TERMS AND CONDITIONS OF CARRIAGE
1. By tendering articles and/or documents for shipment (“Shipment”) under this Consignment Note (“CN”) to DHL Supply Chain India Pvt. Ltd. (“DHL”), which term shall include its authorized agents and affiliated companies, their officers, directors and employees, the shipper (“Shipper”) on its behalf and on behalf of anyone else with an interest in the Shipment, agrees to the
Terms and Conditions stated herein. No agent, employee or servant of DHL or of the Shipper shall alter or modify these Terms and Conditions. The liability of DHL and its employees and agents is strictly limited to the amount stated in these
Terms and Conditions.
2. This CN is non-negotiable and the Shipper acknowledges that it has been prepared by the Shipper or by DHL on behalf of the Shipper. DHL shall issue the CN at “OWNER’S RISK” only as the Shipper / Consignee confirms having comprehensive Open Transit Insurance Policy towards accident, theft, shortages, damages, leakages for goods being carried under this Consignment
Note.
3. The Consignment would be deemed to be properly and validly delivered to the Consignee or its authorized Agent if proper acknowledgment has been obtained on this Consignment Note or any other related document.
4. The Shipper shall be primarily liable to pay the transport charges and all other incidental charges to DHL.
5. DHL shall not be responsible if the goods are detained, seized or confiscated by Government or Statutory Authority for any reason whatsoever.
6. DHL shall have a general charge / lien over the said goods on account of freight, detention, demurrage, incidental expenses etc. which are already payable or may become payable by the Shipper/Consignee .
7. DHL shall have the right to dispose-off perishables lying undelivered after 48 hours of arrival, without any notice. DHL shall have the right to dispose-off other goods after thirty days of arrival, after giving to the Shipper and the Consignee at least fifteen days’ notice of such disposal of goods.
8. The Shipper acknowledges that DHL is not a common carrier. DHL reserves the right to refuse the carriage of any shipment for any persons or the carriage of any class of articles, at its sole discretion, without assigning any reason whatsoever.
9. DHL shall preserve CN’s and other records in electronic form at least for a period of three years. Whenever fraud is detected or action is initiated, then the record has to be preserved in electronic form till the matter is settled.
10. The Shipper is responsible for all consequences of any incorrect or false declaration.
11. DHL shall only be liable for any claim relating to loss, damage, non-delivery, delay or mis-delivery of, or to the goods where caused by DHL’s negligence or willful default. DHL does not have special knowledge of the goods and DHL shall in no event be held liable for any defects, technical failure or malfunction of the Products howsoever caused. DHL shall not be liable for any
loss, damage, mis-delivery or non-delivery due to acts of God, force majeure, or any cause reasonably beyond the control of DHL DHL’s liability hereunder for loss or damage to goods shall not exceed shall not exceed INR 5,000
(Rupees Five Thousand only) or declared value, whichever is lesser against this consignment note. DHL’s liability under this CN in any other case or circumstance shall not exceed INR 5,000/- (Rupees Five Thousand only). .
12. DHL would be obliged to issue necessary Certificate of Facts / Observation Note to the insured to take up their claims with their underwriters. It is clearly understood that the Shipper / Consignee have voluntarily waived and ensure that their insurers waive their right against DHL against any claims that may arise due to subrogation.
12.1. The Shipper/ consignor or consignee warrants that it shall declare: a) Its GST registration number as per the provisions of GST Act. b) GST Registration number of the Shipper/ consignor or consignee. c) Details of E-Way bill, as mentioned in the Para 12.4 and/or d) Any other details as may be required as per the statutory laws.
12.2. If the shipments is detained or any notice or demand is issued for non-provision of information as mandated in the clause 12.1, the shipper or consignee as the case may be, will be solely and exclusively responsible for all the consequences of such detention and the Shipper and/or consignee shall
indemnify DHL against all claims, demands, proceedings, fines, penalties, damage, costs and expenses suffered by DHL or by any other person to whom DHL is liable in respect hereof.
12.3. In any matters relating to GST or any other tax relating to goods or consignments, the responsibility rests solely with the shipper or consignee as the case may be, and DHL shall in no case be liable or accountable for the same.
12.4. Shipper and/or consignee has to create E-Way bill on GSTN portal and fulfill their obligation as per provisions of GST law. DHL will update details required to be updated by transporter as per the provisions of GST law. DHL will not be responsible for the error/ omission in E-Way Bill which is the responsibility of shipper and/ or consignee.
13. DHL shall in no case be liable for any loss of profit, loss of sales, loss of market, loss of goodwill or reputation, third party claims, incidental or special damages or indirect or consequential loss of any kind; and all of the exclusions and limitations contained in this document shall apply to any claim whether in contract, tort (including negligence), equity, restitution or otherwise.
14. The following articles will not be accepted for carriage:
Hazardous & Dangerous Goods as per the list available with the booking offices of DHL;
Chemicals and drugs (provided however, such shipments may be accepted if they do not fall under the category of Hazardous and Dangerous goods and the Shipper provides a declaration in writing to the effect that the contents are harmless and non-inflammable);
Precious Cargo in the form of gold, bullion, silver, jewelry, gems, precious stones and other precious metals, currency notes, traveler’s cheques, antiques, stamps;
Perishables, live-stock, human remains, firearms, drugs, lewd, obscene or pornographic materials;
Items the carriage of which are prohibited by any law, statute or regulation;
Any items as may from time to time be notified by DHL to be restricted and/or banned and/or hazardous and/or dangerous and/or prohibited for carriage.
15. UNDELIVERED OR UNCLAIMED CONSIGNMENTS
15.1 A Shipment shall be considered to be undeliverable if:
a) the consignee's address is incomplete, illegible, incorrect or cannot be located;
b) the consignee fails or refuses to accept delivery or sign or pay for delivery within a period of 10 (Ten) days from the date the attempt to deliver the Shipment is made;
c) it would likely cause damage or delay to other shipments;
d) it contains prohibited items;
e) its contents or packaging are damaged to the extent that re-wrapping is not possible;
f) it is detained or otherwise unable to clear local or State boundaries..
15.2 In case a Shipment is undeliverable or unclaimed, DHL shall notify the Shipper in writing requiring it to remove the Shipment within a period of 15 (Fifteen) days from the date of receipt of the notice. In the event of failure to comply with the requisitions of such notice, DHL shall have the right, but not the obligation, to sell such consignment without any further notice to the
Shipper or the consignee, as the case may be without incurring any liability whatsoever to the Shipper/consignee or any other person. Upon accounting to the Shipper for any balance remaining after payment of any sums due to DHL and any costs of sale, DHL shall be discharged of any liability whatsoever in respect of the Shipment. The Shipper shall indemnify DHL against all
claims, demands, proceedings, fines, penalties, damage, costs and expenses suffered by DHL or by any other person to whom DHL is liable in respect hereof.
16. No Suit or other Legal proceedings shall be instituted against DHL for any loss of, or damage to, the consignment, unless notice in writing of the loss or damage to the consignment has been served on DHL before the institution of the suit or other legal proceeding and within one hundred and eighty days from the date of booking of the consignment by the Shipper.
17. Only the competent courts of Mumbai shall have the exclusive jurisdiction to try and disputes arising out of this CN.

indemnify DHL against all claims, demands, proceedings, fines, penalties, damage, costs and expenses suffered by DHL or by any other person to whom DHL is liable in respect hereof.
12.3. In any matters relating to GST or any other tax relating to goods or consignments, the responsibility rests solely with the shipper or consignee as the case may be, and DHL shall in no case be liable or accountable for the same.
12.4. Shipper and/or consignee has to create E-Way bill on GSTN portal and fulfill their obligation as per provisions of GST law. DHL will update details required to be updated by transporter as per the provisions of GST law. DHL will not be responsible for the error/ omission in E-Way Bill which is the responsibility of shipper and/ or consignee.
13. DHL shall in no case be liable for any loss of profit, loss of sales, loss of market, loss of goodwill or reputation, third party claims, incidental or special damages or indirect or consequential loss of any kind; and all of the exclusions and limitations contained in this document shall apply to any claim whether in contract, tort (including negligence), equity, restitution or otherwise.
14. The following articles will not be accepted for carriage:
Hazardous & Dangerous Goods as per the list available with the booking offices of DHL;
Chemicals and drugs (provided however, such shipments may be accepted if they do not fall under the category of Hazardous and Dangerous goods and the Shipper provides a declaration in writing to the effect that the contents are harmless and non-inflammable);
Precious Cargo in the form of gold, bullion, silver, jewelry, gems, precious stones and other precious metals, currency notes, traveler’s cheques, antiques, stamps;
Perishables, live-stock, human remains, firearms, drugs, lewd, obscene or pornographic materials;
Items the carriage of which are prohibited by any law, statute or regulation;
Any items as may from time to time be notified by DHL to be restricted and/or banned and/or hazardous and/or dangerous and/or prohibited for carriage.
15. UNDELIVERED OR UNCLAIMED CONSIGNMENTS
15.1 A Shipment shall be considered to be undeliverable if:
a) the consignee's address is incomplete, illegible, incorrect or cannot be located;
b) the consignee fails or refuses to accept delivery or sign or pay for delivery within a period of 10 (Ten) days from the date the attempt to deliver the Shipment is made;
c) it would likely cause damage or delay to other shipments;
d) it contains prohibited items;
e) its contents or packaging are damaged to the extent that re-wrapping is not possible;
f) it is detained or otherwise unable to clear local or State boundaries..
15.2 In case a Shipment is undeliverable or unclaimed, DHL shall notify the Shipper in writing requiring it to remove the Shipment within a period of 15 (Fifteen) days from the date of receipt of the notice. In the event of failure to comply with the requisitions of such notice, DHL shall have the right, but not the obligation, to sell such consignment without any further notice to the
Shipper or the consignee, as the case may be without incurring any liability whatsoever to the Shipper/consignee or any other person. Upon accounting to the Shipper for any balance remaining after payment of any sums due to DHL and any costs of sale, DHL shall be discharged of any liability whatsoever in respect of the Shipment. The Shipper shall indemnify DHL against all
claims, demands, proceedings, fines, penalties, damage, costs and expenses suffered by DHL or by any other person to whom DHL is liable in respect hereof.
16. No Suit or other Legal proceedings shall be instituted against DHL for any loss of, or damage to, the consignment, unless notice in writing of the loss or damage to the consignment has been served on DHL before the institution of the suit or other legal proceeding and within one hundred and eighty days from the date of booking of the consignment by the Shipper.
17. Only the competent courts of Mumbai shall have the exclusive jurisdiction to try and disputes arising out of this CN.
