AN ORDINANCE PRESCRIBING THE CENTRALIZED AND UNIFORM ISSUANCE
OF BARANGAY CLEARANCE, FEES, PENALTIES, TAX AND PERMITS AND THE
COLLECTION CORRESPONDING TO THE MUNICIPAL REVENUE CODE OF THE
MUNICIPAL GOVERNMENT OF DUPAX DEL SUR, NUEVA VIZCAYA

WHEREAS, there is a need to streamline/simplify the process of business registration in this
Municipality to promote a friendlier atmosphere for taxpayers and investors and to provide a
more efficient and effective revenue collection;
WHEREAS, RA 8424 declared the policy of the State to promote sustainable economic growth
through the rationalization of the Philippine Internal Revenue Tax System, including tax
administration to provide as much as possible, an equitable relief to a greater number of
taxpayers in order to improve levels of disposable income and increase economic activity , and to
create a robust environment for business to enable firms to compete better in the regional as
well as the global market, at the same time that the State ensure that Government is able to
provide for the needs of those under its jurisdiction and care.
WHEREAS, it has been a declared policy of the Municipal Government of Dupax del Sur, Nueva
Vizcaya, to make regulations simple and transparent, streamline transactions and eliminate red
tape to facilitate business processing and licensing;
WHEREAS, Republic Act No. 11032, otherwise known as "An Act Promoting Ease of Doing
Business and Efficient Delivery of Government Services", or the EODB Act of 2018, was signed
into law to make the process of putting up and running a business in the Philippines easier and
more efficient;
WHEREAS, Section 11 (f) of RA No. 11032 provides that "Barangay clearances and permits
related to doing business shall be applied, issued and collected at the City/Municipality in
accordance with the prescribed processing time of said Act. Provided, that the share in the
collections shall be remitted to the respective barangays.
WHEREAS, Memorandum Circular No. 2019-177. Under Pillar 1, Enhancing the Social Fabric, the
PDP 2017-2022 includes strategies to reduce corruption, achieve seamless service delivery,
enhance administrative governance, strengthen the civil service, and fully engage and empower
citizens. The Circular shall cover all Municipal Mayors, Punong Barangays, Local Official, and DILG.
WHEREAS, DILG-DTI_DICT Joint Memorandum Circular No. 2016-01, “Revised Standards in
Processing Business permits and Licenses in all Cities and Municipalities.

WHEREAS, DILG Memorandum Circular 6.3, the role and responsibility of the Local officials to
enact ordinances and implement requisite orders and directives relative to the new standards
and other complementary reforms for business and issuance of locational clearance for Building
Permits.
WHEREAS, the component barangays of this Municipality enacted their respective barangay
ordinances to authorize the Municipal government of Dupax del Sur to issue barangay clearance
and collect corresponding barangay clearance fee in the application for any business-related
transactions subject to the remittance of the aforesaid fees to the barangay and the conditions
hereunder, and for other purposes.
SECTION 1. COVERAGE.
This Ordinance shall apply only to the issuance of Barangay and Municipal
Clearance/Certification, Permits, Fees, Bills/ Payments and Taxes.
Section 2. DEFINITION OF TERMS.
The words and phrases used in this Ordinance are hereby defined as follows:
Applicant- shall refer to any person, firm, partnership, corporation, head of government
or private institution, or organization of any character applying for the issuance of
permits and clearances.
Barangay Clearance - refers to any and all documents issued by the barangays with or
without corresponding fees as defined in their respective ordinances relative to or in
relation to the application for and issuance of business permits and locational/zoning
clearances by the Municipal government or any other permit as may be required. (IRR of
RA. No. 11032);
Barangay Clearance Fee — is an amount imposed by the barangay, through an
ordinance, and collected by the Municipal government in relation to the issuance of
business permits and locational clearance by the Municipal Government;
Business Permit — is a document that must be secured from the Municipal
Government, through the Municipal Business Permits and Licensing Office (BPLO), for a
business to legally operate within the locality. (IRR of RA No. 11032)
Barangay Ordinance shall refer to a piece of legislation enacted by the Sangguniang
Barangay and reviewed by the Sangguniang Bayan.
Building Permit refers to a document issued by the Building Official to an
owner/applicant to proceed with the construction, installation, addition, alteration,
renovation, conversion, repair, moving, demolition, or other work activity of a specific
project/building/structure or portions thereof after accompanying principal plans,
specifications and other substantially conforming with the National Building Code of the
Philippines.
Business One-Stop Shop refers to a single common site or location, or a single online
website or portal designated for the Business Permit and Licensing System of a local
Government Unit to receive and process applications, receive payments and issue
approved licenses, clearance, permits or authorizations.
Locational Clearance • is a clearance issued by the Zoning Administrator/Zoning Officer
to a project that is allowed under the provisions of an ordinance of this Municipality

when such locational clearance is secured as a requirement in the application for and
the issuance of a Building Permit;
Mayor’s Permit is often also referred to business permit. The Business Permit is a key
compliance document that entitles and enables a business to legally operate and do
business in the area in which the business is registered.
Solicitation Permit refers to the authority issued by the Department of Social Welfare
and Development to a particular individual or judicial entity to solicit donations or
voluntary contributions for charitable or public welfare purposes.
Fundraising Permit refers to the act of producing money for a particular purpose,
especially for a charity. (A-Thon Events, Competitions, Fashion shows, Auctions, Art
Exhibits, Gala, Concert)
Water bill payment refers to a regular charge that is made to people for the use of their
local water supply.
Municipal Parks and Recreation Fee/Payment refer to the resources and services
provided for the purpose of leisure, entertainment and recreational pursuits. Resources
maybe public spaces and facilities like parks, nature preserves, open space areas,
greenways, trails, and built structures for sports, recreation or arts programs.
Real property Tax is an annual tax on real property. It is usually but not always, a local
tax. It is most commonly founded on the concept of market value. The tax base may be
the land only, the land and buildings or various permutations of these factors.
SECTION 3. BARANGAY CLEARANCE, FEES AND OTHER PAYMENTS
a. The barangay clearance contemplated in this Ordinance shall be applied in and
secured from the Municipal Business Permits and Licensing Office (BPLO).
Barangay Clearance Fee- P 100 , (this varies on each barangay, some don’t
charge a fee.)
b. Community Tax Certificate or CEDULA, this varies on Income.
c. Barangay Residence Certification- P 100
d. Business Clearance P 100
e. Certificate of Low Income P 100
f. Barangay Construction Clearance P 100
g. Travel Certification for Livestock P 100
h. Cutting Certification P 100
i. Water Bills (this varies on the consumption)
SECTION 4. AUTHORITY TO COLLECT BARANGAY CLEARANCE FEES OF BUSINESS-
RELATED TRANSACTIONS
a. The Municipal Government of Dupax del Sur shall henceforth collect Barangay
Clearance Fee, pursuant to and as prescribed in the respective barangay
ordinances and/or barangay revenue codes of the barangays concerned, subject
to the remittance of the total amount thus collected to the barangay concerned.
b. Rate of Barangay Clearance Fee to Be Collected The rate of the Barangay
Clearance Fee to be collected by the Municipal government for the issuance of
the corresponding barangay clearance shall be pursuant to and as prescribed in
and computed in accordance with the respective barangay ordinances and/or
barangay revenue codes or ordinances of the barangays concerned.

c. Guidelines in the Integration of The Issuance of Barangay Clearance In The
Permitting Process Of The Municipality and the other Fees, Payment to be
Collected
Collect Barangay Clearance fees as stated in the Barangay Ordinance
Issue Official receipt to the application corresponding to the total amount
indicated in the Order of Payment including Barangay Clearance Fees.
Release Barangay Clearance to the applicants in the municipal Business
Permit and Licensing Office of the Building Official.
Remit the collected Barangay Clearance fees to the concerned Barangay not
later than seven working days of the ensuing month with the list of the
issued Business Permit and Building permit.
The barangay clearance shall be issued by the Municipal Business Permits
and Licensing Office (BPLO), and shall bear the digital and electronic
signature of the Punong Barangay concerned, duly authenticated and
countersigned by the head of the Municipal Business Permits and Licensing
Office (BPLO)
The Municipal government shall remit the Barangay Clearance Fees
collected to the barangays concerned within the first seven (7) working days
of the ensuing month together with the list of the issued business permits
and building permits pertaining to the barangays once

SECTION 4. RULES AND REGULATIONS
1. The BPLO shall upon receipt of any application for permit or the Municipal Engineer
in case of application for building permit, notify the Barangay of any application for
business permits and for building permit for the approval or disapproval of issuing
barangay clearance. If no action has been taken by the barangay within 3 days upon
notice on the application, the same shall be deemed approved.
2. Upon receipt of the Notice for the application of business, the barangay concerned
shall immediately visit the location and conduct ocular checking to verify the status
of the location subject of the application to determine compliance with applicable
laws and other regulatory bodies. Each barangay shall be responsible to monitor and
ensure in writing the BPLO of the Municipal Engineer copy furnished the Municipal
Mayor for immediate action in cases of any illegal acts committed by business/
building owners/ applicants.
3. The Joint Inspection Team by implementing business-related regulations shall
conduct an annual inspection or when necessary of all business enterprises to
determine compliance with applicable laws, rules and regulations.
4. The BPLO shall conduct a regular inventory of all business approved entities and shall
have a list thereof posted in the Municipal Bulletin Board for transparency.

5. Delinquent and non-compliant business establishment shall immediately be acted
upon by the JIT and BPLO for appropriate action in accordance with existing Laws,
rules and regulations.
SECTION 5. SEPARABILITY CLAUSE
If for any reason, a part of this Ordinance is declared unconstitutional, ultra vires,
inoperative, or otherwise illegal or invalid, other parts or provisions hereof that are not
affected thereby shall remain valid and in full force and effect.
SECTION 6. REPEALING CLAUSE.
All previous ordinances, executive orders, rules, and regulations, which are inconsistent
with the provisions of this Ordinance, are hereby deemed amended, modified, or
repealed accordingly.
SECTION 7. EFFECTIVITY CLAUSE.
This Ordinance shall take effect immediately upon its approval.
