Please note:
By appointing FedEx to clear your goods or package through customs, FedEx as a licensed clearing agent in terms of section 64(B)(2) of the
Customs and Excise Act 91 or 1964, is liable for the fulfilment of the obligations imposed in terms of this Act. Accordingly, you are
required to declare to FedEx your status as an Importer and indemnify FedEx for the validity of your declaration.
Declaration by the Customer:
If you are a registered Exporter/ Importer, please state your Customs Code Number failing which,
By signing below, you, the Customer warrant to FedEx that you, the Customer, are not a registered Exporter/ Importer and have not
brought or caused any wares, articles, merchandise, animals, currency, material or objects of whatsoever nature (“goods”) or any container,
wrapping or outer cover and its contents or bundle or single piece of unpacked goods (“package”) to be brought into or sent from the
Republic of South Africa, the Republic of Botswana, the Republic of Namibia, the Kingdom of Lesotho or the Kingdom of Swaziland more
than three times in the current calendar year.
It is important to note that any goods that transfer across the borders of the country are considered to be an import/export, and that an
importers/exporters code are required when goods are of commercial nature, exceeding the value of R50 000 and/or when such a transaction
has taken place more than three times a calendar year.
Application forms to apply for an importers/Exporter code can be obtained from SARS on www.sars.gov.za.
This application together with a utility bill, bank statement, proof of address, identity document / passport and company registration
documentation where applicable, needs to be presented to the nearest SARS Customs office.
In completing this indemnity, you are authorising FedEx to use the general Importers code, 70707070. This could result in you the
importer/exporter being liable for the payment of penalties of a minimum of R 3000 and minimum of 14 working days delay, due to a
customs physical examination. Part of the deposit could be refundable, yet it is valid for only 30 days and application to refund must be
made directly to Customs with a copy to FedEx.
Indemnity:
In the event of the above declaration being incorrect in any respect, you, the Customer agree to be liable for and to refund to FedEx within
10 days of receipt of written demand, any penalty, cost, damages or expense or other amount incurred by or imposed on FedEx as a result of
the incorrect declaration.
