PENALTIES FOR THE VIOLATION THEREOF, AND FOR OTHER PURPOSES

granted, those necessarily implied therefrom, as well as powers necessary,

WHEREAS, Section 2 (d) of the Republic Act 9003 otherwise known as


the “Ecological Solid Waste Management Act of 2000” declares that it is the

WHEREAS, likewise, Section 10 of the same Act provides that the local
government units (LGUs) shall be primarily responsible for the
implementation and enforcement of the provisions of this Act within their
respective jurisdictions;

evaluate alternative roles for public and private sectors on providing
collection services, type of collection system or combination of systems, that
best meet their needs, provided, that segregation of wastes shall primarily

WHEREAS, to set guidelines for solid waste management in the
municipality to ensure the protection of public health and environment of all

Section I TITLE. This Ordinance shall be otherwise known as “Solid Waste


Segregation Ordinance”

SB Member Section 2 SCOPE AND COVERAGE. The Thirteen (13) barangays of the
Municipality shall be covered by the implementation of this ordinance.

CARLITO M. DE CASTRO Section 3 DECLARATION OF POLICY AND PURPOSE. This Ordinance is


SB Member enacted in order to effectively carry out the Solid Waste Management Plan of
the Municipality.

ROMELL G. HERNANDEZ Section 4 DEFINITION OF WORDS AND PHRASES. When found in this
SB Member Ordinance, the following words and phrases are explained thus:

Buy-back center - shall refer to a recycling center that purchases

suitable beneficial use or for other purposes, including, but not limited to,
newspaper, ferrous scrap metal, non-ferrous scrap metal, used oil, corrugated

Recycling - shall refer to the treating of used or waste materials

purposes, and includes any process by which solid waste materials are
transformed into new products in such a manner that the original products
may lose their identity, and which may be used as raw materials for the

control over significant potential environmental impacts arising from the

Segregation - shall refer to sorting and segregation of different
materials found in solid waste in order to promote recycling and re-use of

practice of separating, at the point of origin, different materials found in solid

Solid waste - shall refer to all discarded household, commercial

Unless specifically noted otherwise, the term “solid waste” as used in
the Act shall not include:

a. Waste identified or listed as hazardous waste of a solid, liquid,


contained gaseous or semisolid form which may cause or contribute to an
increase in mortality or in serious or incapacitating reversible illness, or

b. Infectious waste from hospitals such as equipment, instruments,
utensils and fomites of a disposable nature from patients who are suspected

such as pathological specimens (i.e., all tissues, specimens of blood elements,
excreta, and secretions obtained from patients or laboratory animals), and

SB Member surgical operating room pathologic specimens and disposable fomites
attendant thereto, and similar disposable materials from outpatient areas and
emergency rooms; and

and debris.

Section 5 MANDATORY WASTE SEGREGATION AT SOURCE

5.a. Every household, establishment and institution in this municipality
is strictly required to segregate its daily waste. Garbage must be placed in

2. Non-biodegradable or recyclable (Hindi nabubulok)

5.b. Receptacles or garbage containers either in the form of sacks or

5.c. Households/institutions/establishments are strongly encouraged to
practice composting, re-using and recycling of waste, if possible, right within

5.d. Open dumping and open burning in barangay or household level is
strictly prohibited.

6.a. No household, establishment or institution in this municipality shall

6.b. The municipal government’s garbage trucks assigned in the area of

6.c. The LGU garbage trucks shall be so designed as to have separate
container for the different kinds of garbage collected.

6.e. Backyard composting is hereby strongly encouraged, since many


households have spaces within which backyard composting may be done.

Section 7 ROLE OF JUNK SHOP OPERATORS

7.a. The Municipal Government shall coordinate with junkshop


CRISPIN E. CABRAL operators or owners of buy back centers to which recyclable waste materials,

gathered from the collected waste may be bought and sold. These include
empty bottles, steel, newspapers, plastic containers, soft drink cans, etc.

NILO E. ROLDAN 7.b. Barangays shall have the option to establish ties with junk shop
SB Member operators in their barangays who shall accept recyclable wastes from
households in the barangay. Only refuse (patapon) will then be collected by
the LGU garbage truck.

SB Member Section 8 ROLE OF BARANGAY SOLID WASTE MANAGEMENT
COMMITTEE. As provided under Section 7 (IRR) of RA 9003, The BSWC which
shall be duly organized by every barangay thru an ordinance, shall have the

a.) Formulate solid waste management plan consistent with this
municipal ordinance/or municipal plan:

compostable and reusable wastes;

c.) Establish materials recovery facility; if necessary

d.) Allocate barangay funds, or look for sources of funds

e.) Organize core (sitio) coordinators; and

f.) Submit quarterly report to municipality.

In addition, the BSWC shall undergo re-echo training on Solid Waste

Management practices to be conducted by the Solid Waste Management Unit

and Local Trainers Pool of the Municipal Government.

Section 9 ROLE OF MUNICIPAL SOLID WASTE MANAGEMENT BOARD

Section 4 (IRR) of RA 9003:

integrate the various solid waste management plans and strategies of the

9.b. Adopt measures to promote and ensure the viability and effective

9.c. Monitor the implementation of the Municipal Solid Waste
Management Plan or ordinance through its various political subdivisions and

9.d. Adopt specific revenue-generating measure to promote the
viability of its Solid Waste Management Plan (e.g. sale of compost and

9.e. Convene regular meetings of purposes of planning and

implementation of the Municipal Solid Waste Management Plan/ordinance;

component barangays in consonance with subsection (f) of Section 17 of the
Local Government Code;

9.i. Recommend measures and safeguards against pollution and for the
preservation of the natural ecosystem; and

9.j. Coordinate the efforts of its component barangays in the

9.k. Propose the appropriation of funds for the sustainability of this


project such as for procurement of composting equipment, improvement of

Section 10 MATERIAL RECOVERY FACILITY (MRF)

WILLIAM C. EVANGELISTA Material Recovery Facility (MRF) shall be established in Barangay


SB Member Poblacion within the Bansud Public Market so that garbage will be sorted and
segregated as recyclables and compostable. The municipal government shall
introduce improvement of the facility to include provisions for receiving,
ALEX M. MEDRANO waste segregation, hammer-milling, composting drums, storage for both
ABC President organic fertilizers produced and recyclables, toilet, and office space. Only
reuse or residuals will then be dumped at the nearby Rosacara Sanitary
Landfill.

SKMF President Barangays shall have the option to establish their own MRF even a
modest version.

ATTY. LARRY M. QUINTON Section 11 MASSIVE INFORMATION AND EDUCATION CAMPAIGN (IEC)

The Municipal Government shall undertake massive information
campaign to be designed by the Municipal SWMC, the MSW Unit and LTP. The

recyclables & compost, etc)

2. Display of posters and streamers, placing of appropriate signs

3. Launching of project thru motorcade or simple program

5. Incorporation of SWM information in regular meetings of the

6. As a matter of setting example, solid waste segregation should be
practiced within the Municipal Hall Offices.

SB Member Section 12 PILOT BARANGAYS

Two (2) barangays in the municipality shall serve as project pilot areas

12.1 Initial implementation of the project shall cover the

Section 13 PROHIBITED ACTS

Upon approval of this ordinance, the following acts shall be strictly

Section 15 IMPLEMENTING RULES AND REGULATIONS

The Municipal Solid Waste Management Board (MSWMB) shall

Section 17 SEPARABILITY CLAUSE. If, for any reason or reasons, any
part of the provision or provisions of this Code shall be held unconstitutional

Section 18 EFFECTIVITY CLAUSE. This Ordinance shall take effect
