5 Nature of misconduct/ incidence
You were found sleeping behind the compressor while on duty. There was a
problem in the ¾” Flange Line-2 0202-07(2) & as such the hopper conveyor
operator reported to Shift Officer, Mr.Rahul Nemade that despite his request you
have not attended the problem. Shift Officer, Mr.Rahul Nemade went to you and got
tried to wake up you and asked you to attend the aforesaid problem however you
did not listen to him and continued to sleep while on duty.

It is reported that on 12/03/2010 at about 2.30 a.m. the aforesaid line once again
faced trimming burr problem. You were again asked by shift officer, Mr. ___ to
attend the problem but you once again refused to attend the same. You were
required to attend the problem immediately as you are the line tender, responsible
for smooth running of the production line. When Mr.____ noticed that you continue
to sleep as a stated above at around 3.30 a.m. and he questioned you as to why the
problem in the machine has not been rectified. You instead of attending the
problem argued with him in arrogant manner and refused to do any work and carry
out the tool setting needed in the production line.
7 Effect of this misconduct on Company/ Discipline
Due to neglect and refusal to carry out the assigned work and due to your refusal to
follow the lawful and reasonable order of your superior. The aforesaid machine
finally could not be run after break i.e. 3.30 a.m. in the night shift of 11/03/2010.
Due to the non running of machine after 3.30 a.m. in the night shift in question
Company had suffered production loss which is solely attributable to you if proved.
8 Reference model standing order
On the day in questioned you had not performed any work at all & continued to
sleep while on duty through out & did not carry out any work despite instructions
and as such have not earned the wages for that day and as such not entitled to any
wages on the basis of “no work no wages” formula. The aforesaid act of yours is
serious employment misconduct as provided under the Model Standing Order &
correspondence rules made there under which reads as follows:
Model standing orders relevant clauses :

24(a) wilful insubordination or disobedience, whether or not in combination with


another, of any lawful and reasonable order of a superior;

24(k) drunkenness, riotous, disorderly or indecent behaviour on the premises of the


establishment;

24(l) commission of any act subversive of discipline or good behaviour on the


premises of the establishment;

24(m) habitual neglect of work, or gross or habitual negligence;

The above act, as alleged to have been committed by you, amount to misconduct
which, if proved would warrant serious disciplinary action against you.

Accordingly, you are hereby required to show cause within 2 days, days of the
receipt hereof as to why you should not be dismissed or otherwise punished.

Should you fail to submit your explanation as required, it will be presumed that
you admit the charges and have no explanation to offer and the matter will be
disposed of without any further reference to you.

Since the charges leveled against you are of grave and serious nature, you are
hereby suspended pending further proceedings and final order in the matter.

The receipt of this letter should be acknowledged.
