyscar.
Inthiscase,Boulderpolicecalledhimimmediatelytohelpwiththe
investigation.HewasnearbyonanothercaseinDenver,Colo.,butthe
RamseysrefusedintheimmediateaftermathofJonBenetsdeathtolet
himsitinontheautopsyorvisitthehouseasacrimescene,hesaid.
Isaidtothem,onthewayfromDenvertoBoulder,IsaidImreallylike
toseepersonallywhatthedistances(arefrom)thebasementwherethe
bodywas,theentrancelobbyandsoon.Andsowegothere.Iknewthe
housefromthenewspapers,Iknewwhatthehouselookedlike.The
officersaystomeImsorrytotellyouthefamilydoesntwantyoutogoin
there.'
Headdedthatnooneofanystandingwasallowedtoviewtheautopsy.
KeyroomsinthefamilyshomewasreconstructedfortheCBSspecial,
whichhadafinaleat9p.m.Tuesday,airinglocallyonCBS62.Andthat
reconstructiononlycementedhisopinionofwhathappenedthatnightin
thathome.
Therestoftheexpertsontheseries,includingaScotlandYarddetective,
aDNAexpert,andotherspecialistsonbehaviorandprofiling,allagreed
BurkeRamseywasthemostlikelysuspect.
Theywantedtoprotecttheson,Dr.Spitzsaid,adding,Yes,thatsmy
personalopinion,anditsbasedonalotofthingsImawareofthathave
notreallycomeout(before)insomanywords.
