VISA changes that could

Immigration was one of the most hotly

debated issues during the 2016 U.S. pres-
idential election, and it is an important
issue for LL.M. students and graduates.
Immigration is a highly complex issue
further complicated by constantly moving
targets. Please use this article as a starting
point to inform yourself. Your immigra-
tion status is not to be taken lightly, and
I strongly encourage everyone to discuss
their situation with a qualified attorney.
Let’s take a look at willful misrepresen-
tations in visa interviews and the effect
H-1B changes have on LL.M. graduates.

Willful Misrepresentation
In a cable to American embassies around
the world, former Secretary of State Rex
W. Tillerson wrote that visitors who
require a visa before entering the U.S.
must follow through on their stated plans
for at least three months. If during that
period they do something they failed to
mention in an interview with a consular
official, such as go to school or get a job,
it will be considered to be “willful misrep-
resentation” – in other words, an inten-
tional lie. This will make it difficult, if
not impossible, for the visitors to renew a
visa, get a new one or change their status.
H-1B Changes
And it would make those visitors still in

Where to get a jump on
your LL.M. degree

Studying for an LL.M. degree in the U.S.

can be intimidating, especially for attor-

little exposure to the American legal sys-

Fortunately, a number of U.S. law
schools provide immersive summer pro-

them prepare for their American legal
studies.
Starting in the Northeast and moving
south and west, here are 15 law schools
that offer summer programs for incoming
international LL.M. students. Most are
open to students who will be attending
any LL.M. program in the U.S.

been admitted to practice in their home country
and be in good standing with that country’s bar or

must have been engaged in the practice of law for
five of the past eight years.
